The regular meeting of the City of Orange Planning Commission was called to order by Chairman Greek at ?:30 p. m. PRESENT: Commissioners Bosch, Greek, Hart, Master, Scott ABSENT: Aone STAFF PRESENT: Jack McGee, Administrator and Commission Secretary; Ron Thompson, Director of Community Development; Gene Minshew, Assistant City Attorney; Gary Johnson, City Engineer; and Sue Devlin, Recording Secretary PLEDGE OF ALLEGIANCE IN RE: ELECTION OF CHAIRMAN AHD VICE-CHAIRMAN Moved by Commissioner Master, seconded by Commissioner ' Bosch, that the Planning Commission nominate Commissioner ~. AYBS: Commissioners Bosch, Greek, Hart, Master, Scott ROES: None MOTION CARRIED I N RB : NEG1 HEARINGS VARIANCB 1828 - FEATURELIHE MANIIFACTURING: Proposed variance to allow a reduction in the required off-street parking on two rectangular shaped parcels of land, located north and west of the intersection of Briardale Avenue and Neville Street, addressed 521 Briardale Avenue. ROTE: Negative Declaration 118? has been prepared for this project. Joan Wolff presented the staff report: The application is for two industrial properties, north of Taft and west of Glassell, zoned K 2. All properties in the area are industrially zoned. The applicant has filed a variance request and is seeking relief from parking requirements in order to provide fewer parking stalls on site than are required by code. The applicant has applied for building permits for construction of three awning structures. These structures would be located within the designated parking areas. The areas are not now used for parking and instead contain outdoor storage and manufacturing uses. However, in order to approve the building permits for the new construction, a variance must first be approved authorizing a waiver in the parking requirements. Pertinent facts regarding this case are that the two buildings have a total parking requirement of 56 parking spaces. The applicant is proposing to provide 24 parking spaces. Building permits for the two industrial buildings were originally issued in 19?8. The parking requirements for the industrial uses haven't changed since that time. It appears the area now used for outdoor storage and manufacturing was designed as a parking lot. The current lack of on site parking has impacted local circulation and that all employees of both buildings must now park on the streets. The applicant is proposing to restore 24 on site parking spaces, which is less than half of the requirements as far as the number of parking stalls. Planning Commission Minutes • January 4, 1988 - Page 3 ® In order to approve the variance request, the applicant will need to demonstrate to the satisfaction of the Planning Commission that there are special circumstances in order to 3ustify the legal findings for granting a variance. The public hearing was opened. Bob Meredith, 15?6 Sky Line Drive, Laguna Beach, stated the awnings were existing awnings which have been there over five years. They have analyzed the whole area and pictures were submitted with the application of the usage in the area. The awnings are part of the business. Without them, his three year lease is gone. The Fire Department required them to sprinkler the awnings and that is why the permits were submitted. One set of awnings have already been sprinklered. They have a lot of money tied up in ducting and sprinklers. What they have requested has always been there. Commissioner Hart informed Mr. Meredith the Code Enforcement Officers are requiring owners to correct code violations and he happened to be one of the first one's notified. The Commission needs to know where the hardship arises with his property in order for them to grant him a variance. Mr. Meredith stated without the raw materials, the two buildings that have the equipment in them and the people would not be there. Nothing has been said in the last five years. There is not enough room in that area to store materials. Mr. McGee thought the original parking that was provided for the building would be adequate. The awnings probably cover some of that originally required parking spaces. The required parking which fills that entire open lot, would not by code, be allowed to be outside storage. Those speaking in opposition: John Olsson, 1845 North Case, has been neighbors for three or four years. His concern is about the stop light on Glassell and Taft, which has caused much of the commuter traffic to go up Neville and Case at a high rate of speed. The traffic is getting out of control on those streets. Mr. Meredith has a problem with the dumpsters in the street. Mr. Meredith did not have a rebuttal. Moved by Commissioner Hart, seconded by Commissioner Greek, that the Planning Commission recommend to the City Council that it accept the findings of the Environmental Review Board to file Negative Declaration 118?. AYES: Commissioners Bosch, Greek, Hart, Master, Scott HOES: Hone MOTION CARRIED Moved by Commissioner Greek, seconded by Commissioner Bosch, that the Planning Commission deny Variance 1828 because no finding of special circumstances or hardship can be found. AYES: Commissioners Bosch, Greek, Hart, Master, Scott ROES: Hone MOTION CARRIED Mr. McGee stated this was a final action, unless appealed to the City Council within 15 days. IH RE: AEW HEARINGS CONDITIONAL USE PERMIT 1642 - CHAPMAH COLLEGE: Proposed conditional use permit to establish a temporary parking lot for Chapman College on property located north of Walnut Avenue, between Grand and Center Street in the R-1 zone. ROTE: Negative Declaration 1196 has been prepared for this project. A staff