order by Chairman Mason at 7:30 p.m.

CONDITIONAL USE PERMIT 1468 - TRU VALU INNS, INC,
Proposed three-story, 29-unit motel within 120 feet of residentially.
zoned property on a 15,464-square foot parcel in the C-3 zone on
the east side of Main Street, 156 feet north of Palmyra Avenue.
(Continued from the November 4, and December 2, 7985, Planning
Commission meetings.)
NOTE: Negative Declaration 1027 has been prepared for this project.
Mr, Soo-Hoo made the presentation in accordance with the Staff
Report and said Staff recommends acceptance of the Negative Declara-
tion and approval of the Conditional Use Permit ,per the conditions
in its. report. He said the variance which was originally part of
the application is no longer required and the Planning Commission
should acknowledge withdrawal of that variance.
Chairman Mason opened the public hearing. Ken Paddock, architect,
representing the applicant, said the building had been redesigned
in accordance with Staff recommendations and he felt that it now
met City requirements.
Chairman Mason declared the public hearing closed,
Commissioner Greek asked where the 30'- elevation started and Mr.
Paddock said i t woul d be from the finished grade level .
Moved by Commilssioner Master, seconded by Commissioner Hart, that
the Planning Commission accept the findings of the Environmental
Review Board to file Negative Declaration 1027.

Moved by Commissioner Master, seconded by Commissioner Scott,-that
the Planning Commission approve Conditional Use Permit 1468 for.
the reasons stated in the Staff Report,_subjeot to the conditions
in the Staff Report,-and accepting withdrawal of the variance,
Commissioner Greek said he would like-the height of the building
to be no more than 31 feet above the top of the curb. Commissioner
Master asked Mr. Johnson if this change would present a problem
and Mr, Johnson said it would not. Commissioner Greek asked that
Condition No. 1 be amended to read, "That structure height shall not
exceed thirty feet above the pad elevation as approved by the City
Engineer." This was acceptable,to both Commissioner Master and
Commissioner Scott as maker and seconder of the motion, and it
was voted upon as follows.

Proposed 45-foot-high freeway oriented pole sign on 3.7 acres
presently under construction fora mini-warehouse facility generally
south from Almond Avenue, west from Flower Street, and adjacent to
the east side of Orange (57) Freeway. (Continued from the October 21,
November 4, November 18 and December 16, 1985, Planning Commission
meetings.)
NOTE: This project is exempt from Environmental Review
Mr. Soo-Hoo repeated the applicant`s request fora continuance.

CONDITIONAL USE PERMIT 1467 - ANGELO`S
Proposed drive through restaurant within the C~1 Zone located on
a .44-acre parcel on the southeast corner of Tustin Street and
Wilson Avenue. (Continued from the January 6 1986, Planning
Commission meeting.)
NOTE: This project is exampt from Environmental Review.
Mr. Soo-Hoo made the presentation in accordance with the Staff Report,,
He said Staff .has a number of concerns regarding this proposal:.
1) use of the drive-through window will block and obstruct fourteen
parking spaces?-making. them unacceptable for vehicular access,
2) driveahrough customers will not be able to gain access to the
drive-through lane by entering from Tustin, those who might enter
from Tustin will need to make a very awkward maneuver within the
parking `lot or exit onto Wilson and make a U-turn,-coming back into
the lot from Wilson, 3) the drive through window wi_11 be locdted on
the passengar side of ,vehicles..,-which will s1 ow down the use of ..the
drive through and exacerbate the obstruction of parking spaces,-and
4) there will be carhops on roller skates delivering meals to cars
parked in the lot, He said that any one of these concerns would
cause a very significant concern for approval of this kind of a
layout and the projection of all four concerns would cause quite a

