AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF ORANGE APPROVING THE RECLASSIFICATION OF
THE FOLLOWING: (1) APPROXIMATELY 36 ACRES OF
PROPERTY WITHIN THE SANTIAGO CREEK CHANNEL
SOUTH OF MABURY AVENUE AND NORTH OF
SANTIAGO CANYON ROAD FROM SAND AND GRAVEL
TO RECREATION-OPEN SPACE; (2)
APPROXIMATELY EIGHT ACRES OF PROPERTY NORTH OF
SANTIAGO CANYON ROAD FROM SAND AND GRAVEL
TO RECREATION-OPEN SPACE; (3)
APPROXIMATELY 34 ACRES OF PROPERTY ADJACENT
TO SANTIAGO CANYON ROAD AND THE
RESERVE DEVELOPMENT FROM SAND AND GRAVEL TO
R-I-8 (RESIDENTIAL,MINIMUM LOT SIZE, 8,000
SQ. FT.); AND (4)APPROXIMATELY 20 ACRES
OF PROPERTY SOUTH OF SANTIAGO CREEK AND
NORTH OF SANTIAGO CANYON ROAD FROM SAND
AND GRAVEL TO R-I-6 RESIDENTIAL, MINIMUM
LOT SIZE 6,

CHANGE 1208-00 APPLICANT: FIELDSTONE COMMUNITIES, INC.WHEREAS, the City Council of the
City of Orange is authorized by Government Code Section 65850 to adopt ordinances
amending the City's zoning laws; and WHEREAS, the CityCouncilhasconsideredFinalEnvironmentalImpactReportNo. l647-00 (hereafter, the "FEIR")
and accompanying documents, the Findings of Fact and Statement of Overriding
Considerations dated August 12, 2003, the Mitigation Monitoring Program dated August 12, 2003
and the Conditions of Approval
and Mitigation Measures dated September 23, 2003; and WHEREAS, the City Council
has certified the FEIR and made the necessary findings as is
fully set forth in Resolution No. 9776; and WHEREAS, the City Council has approved
and adopted the Findings of Fact and Statement of Overriding Considerations
and the Mitigation Monitoring Program and made the necessary findings as is
fully set forth in Resolution No. 9777;WHEREAS, the City Council
has approved and adopted General Plan Amendment No. 1-01 and made the necessary findings as
WHEREAS, the City Council has approved and adopted Conditions of Approval
and Mitigation Measures and made the necessary findings as is fully set forth in Resolution
No. 9779; and
WHEREAS, the City Council held three duly advertised hearings, on July 22,2003,
August 12, 2003, and on September 9, 2003, for the purpose of considering the various
applications and documents described above, as well as Zone Change 1208-00
upon property as shown in the attached Exhibit
B.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
ORANGE DO}:S ORDAIN AS
FOLLOWS:SECTION
I:Existing zoning on the 11 O-acre site consists of
the following:1. Approximately 98 acres of Sand
and Gravel.2. Approximately 12 acres ofR-I-8 (Residential minimum lot
size,
8,000 square feet).The existing zoning on the site is depicted on the map attached
hereto as Exhibit A and
incorporated herein by reference.Section 17.06.030 of the Orange Municipal Code is amended in
order to change the zoning classification ofthe l1O-acre site
to consist of the following:1. Approximately
36 acres of Open Space.2. Approximately 8
acres of Open Space-Public Park.3. Approximately 46 acres ofR-1-8 (
Residential, minimum lot size 8,000 sq. ft.).4. Approximately 20 acres ofR-
1-6 (Residential, minimum lot size 6,000 sq. ft.).The amended zoning on the
site is depicted on the map
attached hereto
as Exhibit B" imd incorporated herein by reference.SECTION II:1. The proposed zone
changes described in Section I are related to the public welfare, are
consistent with adopted General Plan Amendment 1-01, and further the obje(:tives and policies of the
General Plan as is more specifically set forth in Resolution No.Resolution No. 9778, which
is
incorporated
SECTION III:
A
summary of this Ordinance shall be published and a certified copy of the full text of
this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the
City Council meeting at which this Ordinance is adopted. A summary ofthis Ordinance shall
also be published once within fifteen (15) days after this Ordinance's passage in a newspaper
of general circulation, published, and circulated in the City of Orange. The City Clerk
shall post in the Office of the City Clerk a certified copy of the full text of such adopted
Ordinance along with the names of those City Council members voting for and against
the Ordinance in accordance with Government Code Section 36933. This Ordinance shall
take effect thirty (30) days from and after the date of its final passage.ADOPTED
