I AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ORANGE AMENDING CHAPTER 12.02
OF THE ORANGE MUNICIPAL CODE TO ADOPT
THE 2003 EDITION OF THE STANDARD
SPECIFI-CATIONS FOR PUBLIC WORKS
CONSTRUCTION.NOW, THEREFORE, the City Council of the City of Orange does ordain as
follows:SECTION
I:Chapter 12.02 of the Orange Municipal Code IS hereby repealed III its entirety
and replaced with the
following:Chapter 12.
02 STANDARD SPECIFICATIONS
FOR PUBLIC WORKS
CONSTRUCTION

Standards
I 12.02.010 Adopted by Reference. Except as may otherwise be provided herein,
the provisions of the 2003 edition of the Standard Specifications for Public Works
Construction,prepared and promulgated by the Southern California Chapter of the American Public
Works Association and the Southern California Districts of the Associated General Contractors
of California, are adopted and applicable to all public works construction undertaken after
the effective date of this ordinance. One copy of the Standard Specifications for Public
Works construction has been and is now filed with the office of the City Clerk, and said
Standard Specifications for Public Works Construction is adopted by reference as if incorporated and
set out at length in this
Chapter.12.2.20.1 Imposition of Stricter Standards. Whenever any provision
or requirement of this Chapter conflicts with any other provision or requirement of the Code or
the City's Standard Plans and Specifications, as amended from time to time, such other provision
or requirement or the City's Standard Plans and Specifications shall
apply.SECTION
U:Sh(luld any section, subsection, clause, or provision of this Ordinance for any reason
be held to be invalid or ul1constitutional, such invalidity or unconstitutionality shall not affect
the validity or constitutionaiity of the remaining portions of this Ordinance; it being hereby
expressly declared that this Ordinance, and each section, subsection, sentence, clause and phrase
hereof would have been prepared, proposed, approved and ratified irrespective of the fact that
anyone or more ~ections, subsections, sentences, clauses or phrases be declared invalid
or
SECTION III:
A summary of this Ordinance shall be published and a certified copy of the full text of
this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the
City Council meeting at which this Ordinance is to be adopted. A summary of this Ordinance
shall also be published once within fifteen (15) days after its passage in a newspaper of general
circulation in the City of Orange. The City Clerk shall post in the Office of the City Clerk a
certified copy of the full text of the adopted Ordinance along with the names of those City
Council members voting for and against the Ordinance in accordance with Government Code
Section 36933.