lot of confusion in the parking lot as well as hazards to both the
carhops and any pedestrians walking between their parked cars and
the restaurant itself. For these reasons, he said, Staff feels the
drive-through proposal is not adequate. and recommends that the condi-
tional use permit request be denied; however, the applicant could
still use the restaurant without the drive-through or carhop service.
Commissioner Greek asked Mr. Johnson if the alley is dedicated or
not; Mr. Johnson said he believes it is not.. Commissioner Master
asked if there is in the review by the traffic department a prohi-
bition on entering from Tustin Street to use the drive-through
window. Mr. Soo-Hoo said he is sure the intent is that the drive-
through service will not be encouraged from Tustin, but Staff`s
concern is that some customers might inadvertently enter from Tustin
and then need to make some .kind of adjustment either within the lot
itself or by driving out to Wilson and turning around to re-enter.
Commissioner Master asked what would happen if the applicant changed
the plan to allow entery from Tustin; Mr. Soo-Hoo said this would be
unacceptable because traffic would back up onto Tustin while waiting
to reach the drive-through window to place orders.
Chairman Mason opened the public hearing. The applicant was not
present nor was there .anyone else wishing to speak, either in favor
or against. Chairman Mason declared the public hearing closed.
Moved by Commissioner Greek, seconded by Commissioner Master, that
Conditional Use Permit 1467 be denied in accordance with Staff
recommendations.

CONDITIONAL USE PERMIT. 1487, TENTATIVE PARCEL MAP 85-449 - NU WEST, INC.
Proposed reparcelization of two existing parcels into three parcels
and development of off ice uses within the M-2 ~Industria7) Zone,
located on 8.1 acres on the .southeast corner of Kate7la Avenue and
Main Street. (Continued from the January 6, 1986, Planning Commission
meeting.)
NOTE: Negative Declaration 1041 has been prepared for this project
and was accepted for filing by the Planning Commission on
January 6, 1986.
Mr, McGee made a brief p~resEntation in accordance with the Staff Memo-
randum, pointing out that a full presentation had been made at the
meeting of January 6, 1986. He said Staff recommends approval subject
to the conditions in its report.

Commissioner Master repeated his comment from the previous hearing
that it is fortunate. that the Planning Commission is not in a position
to lead a development on this particular property or ones like it
that would have a positive impact on the City and he still feels
there would be a better use for this property.
Chairman Mason opened the public hearing. Steve Prothero, archi-
tect, 741 East Briardale, Orange, representing the applicant,
said he agrees with all conditions in the Staff Report. Chairman
Mason declared the public hearing closed.
Moved by Commissioner Hart, seconded by Commissioner Greek, that
the Planning Commission approve Conditional Use Permit 1487 subject
to S~taff~~recommendations and the conditions in the Staff Report,
and Tentative Parcel Map 85-449 subject to the Engineer`s Plan
Check. Sheet.

IN RE: NEW HEARINGS
GENERAL PLAN LAND USE AMENDMENT 1-86, ZONE CHANGE 1040, CONDITIONAL
USE PERMIT 1470 - KOLL COMPANY '
Proposed development of a high-rise off ice and commercial complex
consisting of two office .buildings,-two multi-level parking
structures and two restaurants, The proposed development is on
a 12,5-acre site at the southwest corner of Orangewood Avenue and
State College Boulevard,
NOTE: Environmental Impact Report 1018 has been prepared for this
project.
Commissioner Greek asked to be excused from the hearing due to a
conflict ~f irnterest.
Bert K. Yamasaki, Director of Planning and Development Services,
-made the presentation in accordance with the Staff Report. He
said that as part of the applicant's request for the general plan
land use. amendment, the zone change and the conditional use permit,
he is also requesting approval ofrthe site plan by the~Planning
Commission and at a later date, probably somewhat later this year.,
in order to activate the plan the applicant must request abandonment
of the existing streets and the consolidation of the parcels for a
tentative parcel map, at which time he will be required to submit
a more precise site plan. Mr. Yamasaki said Staff is proposing
that the City develop its own standards to be set at the time the
precise site plan is submitted as part of the application later
this year.

