HomeMy WebLinkAboutORD-8-04 Amend 17.14 &17.10- Infill Residential DevelopmentORDINANCE NO. 8- 04 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING THE ORANGE MUNICIPAL CODE BY ADDING SECTION 17.14.255 AND AMENDING SECTION 17.10. 070 TO ESTABLISH PROCEDURES FOR THE REVIEW OF INFILL RESIDENTIAL DEVELOPMENT. RECITALS After report thereon to the Planning Commission and after due public hearing as required by law, the City Council of the City of Orange has concluded that the following changes to the Orange Municipal Code should be adopted:NOW THEREFORE, the City Council of the City of Orange hereby ordains as follows:SECTION I:Section 17.10.070.8. (When Design Review is Required) of the Orange Municipal Code is hereby amended to add the following:B. When Design Review is Required. Design review is required for all projects listed below:I. Development projects requiring Planning Commission or City Council approval;2. Any project requiring major site plan review;3. Signs as specified in Chapter17. 36;4. All projects located within a redevelopment project area except where otherwise exempted by the specific design guidelines adopted for the project area;5. All projects within Old Towne or other historic districts as established, except where otherwise exempted by adopted design standards and/or adopted specific planes);6. All projects for external remodeling of commercial, industrial, institutional and large scale multiple family developments, except where otherwise exempted by City codes,including adopted design standards and/or adopted specific planes).7. Infill residential development as specified in the City of Orange Infill Residential Design Guidelines. SECTION II: Section 17.IO.070.F (Design Review Findings Required) of the Orange Municipal Code is hereby amended to add the following: F. Findings Required. The reviewing body shall make findings for all projects based upon design criteria stated above. A specific finding shall be made for projects as follows: I. In the Old Town Historic District, the proposed work conforms to the prescnplive standards and design criteria referenced and/or recommended by the Design Review Committee or other reviewing body for the project. 2. In any National Register Historic District, the proposed work complies with the Secretary of the Interior's Standards and Guidelines. 3. The project design upholds community aesthetics through the use of an internally consistent, integrated design theme and is consistent with all adopted specific plans, applicable design standards and their required findings. 4. For infill residential development, as specified in the City of Orange Infill Residential Design Guidelines, the new structure(s) or addition are compatible with the scale, massing, orientation, and articulation of the surrounding development and will preserve or enhance existing neighborhood character. SECTION III: Section 17.14.255 (Infill Residential Design Guidelines) is hereby added to the Orange Municipal Code to read as follows: 17.14.255 Infill Residential Design Guidelines. Infill residential development shall conform to the City of Orange Infill Residential Design Guidelines adopted by resolution and available at the Community Development Department. SECTION IV: A summary of this Ordinance shall be published and a certified copy of the full text of this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the City Council meeting at which this Ordinance is to be adopted. A summary of this Ordinance shall also be published once within fifteen (15) days after this Ordinance's passage in a newspaper of general circulation, published, and circulated in the City of Orange. The City Clerk shall post in the Office of the City Clerk a certified copy of the full text of such adopted Ordinance along with the names of those City Council members voting for and against the 2 Ordinance in accordance with Government Code Section 36933. This Ordinance shall take effect thirty (30) days from and after the date of its final passage. ADOPTED this 13th day of April, 2004. ATTEST: City Clerk, City 0MaryE.
