HomeMy WebLinkAboutORD-09-07 Amending Ch 5.63.02- Display of Plaza BannersORDINANCE NO. 9- 07 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING CHAPTERS 5.63.020 AND 5.63.060 OF THE ORANGE MUNICIPAL CODE RELATING TO CHANGES IN PROCEDURES FOR THE DISPLAY OF PLAZA BANNERS.WHEREAS, the Orange Municipal Code allows from time to time the display of banners over the street right-of-way and portions of Chapman Avenue and Glassell Street in the Plaza; and WHEREAS, the purpose of this Ordinance is to set forth permit requirements and the rules and regulations governing the use and display of said banners.NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES HEREBY ORDAIN AS FOLLOWS:SECTION I:Section 5.63.020 of the Orange Municipal Code regulating permitted locations for Plaza banners, is hereby deleted in its entirety and replaced with the following:5.63. 020 Permitted Locations.Plaza Banners shall only be hung on Glassell Street, one block in each direction from the Plaza, and on Chapman Avenue, two blocks in each direction from the Plaza, at locations deemed appropriate by the Director of Public Works or his designee. The number of banners shall limited to eight (8) on Glassell Street and six (6) on Chapman Avenue.SECTION II:Section 5.63.060 of the Orange Municipal Code regulating the installation and removal of Plaza banners by the City is hereby deleted in its entirety and replaced with the following:5.63.060 Installation and Removal by City.The Public Works Department shall be responsible for the installation and removal of all banners, with priority given to Orange based organizations. The City is not responsible for the physical condition of the banners prior to installation or subsequent to removal. All banners to be installed must be delivered to the Public Works Department at the City Corporation Yard, located at 637 West Struck Avenue, at least 2 weeks prior to the installation, for inspection and compliance City standards and those standards as they may be amended from time to time. The Public Works Department shall not issue a permit for the installation of any banner(s) prior to inspection. Upon removal of the banner(s) by City personnel, the permittee shall be notified and shall have five (5) working days to remove the banner(s) from the Public Works Department. Banners left beyond five (5) days from notification of permittee shall be considered abandoned and may be disposed of by the Public Works Department. SECTION III: Should any section, subsection, clause, or provision of this Ordinance for any reason be held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this Ordinance; it being hereby expressly declared that this Ordinance, and each section, subsection, sentence, clause and phrase hereof would have been prepared, proposed, approved and ratified irrespective of the fact that anyone or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. This Ordinance shall be prospective in application from its effective date. SECTION IV: A summary of this Ordinance shall be published and a certified copy of the full text of this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the City Council meeting at which this Ordinance is to be adopted. A summary of this Ordinance shall also be published once within fifteen (15) days after this Ordinance's passage in a newspaper of general circulation, published, and circulated in the City of Orange. The City Clerk shall post in the Office of the City Clerk a certified copy of the full text of such adopted Ordinance along with the names of those City Council members voting for and against the Ordinance in accordance with Government Code Section 36933. This Ordinance shall take effect thirty (30) days from and after the date of its final passage.
