HomeMy WebLinkAboutORD-12-02 Zone Change 1213-02 - Trico RealtyORDINANCE NO. 12- 02 I AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING TITLE 17 OF THE ORANGE MUNICIPAL CODE AND APPROVING THE RECLASSIFICATION OF PROPERTY LOCATED AT 411 TO 421 SOUTH BATAVIA STREET AND 802 WEST CULVER AVENUE FROM R-3 AND R- 2 TO OP. Zone Change 1213- 02 Applicant: TRICO REALTY WHEREAS, the City Council of the City of Orange is authorized by Government Code Section 65850 to adopt ordinances amending the City' s zoning laws; and WHEREAS, the City Council has considered the information contained in Mitigated Negative Declaration 1695-02, including the initial study and comments received during the public review process, and has found that there is no substantial evidence that the project will have a significant impact on the environment or wildlife and that any significant impacts can be mitigated to a level of insignificance; and WHEREAS, the City Council held one duly advertised hearing on November 12, 2002,for the purpose of considering Zone Change No. 1213- 02 upon property described as follows:See attached NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS:SECTION I:Section 17.06.030 of the Orange Municipal Code is amended in order to change the zoning classification of the above described property as follows:I From R3 (multi-family residential) and R2 (duplex residential) to OP (Office Professional) for the property generally situated at 411 to 421 South Batavia Street and 802 West Culver Avenue, and more particularly described in the recitals above.SECTION II:1. The proposed change from R3 and R2 to OP is consistent with the recommended Major Site Plan Review 227-02, Resolution No. 9682; and 2. The proposed change from R3 and R2 to OP is SECTION III: A summary of this Ordinance shall be published and a certified copy of the full text of this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the City Council meeting at which this Ordinance is adopted. A summary of this Ordinance shall also be published once within fifteen (15) days after this Ordinance's passage in a newspaper of general circulation, published, and circulated in the City of Orange. The City Clerk shall post in the Office of the City Clerk a certified copy of the full text of such adopted Ordinance along with the names of those City Council members voting for and against the Ordinance in accordance with Government Code Section 36933. This Ordinance shall take effect thirty (30) days from and after the date of its final passage.
