HomeMy WebLinkAboutORD-21-07 Amend Title 15- Construction CodesORDINANCE NO.21-07 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING SPECIFIED SECTIONS OF TITLE 15 OF THE ORANGE MUNICIPAL CODE RELATING TO CONSTRUCTION CODES AND ADOPTING THE 2007 EDITION OF THE CALIFORNIA CODES, RELATED MODEL CODES AND APPENDICES AND AMENDMENTS THERETO. WHEREAS, due to Fire Department logistical limitations and local high winds, the requirement of the high rise buildings in Building Code Section 202 is amended to apply to buildings over 55 feet high instead of over 75 feet high; and WHEREAS, due to Fire Department logistical limitation and local high winds, the requirement of high-rise buildings for standby and emergency power loads in Building Code Sections 403.10.2 and 403.11.1 are revised to place smoke proof enclosures in the emergency power category; and WHEREAS, due to Fire Department logistical limitation, the Fire Code requirement in for emergency helicopter landing facilities on high-rises is added to Building Code Section 412.5.1 to coordinate enforcement; and WHEREAS, due to Fire Department logistical limitation and local high winds Building Code Section 904 is modified to apply City of Orange Fire Ordinance (Chapter 15.32) building sprinkler amendments; and WHEREAS, due to serious hazard of rapid fire spread in local high winds, the use of untreated wood roofs and minimally protective roof assemblies and coverings permitted by the Building Code Section 1505 are prohibited for new buildings and re-roofing of existing buildings and are in part, a response to a recent Grand Jury Investigation Report; and WHEREAS, the 2007 California Building Code (CBC) does not provide requirements for separation distances between adjacent buildings to allow for independent building displacement due to earthquake ground motions and amendments are necessary due to the frequency and potential magnitude of earthquake activity in Orange; and WHEREAS, the minimum base shear required by the 2007 CBC is specified in ASCE 7- OS as referenced in the 2006 International Building Code and is significantly less than that required by previous editions of the CBC and ASCE 7 and due to the frequency and potential magnitude of earthquake activity in Orange, provides insufficient levels of protection in structural design and the amendment will provide the same level of protection in structural design for new high-rise buildings as State buildings; and WHEREAS, the CBC has insufficient information in the American Society of testing Materials (ASTM) standards referenced in ASCE 7 regarding prescriptive design requirements for ceiling suspension systems for seismic loads and thus, needs amending; and WHEREAS, the 2007 CBC provisions for concrete design are specified in American Concrete Institute (ACI) 318-OS as referenced by the 2006 IBC. The ACI 318-OS provisions for alternate slender wall design commonly used for tilt-up concrete walls significantly under- estimates service load deflection for some cases. The proposed code amendment is included in ACI 318-08 and is consistent with current practice in California based on previous Uniform Building Code provisions that better estimate service load deflections; and WHEREAS, because of the risk of delays in fire rescue response time due to traffic congestion and due to the high number of swimming pools within close proximity to small children because of local climate which makes pool ownership desirable, pool barriers are necessary and the proposed amendments are necessary to correct an administrative error in the State's adoption to be consistent with barrier requirements currently enforced in the City; and WAEREAS, an amendment is necessary to Electrical Code Article (310.2(B) & 310.16) due to the fact that improper installation creates a potential fire hazard and aluminum wire size No. 6 and smaller requires greater precision and care for proper installation. