THE CITY OF ORANGE AMENDING SECTION 13.08.
010 OF TITLE 13 OF THE ORANGE MUNICIPAL
CODE RELATING TO WATER DEPOSITS AND
ACCOUNT ESTABLISHMENT
FEES"THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS
FOLLOWS:SECTION
I:Section 13.08.010 of Chapter 13.08 of Title 13 of the Orange Municipal Code is
hereby deleted in its entirety and replaced with the following new Section 13.08.010, to read in full
as
follows:13.08.10
Application-Form.Each applicant for water service shall provide to the City
the following:A. The applicant's name and
phone number;B. The location of the premises to
be served;C. The date on which the applicant
requests service;D. For residential accounts, the applicant's driver's license number
and social
security number;E. For commercial accounts, the applicant's taxpayer identification
number or social
security number;F. A utility account deposit in such amount as is specifically set in
the Master Schedule of Fees and Charges, as the same may be revised
periodically by resolution of the City Council. However, no deposit shall
be required provided that within ten (10) days of application, the
applicant provides satisfactory proof that they have made twelve (12)
consecutive on-time water payments at their most reCf:nt water service
location. For the purpose of this chapter, the tenn "on-time water
payments" is defined as payments made prior to the issuance
of a delinquent notice;G. The address to which bills are to
be mailed or delivered;H. Whether the applicant is an owner or tenant of, or
1. A utility account establishment fee in such amount as is specifically set in
the Master Schedule of Fees and Charges, as the same may be revised
periodically by resolution of the City Council; and
J. Such other information as the City may reasonably request.
SECTION II:
Should any section, subsection, subparagraph, clause, or provision of this Ordinance for
any reason be held to be invalid or unconstitutional, such invalidity or unconstitutionality shall
not affect the validity or constitutionality of the remaining portions of this Ordinance; it being
hereby expressly declared that this Ordinance, and each section, subsection, subparagraph,
sentence, clause and phrase hereof would have been prepared, proposed, approved and ratified
irrespective of the fact that anyone or more sections, subsections, subparagraphs, sentences,
clauses or phrases be declared invalid or unconstitutional.
SECTION III:
A summary of this Ordinance shall be published and a certified copy of the full text of
this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the
City Council meeting at which this Ordinance is to be adopted. A summary of this Ordinance
shall also be published once within fifteen (15) days after this Ordinance's passage in a
newspaper of general circulation, published; and circulated in the City of Orange. The City
Clerk shall post in the Office of the City Clerk a certified copy of the full text of such adopted
Ordinance along with the names of those City Council members voting for and against the
Ordinance in accordance with Government Code Section 36933. This Ordinance shall take
effect thirty (30) days from and after the date of its final passage.
