AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF ORANGE AMENDING SECTION 6.04.010
OF CHAPTER 6.04 OF THE ORANGE MUNICIPAL
CODE AND ADOPTING TITLE 4, DIVISION 1 AND
TITLE 5, DIVISIONS 1, 2 AND 3 OF THE CODIFIED
ORDINANCES OF THE COUNTY OF ORANGE
PERTAINING TO REGULATION OF THE
CONTROL OF ANIMALS.
WHEREAS, Section 50022.9 of the Government Code of the State of California
permits a city to adopt ordinances and any amendments thereto of the county by reference
provided the procedures of Sections 50022.1 through 50022.10 are observed; and
WHEREAS, the aforementioned provisions of the California Government Code require
that such county ordinances be adopted by reference only after a public hearing held in
accordance with procedures specified in the aforementioned provisions; and
WHEREAS, the City Council has previously, in Ordinance 37-76, adopted
those certain ordinances of the County of Orange known as Title 4, Division I, and Title 5,
Divisions I, 2 and 3 of the County of Orange Codified Ordinance regulating animals and
establishing welfare and licensing requirements therefore;
and WHEREAS, the City Council now desires to additionally adopt by reference
recent amendments to the County of Orange ordinance known as County Ordinance No.
06-011 adding section 59 to Title 4 of the County's
Codified Ordinance.NOW THEREFORE, the City Council of the City of Orange does ordain
as follows:
SECTION I:Section 6.04.010 of Chapter 6.04 of Title 6 of the Orange Municipal Code
is hereby amended
to read:Title 4, Division I, Title 5, Divisions 1,2 and 3, of the Codified
Ordinances of the County governing the control, licensing, and regulation of
animals are adopted by reference with the enumerated exceptions designated
in Section 6.04.020. Copies of the aforementioned ordinance of the County
of Orange proposed to be adopted by reference, together with the exceptions
as hereinafter specifically enumerated, are on file in the office of the City Clerk for
use and examination by
SECTION II:
Should any section, subsection, clause, or provision of this Ordinance for any reason be
held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the
validity or constitutionality of the remaining portions of this Ordinance; it being hereby
expressly declared that this Ordinance, and each section, subsection, sentence, clause and
phrase hereof would have been prepared, proposed, approved and ratified irrespective of the
fact that anyone or more sections, subsections, sentences, clauses or phrases be declared
invalid or unconstitutional.
SECTION III:
A summary of this Ordinance shall be published and a certified copy of the full text of
this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the
City Council meeting at which this Ordinance is to be adopted. A summary of this Ordinance
shall also be published once within fifteen (15) days after this Ordinance's passage in a
newspaper of general circulation, published, and circulated in the City of Orange. The City
Clerk shall post in the Office of the City Clerk a certified copy of the full text of such adopted
Ordinance along with the names of those City Council members voting for and against the
Ordinance in accordance with Government Code Section 36933. This Ordinance shall take
effect thirty (30) days from and after the date of its final passage.