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS: SF,CTinN T—Rnilding('.de Sections 15.04.010, 15.04.020, 15.040.030, 15.040.060 and 15.04.070 of the Orange Municipal Code shall be deleted in their entirety and replaced with the following: 15.04.010 Adopted by Reference. Except as provided in this Chapter, those certain building codes known and designated as California Building Code 2007 Edition, including Appendix Chapter 1 based on the 2006 International Building Code as published by the International Code Council, shall become the building codes of the City for regulating the erection, construction, enlargement, alteration, repair, moving, removal, demolition, conversion, occupancy, equipment, use, height, area and maintenance of all buildings and/or structures in the City. The California Building Code and its appendix shall be on file far public examination in the office of the Chief Building Official. The 2007 California Building Code is hereby amended as follows: Section 202 is amended by revising the definition of High-Rise Building item #2 from 75 feet to 55 feet to read as follows: High-rise structure" means every building of any type of construction or occupancy having floors used for human occupancy located more than 55 feet(16764 mm)above the lowest floor level having building access. (See Section 403.1.2), except buildings used as hospitals as defined in Health& Safety Code Section 1250. Section 403.10.2 and 403.11.1 are modified by moving #3 Ventilation and automatic fire detection equipment for smoke proof enclosures from 403.10.2 Standby Power Loads and placing it in 403.11.1 Emergency Power Loads. The revised Sections are to read as follows: 2 403.10.2 Standby power loads. The following are classified as standby power loads: 1.Power and lighting for the fire command center required by Section 403.8; 2.Electrically powered fire pumps Standby power shall be provided for elevators in accordance with Sections 1007.4 and 3003. 403.11.1 Emergency power loads. The following are classified as emergency power loads: 1.Exit signs and means of egress illumination required by Chapter 10; 2.Elevator car lighting; 3.Emergency voice/alarm communications systems; 4.Automatic fire detection systems; 5.Fire alarm systems; and 6.Ventilation and automatic fire detection equipment for smoke proof enclosures. Section 412.51 is amended to add a definition for emergency helicopter landing facilities on high-rises to read as follows: Emergency Helicopter Landing Facility" (EHLF) shall mean a landing area on the roof of a high-rise building that is not intended to function as a helicopter or helistop but is capable of accommodating fire or medical helicopters engaged in emergency operations, in accordance with California Fire Code Section 1108. Federal Aviation Administration(FAA) approval is not required for an EHLF. Section 903.2 is amended to provide as follows: Fire sprinklers shall be required in accordance with Chapter 15.32 of the Orange Municipal Code. Table 1505.1 is deleted in its entirety and replaced with the following: TABLE 1505.1 MINIMUM ROOF COVERING CLASSIFICATIONS TYPES OF CONSTRUCTION IA IB IIA IIB IIIA IIIB IV VA VB A A A A A A A A A Section 1505.1.3 is deleted in its entirety and replaced with the following: 3 1505.13 Roof coverings within all other areas. The entire roof covering of every existing structure where more than 50 percent of the total roof area is replaced within any one-year period, the entire roof covering of every new structure, and any roof covering applied in the alteration,repair or replacement of the roof of every existing structure, shall be a fire-retardant roof covering that is at least Class A. Section 1613.7 is added to Chapter 16 of the 2007 California Building Code to read as follows: 1613.7 Minimum Distance for Building Separation. All structures shall be separated from adjoining structures. Separations shall allow for the maximum inelastic response displacement M). M shall be determined at critical locations with consideration for both translational and torsional displacements of the structure as follows: C d Smax M —I Equation 16-45) where ,,,aX is the calculated maximum displacement at Level x, and may be taken as 1.2 times the average of the displacement at the extreme points ofthe structure at level x. Where a structure adjoins a property line not common to a public way, the structure shall also be set back from the property line by at least the displacement, M, of that structure. Exception: Smaller separations or property line setbacks shall be permitted when justified by rational analyses. References: 1. CBC 2002 (UBC 1997) Section 1630.9.2, Determination of M; Section 1630.10.1, General; and Section 1633.2.11, Building Separations. 4 4. Los Angeles Regional Uniform Code Program item 16-01. The minimum seismic base shear provisions of ASCE 7-02 are adopted in place of the ASCE 7-OS provisions by adding Section 1614, 1614.1 and 1614.l.l to Chapter 16 of the 2007 CBC to read as follows: Ser.ti n 1 fil4 M dificati ns t ASCF, 7 1614.1 General. The text of ASCE 7 shall be modified as indicated in this Section. 