1. CONDITIONAL USE PERMIT 1733-88, PRE-ZONE CHANGE
1103-88, TENTATIVE TRACT MAP 13819 - B.E. DEVELOPMENT
Final disposition of the map is not ready for the
Commission's review and it is requested to continue
this item to February 22, 1989.
Thomas R. Flynn, 2811 East Villa Real Drive, Director
of_ the Catholic Cemeteries, was not in opposition to
the project, but wanted to go on record so that the
developer will. know what is being planned for the
property immediately adjacent to the property he is
seeking to subdivide. It is his intention to build a
mausoleum within 200 yards of that development. i-Ie
wants to be cooperative with the neighbors.
Commissioner Greek took issue with the water tank and
lack of landscaping at the cemetery.
Don Cray, 8001 Santiago Canyon Road, is a neighbor of
the cemetery. He has concerns with the proposed
mausoleum.
Commissioner ,Scott would like the concerns of. P1r. Flynn
to be brought to the attention of staff and the
developer of the adjoining property.

Commissioner Greek was going to be out of town February
22, 1989 and requested another date. Commissioner Fiart
was also going to be out of tocan.

Bart, that the Planning Commission continue Conditional
Use Permit 1733-88, Pre-Zone Change 1103-88 and
Tentative Tract P3ap 13819 to March 6, 1.989; also,
request staff to bring the proposals of the cemetery to
the attention of the developer.

2. CONDITIONAL USE PERMIT 1730-88 - EL POLLO LOCO, INC.
There was some confusion as to the final submittal. from
the applicant and staff suggests a continuance to the
February 6, 1.989 meeting.
Moved by Commissioner Master, seconded by Commissioner
Hart, that the Planning Commission continue Conditional
Use Permit .1730-38 to February 6, 1989.

CONDITIONAL USE PERMIT 1724-88 - STEVEN GLASSEY:
Request for a Conditional Use Permit to all..ow the
development of a two story second unit in the R-2-6
(Residential Duplex) zone, pursuant to Section 17.26.110 of
the Orange Municipal Code, located at 226 East LaVeta
Avenue.
NOTE: This project i.s exempt from environmental review.
(Conditional Use Permit 1724-88 was continued from the
December 19, 1988 Planning Commission Meeting.)
The Commission recommended this item be continued in order
for staff to determine whether or not the Old Towne
Demolition Guidelines and Design Guidelines app]i.ed to this
project. And, if so, what the process would be i.n order to
review them through that process. It was staff's
determination that the Ordinances do apply to the project.
As written in the memo of December 27, 1988 to the Planning
Commission, it is suggested that although the Ordinance does
not specify the actual procedure as to whether or not the
Planning Commission action needs to take place prior to

D.R.B. action, staff is recommending that the Planning
Commission take it's action on not only the use, but also to
consider the proposal's relationship and effect on the
neighborhood plan as required by Code, which would be the
Design Guidelines.
Chairman Bosch stated the public hearing was closed at the
previous hearing.
Commissioner Hart wanted it to be clear they were not
approving the building elevation plans. The main issue was
the mass of the structure as it appeared in relation to the
existing structure. He wanted their concerns entered in a
motion form regarding the mass of the building.
Commissioner Greek feels it is too much mass for the lot in
that particular neighborhood. A condition is needed stating
the coverage, the square footage, or some kind of number
that gives an indication of how much the mass should be
reduced. The use is ok, but the particular p1.an is not
acceptable.
Commissioners discussed this project as it related to
existing codes.
Commissioner Scott wanted to know how previous approvals of
similar projects in the area differed from this project?
Chairman Bosch explained that staff determined this meets
the development standards of the zone subject to the C.U.P.
approval, but Commission needs to determine whether the
specific relationship of this proposed structure to it's
neighbors. His key concern is the massing of the project,
causing a more significant impact on the neighborhood.
Moved by Commissioner Greek, seconded by Commissioner
Master, that the Pl.anni.ng Commission deny Conditional Use
Permit 1?24-88 without prejudice.

Commissioner Greek stated there was greater than a 1.1 ratio
for the lot.
Applicant, Steven Glassey, 226 East LaVeta, wanted to know
what too massive is? His front unit is 1160 square feet.
The Deck unit is 1180 square feet. Next door to him they
are building a larger unit than his.
trtr. Godlewski explained the 15 day appeal pQriod to the
apolicant.

CONDITIONAL USE PERMIT 1734-$$ - SOUT9WESTERN AMMUNITION
SERVICES, INC.
A proposed Conditional Use Permit to allow manufacturing,
storage and retail sales of small arms ammunition in the ^7-?_
zone on property located on the north side of Blueridge,
west of Glassell Street, between Taft Avenue and Grove
Street, addressed 223 West Blueridge.
NOTE: Negative Declaration 1272 has been prepared for this
project.
Staff has received one letter objecting to the proposed use.
Their primary objection is based on the potential. insurance
cost increases to the properties nearby and the possible
dangers to the employees at the referenced location.
A staff report was not presented and the public hearing was
opened.
Applicant:
Les Tingly, 231 Blueridge, stated they are working out of a
location on Katella. That location does not afford them the
ability to produce and manufacture the materials in an
economic manner. They are looking to move to the new
location so they can do a better job of manufacturing.
The public hearing was closed.
Commissioner Greek said the only problem he had with the
project was the use of the parking by Mr. Tingly's business
for open storage. He requested that Planning (Code
Enforcement,) investigate and require all the fences being
used for open storage in lieu of parking in the adjacent
building be removed. If this project is approved, a
condition needs to be made that prior to any occupancy that
the storage fences be removed and the 22 parking stalls be
provided.
Chairman Bosch summarized Commissioner Greek's concerns: (1)
P.equest Code Enforcement action to assure that all required
parking is available for all. of the tenants of the
buildings; and (2) To assure, before occupancy, that all 22
spaces required of this particular tenant be available for
parking.
Commissioner Hart noted that Santiago Air Conditioning owns
the property. They are in violation of the parking code.

that the Planning Commission accept the findings of the
Environmental Review Board to file Negative Declaration
1272.