Mr. Yamasaki said Staff recommends that the Planning Commission
recommend to the City Council that it certify the Environmental
Impact Report and approve the General Rlan Land Use Amendment, the
Zone Change and the Conditional Use Permit.
Commissioner Master asked if when the applicant comes back with a
more precise plan and abandonment will it come before the Planning
Commission. Mr. Yamasaki said normally that would not occur
because the abandonment area would be before the City Council only;
however, if the Planning Commission wants to see the plans, that
request can be made part of the instructions to Staff and could
even be added to conditional approval. Commissioner Master asked
Mr. Yamasaki to put into perspective the action of the Planning
Commission at this hearing and how it would affect the phasing in
regard to the developer being able to complete the development.
Mr. Yamasaki said what the Planning Commission is reviewing this
evening is a plan for that portion of the entire quadrant that
comprises the real lot lines of those lots on the south side of
Walnut so that the approval that results will cover that portion..
He said the applicant is currently trying to acquire other portions.
He said the EIR accepted the entire phase-out but what is occuring
tonight is not the approval of the remaining portions yet to be
acquired. He said when the developer has control of the remaining
portions then they would be submitted for approval; in fact a
portion of the entire quadrant is still unincorporated and must
still undergo annexation to the City of Orange.
Commissioner Master said his concern was with improvements that
would be necessary with the development of .ingress and egress of
potential developments years from now and he feels that total
build-out would be conditioned upon that, yet that is not happening
at this current time. He said he is concerned with improvements
regarding future traffic conditions. Mr. Yamasaki said he thinks
this concern is quite appropriate in terms of the longer term and
he believes Staff will begin to look at steps that will need to'be
taken to-provide for a higher intensity and there may be some
other major improvements necessary that will become part of a need
fora project that goes above and beyond what is being approved
this evening. He said the financing .mechanism, the people who
will be participating, the organizational structure which will
make those improvements are all part of what Staff hopes will be
eventual strategy plan.
Commissioner Hart asked if it would be possible to condition ~n
approval with a provision that the applicant have acquired and
completed the purchase of the property in question. He pointed
out that if .the property is rezoned. the bargaining power of the
individual owners of the homes in the area has been taken away
from them if it turns out that the Ko17 Company fails to perform.
Therefore. he would like to see this done with an intent to rezone
in order to protect the property owners.

Chairman Mason opened the public hearing.. Mike Lewis, Ko11 Company
Vice President for Development, 4343 Von Karman, Newport Beach,
said he concurs with the Staff Report and agrees with the conditions
of approval for the project.. He said the Koll Company agrees to
participate on a fair-share basis in future transportation improve-
ment programs that might be enacted by the City. He said Kbll has
purchase agreements covering the 51 lots and has the authority of
the landowners to pursue a zone change, that the closing of the
transactions is subject to eventually obtaining a zone change. Com-
missioner Hart explained the concept of "intent to rezone" and Mr.
Lewis said using that process is acceptable to the Koll Company.
Several residents of the area--Bonnie Robinson, 114 North Walnut;
James Ledbetter, 11572 Hollister; and Mary Lancaster, 471 Northeast
Country Lane--spoke in favor of the project but apparently their
homes are not now included in the particular portion of the project
for which approval is now sought, and these homeowners were concerned
about how the current project will affect their properties. Mr. Edgar
Weichel, a7 so resliding on Hollister, spoke against the project. All
four, whether for or against, were concerned with how the current
project would affect their .properties and what could by done by the
city of Orange, It was pointed out to a17 of them that there was
nothing that could be done by the City concerning their situations.
~ Philip Quarre, Hartmann Corporation, 536 West'Lincoln, Anaheim, owners
of five commercial/industrial buildings on Anaheim Boulevard, on
approximately 4~ acres, said Hartmann is in favor of and welcomes the
project and the Ko11 Company as its neighbor,-but is concerned with
the abandonment and vacation of Country Lane and Walnut because they
are the two main entry streets into the Hartmann property and the
closure of those streets .would cause considerable hardship to Hartmann.
He asked that the ingress and egress of the Kol1 Project on Walnut
Street be redesigned to include a street that will go southwest and
then northwest to what is now Country Lane and then southwest again
into the Hartmann. property, or a similar configuration, so that
there will be access to Hartmann. Mr. Lewis Mr, Lewis said the Koll
Company is prepared to work with Mr. Quarre and the Hartmann Corpora-
tion and will come up with a plan that is acceptable to both companies.
Chairman Mason declared the public hearing closed.
Moved by Commissioner Master, seconded by Commissioner Scotty-that
the Planning Commission recommend to the City Council that it certify
Environmental Impact Report 1018 and all pertinent supplementary
information as Having been completed in compliance with the California
Environmental Quality Act and the State and local guidelines for the
implementation of CEQA, and that the City Council find that the miti-
gation measures outlined in the EIR willlreduce to acceptable levels
or eliminate any adverse environmental. impacts associated with this
project,

