HomeMy WebLinkAboutORD-11-02 Amend Administration of City Boards, Commissions and CommitteesI I ORDINANCE NO. 11- 02 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING CERTAIN PROVISIONS OF THE ORANGE MUNICIPAL CODE RELATING TO THE ADMINISTRATION OF CITY BOARDS, COMMISSIONS AND COMMITTEES.WHEREAS, the City Council desires to make certain revisions to the Orange Municipal Code relating to the administration of certain City boards, commissions and committees.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS:SECTION I:Chapter 2.55 is added to the Orange Municipal Code, to read as follows:Chapter 2. 55 ADVISORY BOARDS, COMMISSIONS AND COMMITTEES GENERAL PROVISIONS Sections:2.55.010 Removal of Members of Boards, Commissions and Committees. Vacancies.Records; Annual Reports.Biennial Review.2.55. 020 2.55. 030 2.55. 040 2.55.010 Removal of Members of Boards, Commissions and Committees.A. Members of boards, commissions and committees serve at the pleasure of the City Council. Unless otherwise provided for in law, any member of a board,commission or committee may be removed at any time, with or without cause, by a majority vote of all the members of the City Council.B. Effective May 14, 2002, members of boards, COnnll1SSlOnS and committees may serve no more than twelve consecutive years on the board,commission or committee to which they are appointed. No member of a board,commission or committee who has served twelve consecutive years shall be for reappointment to the same board, commission and committee prior to the passage of a two year interval. 2.55.020 Vacancies. If a vacancy on a board, commission or committee shall occur, other than by expiration of a term, such vacancy shall be filled by the City Council by appointment for the unexpired portion of the term. 2.55.030 Records; Annual Reports. A. Each board, commission and committee shall keep a record of its minutes, actions, findings and determinations, showing the vote of each member upon each question, or, if absent or failing to vote, indicating such fact. Said records shall be forwarded to the City Clerk for filing and they shall be public records. B. Each board, commission and committee shall submit an annual report to the City Council no later than October 31 sl of each year, Attendance records of members shall be included as part of the annual report. 2.55.040 Biennial Review. In December of a regular City Council election year, or as soon thereafter as the City Council directs, the City Council shall review the annual reports of the boards, commissions and committees. SECTION II: Section 2,60.030 of the Orange Municipal Code IS amended to read as follows: 2.60.030 Appointments and Terms. Members of the Park Planning and Development Commission shall be appointed by the Mayor, subject to the advice and consent of the City Council. Of the members of the Commission first appointed under this chapter, two members shall be appointed for an initial term of two years and three members shall be appointed for an initial term of three years. Following the initial appointments, all terms of office shall run for a term of four years. The terms of office for each member of the Commission shall continue to and include April 30th of the year in which the term shall expire, and thereafter until a successor for the member whose term is expiring has been appointed. Ord. No. ] 1-02 2 I I SECTION III: Section 2.64.020 of the Orange Municipal Code IS amended to read as follows: 2.64.020 Term of Office. A. The terms of office of each member of the Planning Commission shall be four years, B. The terms of office for each member of the Planning Commission shall continue to and include June 30th of the year in which the term shall expire, and thereafter until a successor for the member whose term is expiring has been appointed." SECTION IV: Section 10.06.020 of the Orange Municipal Code is amended to read as follows: 10.06.020 Terms of Office. A. The terms of office for each member of the Traffic Commission shall be four years. The terms of office for each member of the Traffic Commission shall continue to and include June 30th of the year in which the term shall expire, and thereafter until a successor for the member whose term is expiring has been appointed. B. At the first meeting after June 30th of every other year, the Traffic Commission shall select from their membership a chairman and a vice-chairman to serve two year terms.SECTION V:Subparagraph D of Section 17.08.020 of the Orange Municipal Code IS amended to read as follows:D. Design Review Committee.The Design Review Committee is established to uphold community aesthetics.Recognizing that the inclusion of specific aesthetic development standards is impracticable due to the variable nature of architectural concepts, construction materials and aesthetic goals from one time period to another and from one neighborhood to another, it is in the public interest to establish an authority for project revIew.Ord. No. t 1.02TJR 1. Purpose. a. To review development projects, by considering the elements of architectural design, massing and scale, color palette, context, landscaping and signage to ensure that projects are compatible with surrounding development and community aesthetics. b. To interpret and apply adopted design guidelines and standards. c. To assist in formulating design policy. d. To encourage the preservation of cultural historic resources, while allowing for orderly development. 2. Powers and Duties. The Design Review Committee shall have the authority to: a. Make final determination on signs and sign programs III accordance with Chapter 17.36 of this code; b. Make final determination on architectural and landscaping design matters for minor site plan review applications when referred by Staff Review Committee; c. Make final determination on architectural and landscaping design matters for external remodeling of commercial, industrial, institutional and large scale multiple family developments, except for minor site plan review projects acted upon by the Staff Review Committee; d. Make final determination on architectural and landscaping design matters for projects in the Old Towne Historic District, when no Planning Commission review is otherwise required; e. Review and make recommendations to the Planning Commission on architectural and landscaping design matters for all development projects and proposed demolitions requiring Planning Commission recommendation or approval. 3. Meetings. a. The Design Review Committee shall meet in regular session on dates and at times to be determined from time to time by resolution of the City Council. All meetings shall be open to the public, and provisions of the Brown Act shall apply. Ord. No. ] 1-02 4 I I b, Committee members shall be compensated for each meeting as determined by resolution of the City Council. c. Three members shall constitute a quorum. A majority vote of the quorum present shall be required for all Committee actions. Failure to achieve a majority vote of members present shall constitute a denial of the proposed action. 4. Membership. a. The Design Review Committee shall consist of five members of the public. Committee members shall be persons who, as a result of their training, knowledge and experience, are qualified to analyze and interpret architectural and site planning information, including but not limited to, licensed landscape architects and architects, urban planners, engineers, licensed general contractors. At least two of the members shall have professional experience in urban planning, architectural history or historic preservation and shall have general knowledge of architectural styles prevalent in Old Towne. b. Appointed members of the Committee shall live or work in the City and shall be appointed for four-year terms.c. Staff expertise in historic preservation and landscaping shall be available as a resource to the Committee.5. Officers/Terms of Office.a. Officers shall consist of a Chairman and Vice- chairman, both of whom shall be selected by the members of the Committee.b. The terms of office for each member of the Committee shall continue to and include June 30th of the year in which the term shall expire,and thereafter until a successor for the member whose term is expiring has been appointed.6. Rules and Regulations.The Design Review Committee shall adopt and amend, by the affirmative vote of three members, rules and regulations for the conduct of the Committee' s business consistent with this chapter subject to approval by the City Council.Oed. No. 11- SECTION VI: A summary of this Ordinance shall be published and a certified copy of the full text of this Ordinance shall be posted in the Office of the City Clerk at least five 5) days prior to the City Council meeting at which this Ordinance is to be adopted. A summary of this Ordinance shall also be published once within fifteen (15) days after this Ordinance's passage in a newspaper of general circulation, published, and circulated in the City of Orange. The City Clerk shall post in the Office of the City Clerk a certified copy of the full text of such adopted Ordinance along with the names of those City Council members voting for and against the Ordinance in accordance with Government Code Section 36933.