Moved by Commissioner Greek, seconded by Commissioner Hart,
that the Planning Commission approve Conditional Use Permit
1734-88 with the added condition to require that the 22
parking spaces be made avai].abl.e as required by Code prior
to occupancy, and the existing storage fences be removed.

IN RE: NE{^~ HEARINGS
CONDITIONAL USE PERMIT 1737-88 - R.J. CBRISTOFF &
ASSOCIATES, INC.:
A proposed Conditional Use Permit to allow a two story
second unit in the RCD zone on property located at the
southwest corner of Palmyra Avenue and Shaffer Street,
addressed 440 East Palmyra.
NOTE: This project is exempt from environmental review.
Mr. Godlewski presented the staff report. The proposed
project meets all the code requirements for setbacks and
areas. The project is in conformance cvith the goals of the
RCD zone. The applicant proposes to retain the existing
historically significant residence on the site, demolishing
the garage and adding a structure which is in scale and
compatible with the historical character of the existing
structure. This project is subject to the Design Guidelines
of Old Towne Standards, as well as the Demolition Ordinance.
The public hearing was opened.
Applicant:
Steve Smith, 239 South Glassell, is the property owner and
he purchased the property with the intention of conforming
with the typa of structure that can be added to the back of
the property. He hired an architect to carefully design a
structure that would fit in with the type of neighborhood
and historical significance and architecture of the existing
structure.

an apartment. It's a very massive unit with a 4-car garage.
The two buildings are very close together and does not fit
into the community.
Renee Miller, 430 East Palmyra, had a couple of questions
about the project: (1) How close would the proposed
structure be to her property line (on the west side)?
(Chairman Bosch responded it would be 5 feet according to
the plan that was submitted.) (2) How large is the window
that is facing west and is it off the bathroom or the
bedroom? She is concerned about her privacy. (Chairman
Bosch stated the plan shows the window to be in the
bathroom, a double hung window.) {3) Are there any plans
regarding a different fence or is it addressed at all?
(Cha.irman Bosch said the plans show an existing block wall
and no additional fence.) (4) She noted there are no
windows facing north. Can this change after it has been
approved? (Chairman Bosch explained the Commission's
approval is with regard to land use and the impact of the
building on the neighboring land uses. This would go to the
Design Review Board for their review of the actual window
placement, size, style, design, color, etc.)
The public hearing was closed.
Rebuttal-:
2~tr. Smith addressed the concerns of the neighbors as far as
placing the windows. There is no thought of changing the
design as shown on the plans. He wanted to assure the
neighbors their privacy would be protected. They want to
design the project with appropriate wood siding that is
consistent with the type of structure that exists there now.
They are asking to demolish the existing garage. It is an
old structure that is not appropriately being used for
parking automobiaes.
Chairman Bosch commented the lot and location on a corner
and adjacent to an alley helps mitigate the proposed
structure. It has less impact than it would the same type
of structure on a much smaller lot and in a mid-block
location. He is concerned about the particular bathroom
window, but needs to 1.Aave that for the Design Review Board.
He pointed out an excellent job in conforming to the ~Jld
Towne Design Guidelines and Standards.

Moved by Commissioner Scott, seconded by Commissioner Hart,
that the Planning Commission approve Conditional Use Permit
1737-88 subject to the conditions as listed.

Commissioner Hart concurred the size of the lot is a
pertinent issue. The other lot previously discussed was
6700 square feet and this lot is over 9000 square feet.
Commissioner Greek discussed the fact that they should not
require compliance with the Demolition Ordinance. A
non-habitable type building is being demolished and does not
have historical significance.
Chairman Bosch suggested they refer this question to the
attention of the City Council Committee with regard to
demolition policies.
IN RE: MISCELLANEOUS ITEMS
Commissioner Scott wanted to surface the guidelines for the
Demolition Ordinance, which so states that the amount (25~
floor area and 10~ building facade) is altered, that
Commission communicates with the Council that it would be
their recommendation that this pertains to the main
structure only and not patios, accessory buildings, garages,
etc.
Mr. Minshew said the Ordinance reads, more than 50~ of the
building to be demolished.
Mr. McGee suggested this be brought to the Committee's
attention. Many questions need to be resolved by the
Committee.
Commissioner Scott said an accessory building also needs to
be defined.
Chairman Bosch will forward these questions to the
Committee.
Commissioner Greek thought a preliminary review was needed.
Commissioner Hart thought some written rules were needed to
be applied to everyone.
P. memorandum was received from the irJater Superintendent.
Commissioner Greek asked staff to refer to the Minutes of
January 4, 19$9, Page 3, and ask to have the report
completed in accordance with those instructions.

IN RE: ADJOURNMENT
The Commission adjourned to January 30, 1989 at 5:00 p.m.
for a study session in the Weimer Room to discuss the I.D.M.
project. Then, adjourn to the next regular Planning
Commission Meeting February 6, 1989, for a study session at
6:30 p.m. and public hearing at 7:00 p.m.
The meeting adjourned at 8:15 p.m.