the Planning Commission recommend to the City Council that it
approve General Plan Amendment 186 deiignating the area from
industrial. to Major Commercial Land Use based upon the findings
that 1) the amendment would not be in conflict with surrounding
existing and proposed land uses in both Anaheim and Orange,-and
2) the amendment will assist in the transition of the area from
low density residential. and low intensity commercial and industrial
uses to high intensity office and commercial land uses,

Moved by Commissioner Scott, seconded by Commissioner Hart, that
the Planning Commission recommend to the City Council that it
approve Zone Change 1040 designating the subject property to be
zoned C-1 (Limited Business District) based on the following
findings: 1) That the proposed zoning is consistent with the City
of Orange General Plan as amended above,-and 2) that the proposed
zoning is compatible with surrounding zoning and land use,
Commissioner Master said he has no problem with this motion but he
feels that item 2) can be contested because the land in the area
is in transition, He requested the additions of ,the wording, "this
land is in transition from residential to higher use commercial."
The additional wording was accepted by both Commissioner Hart and
Commissioner Scott, the maker and seconder of the motion, thereby
changing Item 20 above to read "that the proposed zoning is
compatible with surrounding zoning and land use which is now in
transition from low density residential and low intensity commercial
and industrial uses to high intensity office and commercial land
uses,

1 the proposal is based on sound land use principles and in response
to services required by the surrounding communitiesy 2) the proposal
.will not cause deterioration of surrounding land uses or create
special problems for the area, and 3) the proposal is compatible
with surrounding land use and zoning which is now in transition

IN RE: NEW HEARINGS
CONDITIONAL USE PERMIT 1486 - CHAPMAN COLLEGE
Proposed college campus expansion through the construction of a
four-story, 92,000-square foot building addition in the Public
Institution (P-I) District,. within 120 feet of residentially zoned
(R-176) property.
NOTE: Negative Declaration 1040 has been prepared for this project.
Jim Reichert, Associate Planner, made the presentation in accordance
with the Staff Report, and said Staff recommends approval subject to
the 22 conditions in its report. Commissioner Master asked for
clarification of a letter from Bernie Dennis, City Traffic Engineer,
regarding his concerns on traffic safety and parking, and also
questioned the parking ratio of one parking stall for every six
students .as well as commenting upon the impact additional traffic
and need for parking would have upon the residents of the area
adjacent to the college. Mr. Reichert. commented that Staff did
receive a letter from some of the adjacent property owners requesting
that this matter be continued for two weeks,
Bernie Dennis,-City Traffic Engineer, said he shares Commissioner
Master`s concerns and said his office has received many letters
over a period of years regarding parking of students on residential
streets thereby not leaving enough room for the property owners
to park. He said he believes some remedial action has to be taken.
to maintain the integrity of the adjacent residents and he feels
Chapman College should be a participant in this remedial action.
He discussed the possibility of a permit parking program on resi-
dential streets, but admitted it would be difficult to administer
and enforce. Commissioner Hart asked if permit parking by ;residents
has been attempted in other areas and, if so, how successful it has
been.. Mr. Dennis said it has never been uti}:i.~zed in the City of
Orange but has been used quite extensively around campuses in the
Los Angeles area,~around the convention center in Anaheim and in
some areas of Garden Grove,-and it does work, Commissioner Hart
said it could perhaps be tried in this area and if Chapman College
does indeed feel its parking spaces will be sufficient, it won`t
-have an objection to permit parking bn the sheets by residents.