1614.1.1 ASCE 7, Section 12.8.1.1. Modify ASCE 7 Section 12.8.1.1 by amending Equation 12.8-5 as follows: CS= 0.044 S I Eq. 12.8-5) Section 1614A.1.8 is hereby added by adopting Section 1614A.1.8 modifying ASCE 7 Equation 12.8-16 as adopted by OSHPD and DSA and as already provided in Chapter 16-A of the CBC. Section 1614A.1.12 is hereby added by adopting Section 1614A.1.12 modifying ASCE 7 Section 13.5.6.2 to add seismic design requirements for suspended ceilings as adopted by DSA and as provided in Chapter 16-A of the CBC." Section 3109.4.4.2 is modified by deleting the first paragraph in its entirety and replacing it with a new first paragraph to read as follows: 3109.4.4.2 Construction permit; safety features required. Commencing, January 1, 1998, except as provided in Section 3109.4.4.5, whenever a construction permit is issued for construction of a new private pool at a residence, it shall have an enclosure complying with 3109.4.4.3 and, it shall be equipped with at least one of the following safety features. 15.04.020 Fee Schedule. The fees shall be as established by resolution of the City Council. 15.04.030 Work Exempt from Permit. Section 105.2 of the California Building Code Appendix Chapter 1 is amended by adding OOOthe following: 14. Free standing concrete or masonry walls not exceeding 42 inches in height above finish grade. 15. TV dishes and flagpoles in connection with a group R, Division 3 occupancy and not exceeding 15 feet in height. 6 15.04.060 California Building Code (CBC) Appendix. The City Council adopts by reference the following Appendices of the CBC Appendix, 2007 Edition and said Appendices are adopted in total as the law of the City except as provided for this Chapter. Appendix C (Group U- Agricultural Buildings), Appendix F (Rodent proofing), Appendix G (Flood-Resistant Construction), Appendix H (Signs), Appendix I (Patio Covers), Appendix J (Grading) 15.04.070 Violation and Penalties. a. It shall be unlawful for any person, firm, or corporation to erect, construct, enlarge, alter, repair, move, improve, convert or demolish, equip, use, occupy or maintain any building or structure in the City, or cause the same to be done or to perform or maintain any grading work or cause the same to be done contrary to, or in violation of, any of the provisions of this Chapter. b. Any person, firm, or corporation violating any of the provisions of this Chapter, shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this Chapter is committed, or permitted, and each such offense shall be punishable by a fine of not more than One Thousand Dollars ($1,000.00), or by imprisonment for not more than six months, or both such fine and imprisonment. c. In addition to criminal penalties, this Code may be enforced by injunction or other appropriate civil remedy. SF.('.TiON ii—Mechanical ('.nde Sections 15.12.010, 15.12.020 and 15.12.025 of the Orange Municipal Code shall be deleted in their entirety and replaced with the following: 15.12.010 Adopted by Reference. Except as provided in this chapter, the California Mechanical Code, 2007 Edition based on the 2006 Uniform Mechanical Code as published by the IAMPO, shall be and become the Mechanical Code of the City, regulating and controlling the design, construction, installation, quality of materials, location, operation and maintenance of heating, ventilating, cooling, refrigeration systems, incinerators and other miscellaneous heat producing appliances within the City. The California Mechanical Code is on file for public examination in the office of the Chief Building Official. 15.12.020 Fee Schedule. The California Mechanical Code 2007 Edition is amended by deleting Appendix Chapter 1 Section 115 .2 and 115.3 and by providing that fees for the issuance of inechanical permits, for checking of inechanical plans and fees for the investigation of work done without permits shall be as established by resolution of the City Council. 15.12.025 Work Exempt from Permit. Section 112.2 of Appendix Chapter 1 of the California Mechanical Code, 2001 Edition is amended by adding the following: ll2.2.6 Repair or replacement of any appliance of the same type and size and in the same location and in connection with a group R, Division 3 occupancy. Section iii—Plumhing ('de. Sections 15.16.010, 15.16.020 and 16.15.025 shall be deleted in their entirety and replaced with the following: 15.16.010 Adopted by Reference. Except as provided in this Chapter, the California Plumbing Code, 2007 Edition, based on the 2006 Uniform Plumbing Code as published by the International Association of Plumbing and Mechanical Officials, shall be and become the Plumbing Code of the City, regulating erection, installation, alteration, repair, relocation, replacement, maintenance or use of plumbing systems within the City. The California Plumbing Code will be on file for public examination in the office of the Chief Building Official. 