04 AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ORANGE AMENDING CHAPTER 2.34
OF TITLE 2 OF THE ORANGE MUNICIPAL
CODE RELATING TO THE CITY'S DEPARTMENT
OF PUBLIC
WORKS.WHEREAS, Chapter2.34 of the Orange Municipal Code sets forth the duties of
the City's Director of Public Works;
and WHEREAS, the purpose of this ordinance is to designate the Director of Public
Works as the City Engineer and authorize the Director of Public Works to establish and amend
from time to time certain standard plans and specifications to be used for all public works
contracts awarded by the City of
Orange.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
ORANGE DOES ORDAIN AS
FOLLOWS:SECTION
I:Chapter 2.34 of the Orange Municipal Code is hereby deleted in its entirety
and replaced with the following new Chapter2.34. to read in full as
follows:Chanter 2.

Director--Duties.Standard Plans
and Specifications.2.34.
010 Director--Duties.The Director of Public Works shall be responsible for all matters
relating to construction,management, maintenance and operation of the physical properties of the
City and all administratiye and field activities related to the City's water system
and perform all duties of the city engineer, or similar designation, and such other related
duties as shall be required by law, ordinance or the city manager. The functions
ofthe department shall include, but not
be limited
to:A. Engineering;
B. Street maintenance;C.
D. Traffic engineering and services;
E. Real Property services;
F. Sanitation services.
G. Water services.
H. Vehicle Maintenance.
2.34.020 Standard Plans and Specifications.
The Director of Public Works is authorized to establish and amend from time to time certain
standard plans and specifications to be used for all public works contracts awarded by the City
of Orange, which shall be used along with the provisions of the latest edition of the Standard
Specifications for Public Works Construction (known as the Greenbook) and all amendments
thereto.
SECTION II:
Should any section, subsection, clause, or provision of this Ordinance for any reason be
held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the
validity or constitutionality of the remaining portions of this Ordinance; it being hereby
expressly declared that this Ordinance, and each section, subsection, sentence, clause and
phrase hereof would have been prepared, proposed, approved and ratified irrespective of the
fact that anyone or more sections, subsections, sentences, clauses or phrases be declared
invalid or unconstitutional.
SECTION III:
A summary of this Ordinance shall be published and a certified copy of the full text of
this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the
City Council meeting at which this Ordinance is to be adopted. A summary of this Ordinance
shall also be published once within fifteen (15) days after this Ordinance's passage in a
newspaper of general circulation, published, and circulated in the City of Orange. The City
Clerk shall post in the Office of the City Clerk a certified copy of the full text of such adopted
Ordinance along with the names of those City Council members voting for and against the
Ordinance in accordance with Government Code Section 36933. This Ordinance shall take
effect thirty (30) days from and after the date of its final passage.