Chairman Mason opened the public hearing. Mr. G. T. Smith,
president of Chapman College, said he concurs with-the Staff
Report and its recommendations. He said it is of great importance
to the college to get started on the new building as it is wanted
for usage when the academic year starts in September, 1987. He
said that regarding parking he concurs in Mr. Dennis` concern and
is aware of the parking problems which he believes is the respons-
ibility of the college, not the. residents or Citya to solve. He
said that at present students and staff must buy a ~l0 per semester
sticker to park in college facilities and he feels that many do not
buy this sticker, preferring to save money and park on the streets.
He says they are now coming up with an alternative procedure which
will require every employee and every student to register their-cars
at no fee, for which they will be gi~!en a stickbr granting them
acces's to co liege parking facilities. He pointed out that this
could also be used as a restriction against parking on the streets;
in other~nvords,-the sticker could be used against them if .they are
parked on the street. He said it has never been the intent of the
college to be non cooperative and obstructive.
Commissioner Hart pointed out that since there are more students than
parking spaces at the college., there will be parking on the street
at any rate and therefore. what's to force the students to put the
stickers on their cars so they are apprehended for parking on the
street; in other words, knowing they will be cited for parking on
the street, they will simply not affix the sticker to the car.
Commissioner Hart says he doesn't believe the ratio is correct; he
doesn`t visualize six students .using~:onei~parking space, even con-
sidering the fact that not all students are on the campus at the
same time, He said the residents in the area have been punished
over the years by having to put up with the lack of parking and he
feels it is now up to the City to correct the situation. Mr. Smith
agreed. it is possible that the college will need additional space.
Commissioner Master asked if there is any way the college has of
knowing the automobile population of its faculty and students and
if so, what is the best judgment as to what this amount might be.
Mr, Smith said he feels the college needs double what it has at the
moment and therefore they are increasing parking spaces by 50% in
the hope of solving the problem, He said if it is found that this
is not enough, they will find another way to solve the problem, such
as prohibiting freshmen from having cars, or finding additional space.
Commissioner Scott asked if there are any records of the days and
hours of student attendance and how this affects parking. Mr, Smith
said the hours of attendance have a great effect on parking and
the college has changed teaching hours to better disseminate the
parked cars.
Deborah McLaughlin, 406 North Shaffer, Orange, spoke against the
proposed project, stating that the increased traffic from the new
parking lot would be dangerous to children in the area. She
mentioned the residents' letter requesting continuance.

John O'Dell, 414 North Shaffer, pointed out that not everyone in
the area, primarily renters of the homes, are aware of this proposal
and the hearing and therefore he feels a continuance would be in
order. He asked what will happen during construction of the new
building and commented on the visual impact to the neighborhood
residents of another tall building so close to their homes. He
also said he feels it is not right to expect the residents to use
a perking permit program nor does he believe students will put
stickers on their cars, so the problem will still be there, He
also mentioned the residents' letter requesting continuance. He
said there is a need for. the college to come up with a master plan
to let the people in the area know what is being planned and what
is being done.
Mr. O'Dell said Chapman!, College does not have a history of being
a really good neighbor. He pointed out that the area proposed to
be torn down to make room for the parking lot now contains homes
owned by the college and rented to tenants over whom the college
apparently has no control. since the properties have been neglected,
thereby depreciating the neighborhood and disheartening the residents
who would like to know the college`s plans for the..future so they
know what they have to do. He said they would be less apprehensive
about the dollege as a neighbor if they knew what was going on.
He also complained about the lights from the stadium shining into
the adjacent homes late at night. He said those who signed the
letter would like the continuance so they can contact all residents
and present a constructive list of alternatives to the present
proposal. He said Chapman College owns other land that could be
made into a parking structure and also offered the suggestion to
build two two-story buildings rather than one four-story building,
He pointed out that if the current plans for the parking lvt are
carried out, it should be shielded f nom the residents of Center
Street who would be facing it.
Joe Susty, 409 North Shaffer Street, and Steve Taylor, 363. North
Center Street., bath expressed agreement with Mr. 0`Dell`s state
merits and made similar comments.
Mr, Smith invited those who spoke and other interested persons to
get together with him and address some of the things they brought
up. He said it is not the intent of the college to go east of
Center Street and the college master plan is within the bounds
of ,the property a7 ready owned by the college.
Chairman Mason declared the public hearing closed.
Commissioner Greek said he feels that the college really has not
solved the problem. and if this was an office building it would
require 450 parking spaces; in facti a school should have even.
more, He said he wants.a more definitive plan Qf what-is going to
be done, that the Planning Commission should have a better idea of

