HomeMy WebLinkAboutORD-14-03 Amend Master Schedule of Fees & Charges- New Sanitization Service FeesORDINANCE NO. 14- 03 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING AND REVISING THE MASTER SCHEDULE OF FEES AND CHARGES TO ADOPT NEW CITY SANITATION SERVICE FEES. WHEREAS, on April 22, 2003, the City Council adopted Resolution No. 9722 which implemented the Master Schedule of Fees and Charges; and WHEREAS, pursuant to the authority set forth in Section 13.60.015 of the Orange Municipal Code and Section 5471 of the Health and Safety Code the City may adopt Sanitation and Sewage system fees by ordinance and include them in the City's Master Schedule of Fees and Charges; and WHEREAS, the City Council of the City of Orange desires to revise the fee charged for City Sanitation Services for sewer cleaning, street sweeping, stormwater maintenance and environmental compliance programs; and WHEREAS, the City Council of the City of Orange finds and detennines that due to increased costs in providing City Sanitation Services, the proposed fees are reasonable and do not excl~ed the estimated costs of providing the services. NOW, THEREFORE, the City Council of the City of Orange hereby ordains as follows: SECTION I: 1. All fees shown in Attachment A in the Master Schedule of Fees and Charges are deleted and shall be replaced with the fees shown in Attachment B (City Sanitation Fees). 2. The City Council finds that the City Sanitation Fees set forth in Attachment B do not exceed the reasonable costs of providing the respective goods, facilities and/or services pertaining to each service. SECTION II: Should any section, subsection, clause, or provision of this Ordinance for any reason be held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity of constitutionality of the remaining portions of this Ordinance; it being hereby expressly declared that this Ordinance, and each section, subsection, sentence, clause and phrase hereof would have been prepared, proposed, approved and ratified irrespective of the fact that any onl~ or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. SECTION III: A summary of this Ordinance shall be published and a certified copy of the full text of this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the City Council meeting at which this Ordinance is to be adopted. A summary of this Ordinance shall also be published once within fifteen (15) days after this Ordinance's passage in a newspaper of general circulation, published, and circulated in the City of Orange. The City Clerk shall post in the Office of the City Clerk a certified copy of the full text of such adopted Ordinance along with the names of those City Council members voting for and against the Ordinan(:e in accordance with Government Code Section 36933. Ca ct, lty Clerk, City of Orange 2 EXHIBIT "A" From Ordinance 4- 99 OTHER CITY SANITATION SERVICES The City furnishes to its residents, businesses and industrial clients, sewer cleaning, street sweeping, storm drain maintenance, litter pickup, street tree maintenance, code enforcement costs related to such service, and other services to provide a clean and healthful environment.For such services and facilities, the following charges are fixed to premised to which a sewer main is available.A. Single-family dwelling, $5.34 per month.B. Single-family dwelling units in any duplex, double house, and other buildings containllng only single-family dwelling units, $5.34 per month per unit.C Apartment house, $5.99 per unit per month where binservice is utilized; $5.34 per unit per month where bin service is not utilized. When the Director of Public Works determines that it liS not reasonably possible to place a trash bin at an active water meter service for a building generating trash in excess of five 45-gallon containers per week, the charge for each unit of such multiple-family building shall be an additional $ 5.34 per month per unit.D, Hotel, motel, bungalow court, or auto court, $5.99 per month for each dwelling unit herein with cooking facilities where bin service is utilized; $5.34 per month where bin service is not utilized.E. Hotel, motel, bungalow court, or auto court, $1.24 per month for each dwelling unit with private toilet facilities only, other than a dwelling unit described in Subsection D above.F. For each water closet in any hotel, motel, bungalow court, or auto court other than a water closet in any dwelling unit in Subsections D and E hereof, the sum of $5.99 per water closet where bin service is utilized, $5.34 per month, where bin service isnot utilized.G. Rooming house, $5.34 per month, together with $1. 24 per month for each rented room.H. Clubhouse, equipped with sanitary plumbing facilities. $ 5.99 per month for one water closet where bin service is utilized. $5.34 per month where bin service is not utilized, and 1.24 per month for each additional water closet.1. For each office situated in any building where bin servIce is utilized, $5.99 per month, wherebin service is not J. Trailer camps or trailer parks, $5.34 per month for each trailer space, provided that if any such trailer camp or trailer park utilizes bin service, rate shall be $5.99 plus $1.24 per month for each additional water closet. K. For all other premises not specifically mentioned in the section where such premises are occupied by one or more persons, or is used for commercial, professional, manufacturing, or processing purposes with sanitary plumbing facilities $5.99 where bin service is utilized, where bin service is not utilized $5.34 per month, plus $1.24 per month for each additional water closet. L. For condominiums and townhouses with individual water meters and utilizing bin service, $5.20 per month per unit, where bin service is not utilized $5.34 per month per unit. M For all other purposes not specifically mentioned in this section and do not utilize trash selvice from the City Contractor, $5.34 per month per unit. 4 EXHIBIT"B" CITY SANITATION SERVICES The City furnishes to its residents, businesses and industrial customers, sewer cleaning, street sweeping, stormwater maintenance/environmental compliance for water quality and solid waste, and street tree maintenance. Fees for sewer cleaning, street sweeping and stormwater/environmental compliance are based on water consumption, per one hundred cubic feet (hc:f). Street tree maintenance is a flat fee per unit per month. Section II.Sanitation Customers not on City of Orange Water Service: City of Orange Sanitation Services customers not serviced by City of Orange Water will be charged a flat monthly fee. The monthly fee for detached, single family homes will be based on median water consumption of a single family residential City of Orange Water customer (20 hcf/mo.) plus the single family residential street tree maintenance flat monthly fee.
