03 AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ORANGE AMENDING
ORANGE MUNICIPAL CODE SECTIONS 2.16.030
AND 2.16.060 PERTAINING TO DELEGATION
OF DUTIES OF THE CITY
MANAGER.WHEREAS, the City of Orange created the position of Assistant City Manager with
the intent that the Assistant City Manager assume the duties of City Manager in the City Manager'
s absence and to assist the City Manager in the performance of his duties;
and WHEREAS, the City Council desires to permit the City Manger to delegate duties
to the Assistant City Manager to the extent the City Manager desires upon written notification
to the City Council;
and WHEREAS, the City Council desires to provide by this Ordinance that the
Assistant City Manager will act as the City Manager in the event the City Manager is absent for
whatever cause except in those cases in which the City Manager specifically delegates his duties
to someone other than the Assistant City
Manager.NOW THEREFORE, the City Council of the City of Orange does ordain as
follows:SECTION
I:Section 2.l6.030D of Chapter 2.16 of the Orange Municipal Code is repealed in
its entirety and replaced with the
following:D. Delegate Duties. Have the power to direct any department, division or bureau
to perform the work for any other department, division or bureau or to authorize the Assistant
City Manager to perform any of the City Manager's duties enumerated in the Orange
Municipal Code if such authorization is reduced to writing and provided to the City Council and
City
Clerk.SECTION
II:Section 2.l6.060C of Chapter 2.16 of the Orange Municipal Code is repealed in
its entirety and replaced with the
following:C. Absence. The Assistant City Manager shall serve as acting City Manager during
any temporary absence or disability of the City Manager unless the City Manager designates
in writing, a City Department Head or other City employee to act as City Manager. In the event
of the absence of the Assistant City Manager and the failure by the City Manager to appoint a
Department Head to act as City Manager, the City Council may appoint a City Department
Head or other person to perform the duties of City Manager during the period of absence or
disability ofthe City Manager.
SECTION III:
Should any section, subsection, clause, or provision of this Ordinance for any reason be
held to be itlValid or unconstitutional, such invalidity or unconstitutionality shall not affect the
validity or constitutionality of the remaining portions of this Ordinance; it being hereby
expressly declared that this Ordinance, and each section, subsection, sentence, clause and
phrase hereof would have been prepared, proposed, approved and ratified irrespective of the
fact that arty one or more sections, subsections, sentences, clauses or phrases be declared
invalid or unconstitutional.
SECTION IV:
A summary of this Ordinance shall be published and a certified copy of the full text of
this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the
City Council meeting at which this Ordinance is to be adopted. A summary of this Ordinance
shall also be published once within fifteen (15) days after this Ordinance's passage in a
newspaper of general circulation, published, and circulated in the City of Orange. The City
Clerk shall post in the Office of the City Clerk a certified copy of the full text of such adopted
Ordinance along with the names of those City Council members voting for and against the
Ordinance in accordance with Government Code Section 36933. This Ordinance shall take
effect thirty (30) days from and after the date of its final passage.