what is really required and what will be done. Commissioner Greek
said he doesn't know the square footage of the buildings on the
campus and it is unreal to expect a ratio of six students to one
parking space. He said he cannot support this application. because
the parking problem has not been solved.
Commissioner Hart asked Commissioner Greek what he feels would be
a satisfactory plan for anything he could support and how long he
thinks it would take to get it. Commissioner Greek said he wants
a parking study. made of the campus-~he doesn`t want ideas of what
could be done, he wants a definite plan of what will be done, He
said he needs definitive information, with a plan, not guesses.
He said he likes having a college in Orange but he cannot support
this proposal, Commissioner Hart requested that the public hearing
be reopened.
Chairman Mason reopened the public hearing. She asked President
Smith if he would like to recommend a continuance..
Mr. Smith said Chapman College has done a parking study and feels
it is very thorough, He said they have to recognize that at any
one time only 40% of the student population is on campus. He said
he thinks there should be a six-month period to see if the parking
lot works. Commissioner Greek said this has been done in the past
and. now there is a real problem, so the time to decide what to do
is before construction begins. He feels the problem should be
solved prior to construction rather than waiting until afterward
and then finding out it can`t be solved. Mr. Smith asked if the
conditional use permit can be granted so the college can get on
with the planning of the building and address the parking problem
at the same time,
William Bluerock, 2300~;Newport:B~ulevard, Newport Beach, architect
for the proposed building, said they have tried to assemble statistics
to come up with logical answers to correspond with the City Code,
He said less than 40% of the students are on the campus at any one
time, some are living on campus, some use the bus, the~~efore he
feels there is a ratio of two students per car. He read from the
conditions in the Staff Report and said they can`t guarantee there
won't be a problem but he doesn't think there will be one. He said
he doesn`t recommend compound parking as opposed to surface parking,
Commissioner Greek said there are 440 .employees that need parking
spaces which, added to the 800 students that are 40% of .the total
student population, makes a total of over 1200 parking spaces needed,
Mr.~Blu.erock said the dormitory students living on the campus won`t
use the proposed new parking lot. Commissioner Greek said ho defini-

to see some firm figures from a traffic study analysis. He said
the Commission does not have a traffic study and it doesn`t have

the college for a long time. Commissioner Greek said he needs
something more definitive to define what the parking requirements
will be and the route Chapman College is going to take.
Chairman Mason declared the public hearing closed.
Commissioner Master pointed out that if the application is turned
down there is still the problem of the present lack of adequate
parking and if the application is approved then there will be even
more parking needed. Commissioner Greek said there are letters in
the file going back to October regarding this problem but he sees
no progress having been made since then. Commissioner Hart said
his concern is not the actual figures but whether or not the plan
will work. Commissioner Hart said he would like to see some agree-
ment between Chapman College and the City that if this is built and
in six months it is obvious that there is not enough parking, the
college will do something to have more parking. Commissioner Master
pointed out the wording of Conditions 1 and 2 on page 12 of the
Staff Report, refering to Chapman College's "parking control plan"
and "parking management plan." Commissioner Greek said there is
no parking control plan at Chapman College.
Chairman Mason suggested continuance for two weeks to iron out the
things discussed at this hearing, Commissioner Greek said it will
be necessary to .have from Chapman College an indication of its parking
needs and a plan for policing the parkingi then the parking situation
can be looked at in six months to see if it is working, He said he
still wants individual parking considerations or even to have the
City Traffic Engineer look-over the plan. He said what is before
the Commission now is just opinions, not anything definitive, and
the Commission cannot make a decision on what it has now.
Commissioner Scott said he supports Commissioner Harts suggestion
for agreement and review in six months. He pointed out that actually
the Planning Commission doesn`t know if .the entire campus is being
included because it doesn`t know what is being torn down to erect
the proposed building and parking lot. Mr, Minshew said he would
draft an agreement if he can find out what the Commission wants.
It was agreed that Conmisioner Hart, Commissioner Scott and Mr.
Minshew would get together to work out an agreement,

Conditional Use Permit 1486 be continued to tho maeting of Febru-
ary 3, 1986, allowing Chapman Co'11ege to submit figures as to what
is going to be torn down and allowing Commissioner Hart,-Mr, Minshew
and himself time to get together and draft an agreement. Mr. Smith
said that this was not agreeable to him or to Chapman College.

