HomeMy WebLinkAboutORD-05-01 Amend Master Schedule- New Water Rates and FeesORDINANCE NO. 5- 01 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING AND REVISING THE MASTER SCHEDULE OF FEES AND CHARGES TO ADOPT NEW WATER RATES AND NEW WATER FEES AND CHARGES.WHEREAS, on June 12, 1984, the City Council adopted Resolution No. 6100 which implemented the Master Schedule of Fees and Charges; and WHEREAS, the City Council has determined that the Master Schedule should be amended for fees and user charges of the City's Water Division; and WHEREAS, the City Council reviewed the February 14, 2001, Hilton, Famkopf &Hobson Water Rate Report and desires to adopt the recommendations set forth in Alternative Number 3.NOW, THEREFORE, THE COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS:1. The Master Schedule of Fees and Charges is hereby amended to include Attachment A" (Water Rates) and Attachment "B" (Water Fees and Charges).2. The City Council finds that the fees and charges set forth in Attachments "A" and B" do not exceed the reasonable costs of providing the respective goods, facilities and/or services pertain:lng to each rate, fee, and charge. Provided that the Public Works Director shall report annually to the City Council prior to any annual increases approved by this ordinance.3. The City Manager is authorized to approve a rate indexing formula for pass through costs related to energy charges, Orange County Water District replenishment assessment charges and purchased water charges with an annual maximum pass through rate adjustment not to exceed 6%. However, prior to implementation the City Manager shall prepare a report to the City Council at a regularly scheduled meeting, identifying the proposed pass through and the need therefore.4. If any rate, fee, or charges set forth in this Ordinance or the application thereof to any person or circumstance is held to be unconstitutional or otherwise invalid by any court of competent jurisdiction, such invalidity shall not affect any other rate, fee, or charge, or application thereof: which can be implemented without the invalid rate, fee, or charged, or application thereof,and to this end the rates, fees, and charges of this Ordinance are declared to be severable.ADOPTED this 13th day of March, ATTEST: j~ Cassandra J.