report was not presented. The public hearing was opened. Steve Scopeletti, 25?01 Fernbank, B1 Toro, Director of Facility Management for Chapman College, agrees to the recommendations in the staff report. They are looking for Commission approval on this request. Commissioner Bosch asked if Mr. Scopeletti were aware of the condition to comply with the City's security ordinance is that the Police Department's request requires construction of a rod iron fence <non-climbable) and it cannot be placed in the setback. The condition appears to impact the layout of the parking as presented. Mr. Scopeletti thought a chain link fence would be adequate. Planning Commission Minutes January 4, 1988 - Page 5 Mr. Scopoletti did not realize there was a problem and will need to speak to the Police Department. Ms. Wolff commented on Condition 8. She spoke with the Police Department and their intention to have some fencing around the parking area, be it 6' high at the setback line or 42 inches within the setback, was negotiable with them. They wanted some sort of symbolic barrier to keep people out of there, The fencing could be within that setback area at 42 inches high as long as it was a non-climbable fence . Commissioner Greek had a problem with that condition. He had trouble supporting a condition that was negotiable. He preferred having a representative from the Police Department at the hearing to answer these questions. He questioned the need of a rod iron fence for a two year period. Commissioner Hart commented that it appears they have an unworkable plan under the Police Department's original request. Commissioner Greek wanted to postpone this item to the next meeting. Chairman Scott stated the Commission was not in a position to negotiate with Chapman College. Mr. McGee stated if the Commission desired, staff would meet with the Police Department and Chapman College together to resolve exactly what the expectations are and bring it back to the Commission, Chairman Scott was also concerned about the existing gravel surface for a two-year period. It is inadequate for a parking lot. Commissioner Bosch shares that concern. Two years does not seem that long over a two-year growth of the development of the campus, but the neighbors adjacent to the College would probably feel different. Commissioner Hart would like to see something more substantial. Mr. Scopoletti spoke about their plans for future growth at Chapman College. Commissioner Greek feels some of the requirements are not realistic. The plan needs to be altered to match the City codes so it will work for Chapman College. C G Planning Commission Minutes January 4, 1988 - Page 6 Mr. Thompson thought it was appropriate at this time, since Chapman College is working on a master plan for their ultimate campus expansion, to bring in their master planner to look at the interim parking lots on a more permanent basis and come up with a reasonable setback requirement, than using the 20' residential setback. Moved by Commissioner Greek, seconded by Commissioner Bosch, that the Planning Commission continue this item for two weeks to allow the applicant to revise his plan to satisfy current City codes, and allow the Commission to determine what standards of security are being required by the Police Department. AYES: Commissioners Bosch, Greek, Hart, Master, Scott ROES: None MOTION CARRIED ROTE: THE COMMISSION LATER CHARGED THE ABOVE MOTION TO CONTINIIE THE HEARING TO 2-1-88. IN RE: NBW HEARINGS CONDITIONAL USE PERMIT 1643 - CHAPMAN COLLEGE: Proposal to locate a modular classroom unit for two years on the west side of Center Street, south of Walnut Avenue. This item was referred to the Planning Commission by the Zoning Administrator. A staff report was not presented. The public hearing was opened. Steve Scopeletti, 25?01 Fernbank, E1 Toro, Director of Facility Management for Chapman College, does not have any problems with the conditions of the staff report. The unit that would be put on the property would house a classroom for two years. The area is for off-site storage while the learning center is being built. The public hearing was closed. Commissioner Hart requested a copy of Security Ordinance ?-?9. Commissioners discussed paving and security requirements with Mr. Minshew. C Mr. Johnson stated they have allowed a temporary type of surfacing for other requests. Vhen Chapman College asked for that lot to be provided several tenths ago, there was . Planning Commission Minutes ' January 4, 1988 - Page 7 nothing else requested. How they are getting requests for temporary buildings and it appears those lots will be more permanent than were originally envisioned. Standards need to be imposed. Mr. Johnson further stated a grading permit is required and a grading plan would be necessary. Commissioner Greek does not have a problem with the temporary usage of the facility with the trailer, but has a problem with knowing what level of requirements being placed on it. Two conditions do not spell out what is being asked of Chapman College. He wishes there were some temporary rules or requirements that would accomplish their goals for a two-year period. Commissioner Hart suggested they draw up a set of temporary parking lot standards/specs. Commissioner Bosch agrees they need something that applies to temporary standards. Mr. Thompson offered to discuss this matter with Chapman College's consultant and have them come up with some temporary standards, as well as permanent standards. Moved by Commissioner Bosch, seconded by Commissioner Hart, that the Planning Commission continue this item until 2/1/88.
