07 AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ORANGE ADDING SECTION10.42.065
TO CHAPTER10.42 OF THE ORANGE
MUNICIPAL CODE PERTAINING TO NO
OVERNIGHT PARKING IN DESIGNATED OFF-
STREET CITY
PARKING LOTS.WHEREAS, the City owns and controls a number of parking lots that are open
to the
public; and WHEREAS, Orange Muncipal CodeChapter 10.42 provides rules and
regulations for the use of these parking
lots; and WHEREAS, some of the City controlled parking lots are adjacent to City
facilities that are not used overnight and overnight parking in such lots is not necessary to carry
on City
business; and WHEREAS, the prohibition of overnight parking in certain lots would assist
the Police Deaprtment in securing City property
and buildings.NOW THEREFORE, the City Council of the City of Orange does ordain
as follows:
SECTION I:Chapter 10.42 is amended to add a newSection 10.42.065 to the
Orange Municipal Code to read
as follows:A No person shall between the hours of II :00 P.M. and 5:00 AM., stop, park,
or leave standing any vehicle whatsoever within any public parking lot designated as
No Parking Between II :00 P.M. and 5:
00 AM.B. Any vehicles stopped, parked, or left standing in violation of this section
shall be subject to being towed away at the owner'
s expense.C. Appropriate signs shall be posted in and about the parking lots
specifying the aforementioned times when stopping, parking and standing of vehicles
shall be prohibited and that vehicles in violation thereof shall be subject to being
towed away.The City Manager, or his designee, shall determine which parking lots shall
be
so designated.
SECTION II:Should any section, subsection, clause, or provision of this Ordinance for any
reason be held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not
affect the validity or constitutionality of the remaining portions of this Ordinance; it
expressly declared that this Ordinance, and each section, subsection, sentence, clause and
phrase hereof would have been prepared, proposed, approved and ratified irrespective of the
fact that anyone or more sections, subsections, sentences, clauses or phrases be declared
invalid or unconstitutional.
SECTION III:
A summary of this Ordinance shall be published and a certified copy of the full text of
this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the
City Council meeting at which this Ordinance is to be adopted. A summary of this Ordinance
shall also be published once within fifteen (15) days after this Ordinance's passage in a
newspaper of general circulation, published, and circulated in the City of Orange. The City
Clerk shall post in the Office of the City Clerk a certified copy of the full text of such adopted
Ordinance along with the names of those City Council members voting for and against the
Ordinance in accordance with Government Code Section 36933. This Ordinance shall take
effect thirty (30) days from and after the date of its final passage.