15.16.020 Fee Schedule. The California Plumbing Code 2007 Edition is amended by deleting Appendix Chapter 1, Section 103.4.1 and 103.4.2 and by providing that fees for the issuance of plumbing permits, for checking of plumbing plans and fees for the investigation of work done without permits shall be as established by resolution of the City Council. 15.16.025 Work Exempt from Permit. Section 103.1.2 of Appendix Chapter 1 of the California Plumbing Code, 2001 Edition is amended by adding the following: 103.1.2.3 Repair or replacement of any plumbing fixture or appliance of the same type and size and in the same location and in connection with a group R, Division 3 occupancy. SF.('TTnN iV—F.lectrical C de Sections 15.24.010 and 15.24.020 of the Orange Municipal Code shall be deleted in their entirety and replaced with the following: 8 15.24.010 Adopted by Reference. Except as provided in this Chapter, the California Electrical Code, 2007 Edition, based on the 2005 National Electrical Code as published by the National Fire Protection Association, shall be and become the Electrical Code of the City, regulating all installation, arrangement, alteration, repair, use and other operation of electrical wiring, connections, fixtures and other electrical appliances on premises within the City. The California Electrical Code is on file for public examination in the office of the Chief Building Official. The 2007 Edition of the California Electrical Code is hereby amended as follows: Article 310.2(B) is hereby amended, by the addition of a second paragraph, to read as follows: Copper wire shall be used for wiring No. 6 and smaller in all installation. Consideration for use of aluminum wiring can be made by the Building Official for feeder lines only on an individual basis where adequate safety measures can be ensured. Article 310 is amended,by addition ofa new Article 310.16,to read as follows: 310-16 Continuous inspection of aluminum wiring. Aluminum conductors of No. six (6) or smaller used for branch circuits shall require continuous inspection by an independent testing agency approved by the Building Official for proper torquing of connections at their termination point. 15.24.020 Fee Schedule. Fees shall be as established by resolution of the City Council. SFC'TinN V—Swimming Pn l Cnde Chapter 15.48 of Title 15 of the City of Orange Municipal Code is hereby repealed in its entirety. The Building Code provisions in Chapter 15.04 of this Code shall cover the requirements for the private and public pools, spas &hot tubs. F('TTnN Vi—Seicmic Strength^ ening of TJn-reinfnrced masnnry Rearing Wall RLildings: Chapter 15.55 of the City of Orange Municipal Code shall be deleted in its entirety and replaced with the following: The California Existing Building Code (Title 24, Part 10) based on the 2006 International Existing Building Code as published by the International Code Council, shall become the Existing Building Code of the City for regulating seismic strengthening of un-reinforced masonry bearing wall buildings in the City. The California Existing Building Code shall be on file for public examination in the office of the Chief Building Official. 9 SF.CTTnN Vii; Should any section, subsection, subparagraph, clause, or provision of this Ordinance for any reason be held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this Ordinance; it being hereby expressly declared that this Ordinance, and each section, subsection, subparagraph, sentence, clause and phrase hereof would have been prepared, proposed, approved and ratified irrespective of the fact that any one or more sections, subsections, subparagraphs, sentences, clauses or phrases be declared invalid or unconstitutional. SF.('TTnN Viii: A summary of this Ordinance shall be published and a certified copy of the full text of this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the City Council meeting at which this Ordinance is to be adopted. A summary of this Ordinance shall also be published once within fifteen (15) days after this Ordinance's passage in a newspaper of general circulation, published, and circulated in the City of Orange. The City Clerk shall post in the Office of the City Clerk a certified copy of the full text of such adopted Ordinance along with the names of those City Council members voting for and against the Ordinance in accordance with Government Code Section 36933. This Ordinance shall take effect thirty (30) days from and after the date of its final passage.
