HomeMy WebLinkAboutORD-19-03 Amend Portions of Title 10- Parking Time LimitationsORDINANCE NO. 19- 03 AN ORDINANCE OF THE CITY COUNCIL OF TH}:CITY OF ORANGE AMENDING PORTIONS OF CHAPTERS 10.30, 10.34 AND10.42 OF TITLE 10 OF THE ORANGE MUNICIPAL CODE RELATING TO PARKING TIME LIMITATIONS ON PLAZA SQUARE AND BOTH PERMIT PARKING ro:QUlREMENTS AND PARKING TIME LIMITATIONS ON CERTAIN MUNICIPAL PARKING LOTS SERVING THE CENTRAL PUBLIC SQUARE AND CIRCULAR PLAZA AT GLASS ELL STREET AND CHAPMAN AVENUE.WHEREAS, Chapter 10.30 of the Orange Municipal Code regulates those areas in the City which are subject to the Neighborhood Parking Permit Program, including permit parking on municipal parking lots serving the central public square and circular plaza at Glassell Street and Chapman Avenue (the Plaza); and WHEREAS, it is more efficient to remove from Chapter 10.30 the specific fees for permit parking in certain municipal parking lots serving the Plaza and to allow for such fees to be set forth in the City's Master Schedule of Fees and Charges by the adoption of a resolution of the City Council, as the same may be: amtmded from time to time; and WHEREAS, Chapter 10.34 of the Orange Municipal Code prohibits or restricts,among other things, the stopping, parking or standing of vehicles on certain streets or highways during all or certain hours of the day, which the City Council now desires to amend, in part; and WHEREAS, Chapter 10.42 of the Onmge Municipal Code regulates off-street parking lots located in the City of Orange, which the City now desires to amend, in part, to increase from two hours to three hours the time limit for parking spaces within certain municipal parking lots serving the Plaza; and WHEREAS, the City Council finds that the approval of fees for permit parking authorized by this ordinance is exempt from the California Environmental Quality Act (CEQA)pursmmt to Section 15272 of the State CEQA Guidelines because the fees to be collected are necess,ary to maintain the municipal parking lots serving the Plaza; and WHEREAS, the City Council finds that the modification of the time limits for parking of vehicles on Plaza Square and certain streets serving the Plaza, as described herein below, falls within that class of projects which will not cause a significant effect on the environment and is exempt from the California Enviromnental Quality Act ( CEQA) pursuant to Section 15301 of the State CEQA Guidelines b'~caust~ such action involves negligible or no expansion of use of the streets beyond that NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS: SECTION I: Section 10.30.030 of the Orange Municipal Code is repealed in its entirety and replac(:d with a new Section 10.30.030 to read as follows: 10.30.030 Permit Parking--Plaza Area.A. The City Traffic Engineer is authorized to designate and to alter, from time to time, the number and locations of spaces for permit parking at all parking lots owned by the City of Orange serving the central public square and circular plaza at Glassell Street and Chapman Avenue (the Plaza), which parking lots are described in Section10.42.050 of this code. Furthermore, the City Traffic Engineer is authorized to establish from time to time,and to change, alter, and amend, and the Chief of Police is authorized to enforce, any reasonable rules and regulations which are deemed necessary or advisable for the proper and efficient operation of the permit parking at all such parking lots.B. Permits shall be issued by the City's Director of Finance on a semi-annual basis in an amount and based upon the fees therefor established and adjusted, from time to time, by resolution of the City Council amending the Master Schedule of Fees and Charges. Permits shall be affixed or attached to a permittee's motor vehicle in an area or location as designated by the Chief of Police. SECTION II:Section 10.34.030 of the Orange Municipal Code is repealed in its entirety and replacl:d with a newSection 10.34.030 to read as follows:10.34.030 Parking Limited to Thirty Minutes--Green Curb.No person shall stop or park a vehicle longer than thirty ( 30) minutes during designated hours of designated days in any thirty (30) minute parking zone.SECTION III:Section 10.34.040 of the Orange Municipal Code IS repealed in its entirety and replacl:d with anew Section 10.34.040 to read as follows:10.34. 040 One-Hour Parking--Generally.No person shall stop or park a vehicle longer than one hour continuously during designated hours of designated days in anyone-hour parking SECTION IV: Section 10.34.050 of the Orange Municipal Code IS repealed in its entirety and replaced with a new Section 10.34.050 to read as follows: 10.34.050 Two-Hour Parking-Generally.No person shall stop or park a vehicle longer than two hours continuously during designated hours of designated days in any two- hour parking zone.SECTIONV:Section 10.42.050 of the Orange Municipal Code is repealed in its entirety and replaced with anew Section 10.42.050 to read as follows:10.42.050 Off-Street Parking Lots-.Three-Hour Limit.A. No person shall stop or park a vehich: longer than three hours continuously during designated hours of designated days upon the fi)llowing parking lots owned and under the control of the City and located in the City:1. The southwest comer of Orange Street and Maple Avenue;2. The southeast comer of Olive Street and Maple Avenue;3. On South Grand Street between 124-142 South Grand Street and 230 E.Chapman Avenue;4. The 100 block of South Orange Street;5. The 100 block of North Orange Street;6. On the east and west sides of the 100 block of South Olive Street; and 7. The 100 block of North Olive Street.B. Appropriate signs shall be posted by the City Traffic Engineer in and about the parking lots specifying the aforementioned time limit.SECTION VI:A summary of this Ordinance shall be published and a certified copy of the full text of this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the City Council meeting at which this Ordinance is to be adopted. A summary of this Ordinance shall also be published once within fifteen (I5} days after this Ordinance's passage in a newspaper of general circulation, published, and circulated in the City of Orange. The City Clerk shall post in the Office of the City Clerk a certified copy of the full text of such adopted Ordinance along with the names of those City Council members voting for and against the Ordinance in accordance with Government Code Section 36933.