Chairman Mason responded that a public hearing is not required but
there can be one.
IN RE: NEW HEARINGS
CONDITIONAL USE PERMIT 1202-A - HE LIVES FAITH CENTER
Proposed church use within the Industrial M-2 Zone on a .39~-acre
parcel on the southeast corner of Main Street and Alvarez Avenue
(645 North Main Street).
NOTE: Negative Declaration 762 has been filed previously for this
use and has been amended to consider this site.
Mr. McGee made the presentation in accordance with the Staff Report
and said Staff recommends that the Planning Commission reactivate
and extend Conditional Use Permit 1~ prior to considering 1202-A.
He said Staff has re-evaluated the Negative Declaration and suggests
action on it be reaffirmed. He said Staff recommends approval of
Conditional Use Permit 1202-A for temporary use of the facility.
Chairman Mason opened the public hearing. Tom Barkey, pastor of
the He Lives .Faith Center, 1374 Carl Street, Anaheim, said he 'has
reviewed the conditions and agrees with them;. in fact,-the church
has already met most pf .them in working with-the Fire Department,
He said some conditions were not met in the past because of a mis~
understanding; when that was realized the conditions were then met,
He said the condition that was not met was recording the parking
p~ermi_ts with the County Recorder, but that has now been done. He
said the Staff person who was working on this application left the
City employ and Mr, McGee is the third person assigned to it, Mr.
McGee stated he did not become involved with this application until
six weeks ago.

CONDITIONAL USE PERMIT 1457 - TONTI/GARCIA
Proposed construction of a second-story unit over a garage within
the RD-6 (Residential Duplex) RCD (Residential Combining District)
Zone on a .14-acre parcel on the east side of Batavia Street,
south of Chapman Avenue (141 S. Batavia Street).
NOTE: This project is exempt from Env ironmental Review.
Mr. Soo-Hoo made the presentation in accordance with the Staff Report
and said Staff recommends approval subject to the conditions in its
report.
Chairman Mason opened the public hearing.
Joaquin Garcia, applicant, 141 S. Batavia Street, said he understands
all the conditions and agrees with them.
David Shelley, 131 South Batavia Street, said he is against approval
of this project because it will be five feet from his fence overlooking
his back yard. He said he already has one on one side and he doesn`t
want it on .both sides,
Dennis Gerry., 152 South Batavia Street, said there is already a
parking problem on the street and an additional residential unit
will add to it. He said the applicant already has a second-story
apartment in use in his home, which he claims will be eliminated
when the unit over the garage is built,
Commissioner Greek pointed out Conditions 1 and 10 and asked what
is the guarantee that there will not be a third unit on the property.
Commissioner Hart asked what the applicant intends to do.
Mike Gale,-173 South Batavia Street, said any apartment in the area
would be seen from any home in the area and therefore would detract
from the area's appearance. Commissioner Hart poiocted out that the
property is zoned for this. He asked Mr, Garcia if he realized
that the maximum allowed on the property would be two units which
he already had with the apartment on the second floor of his home,
Mr. Garcia said he plans to use the second floor of his home for a
family room and wants the rental unit to be over the garage,

Commissioner Hart asked Mr. Garcia if, in that case, he would be
willing to close the outside exit and staircase to the second
floor. Mr. Garcia asked why he should close the exist and s~haircase.
Commissioner Hart said that would prevent him from renting it and
having three units. Mr. Garcis said if the Commission thinks the
exit and stairway should be removed he will remove it. Commissioner
Scott asked about the windows on the new structure and if they will
be high enough to not interfere with the privacy of the neighbors.
Commissioner Hart said it appears that all of the windows and even
a balcony are on the north side and that seems excessive. He suggested
a continuance to revise the plans so that there is no encroachment
on the neighbors. Mr. Garcia. said the staircase to the second floor
of his house is inside, not outside, and is the only way of reaching
the second floor. Discussion followed on the possibility of his
trying to have a triplex with two rental units, He was asked if
he would agree to a continuance so he could revise his plans. He
agreed to this and said he would .contact his builder,
