PLANNING COMMISSION
MINUTES
City of Orange
Orange, California
January 6, 1986
Monday, 7:30 p.m.
The regular meeting of the City of Orange Planning Commission was called to
order by Chairman Master at 7:30 p.m.
PRESENT: Commissioners Master, Greek, Hart, Mason, Scott
ABSENT: None
STAFF Stan Soo-Hoo, Administrator of Current Planning and Commission
PRESENT: Secretary; Jack McGee, Associate Planner; Gene Minshew, Assistant
City Attorney; and Toba V. Wheeler, Recording Secretary.
PLEDGE OF ALLEGIANCE
Chairman Master announced that it was time to elect new Planning
Commission officers and requested nominations for the office of
- Chairman. Commissioner Scott suggested that the position be
rotated annually and nominated Commissioner Mason for Chairman.
There were no other nominations and Commissioner Mason was unan-
imously elected Chairman. Commissioner Hart nominated Commissioner
Greek for Vice Chairman. There were no other nominations and Com-
missioner Greek was elected unanimously. Cbmmhissioner~:Master gave
the gavel to Chairman Mason.

IN RE: ITEMS TO BE CONTINUED OR WITHDRAWN
CONDITLONAL USE PERPIIT 7467 - ANGELOS
Mr. Soo-Hoo said that due to a need for clarification regarding the
conditions of approval, Staff is requesting that this item be con-
tinued to tfi a meeting of January 20, He said the applicant's attorney
has been notified and has consented to the continuance, When
the applicant's representative was questioned by Chairman Mason,
he said that continuance to January 20 meets with his approval.
Moved by Commissioner Greek, seconded by Commissioner Master-that
this item be continued to the meeting of January 20,--'1985,

CONDITIONAL USE PERMIT 1.456 - INTERSTATE CONSOLIDATED LNDUSTRIES
Proposed drive-through window in conjunction with a fast food
restaurant on 2.04 acres in the C-1 zone at the southwest corner
of Kate1la Avenue and Tustin Street.. (Continued from the October 14,
December 2,-and December 16, 1985, Planning Commission meetings.)

NOTE: Negative Declaration 1042 has been prepared for this project.
Mr. Soo-Hoo made the presentation in accordance with the Staff
Report, using the diagrams posted on the wall, and pointed out that
the Staff Report had been amended to show a reduction of eight
parking stalls rather than a deduction of six parking stalls. He
said Staff recommends acceptance of the Negative Declaration, approval
of the 3.5% reduction in parking and approval of the Conditional Use
Permit subject to the conditions listed in its report.
Chairman Mason opened the public hearing. Susan Lindquist, 3140
Redhill Avenue,-Costa Mesa., representing the applicant, said the
conditions in the Staff Report were acceptable.
Chairman Mason declared the public hearing closed.
Moved by Commissioner Greek, seconded by Commissioner Hart, that the
Planning Commission accept the findings of the Environmental Review
Board to file Negative Declaration 1017.

Planning Commission approve Conditional Use Permit 1456 subject to

IN RE: ~~.NEW HEARINGS
CONDITIONAL USE PERMIT, 1489, VARIANCE 1787 ~ ORANGE SENLOR HOUSLNG, INC.
Proposed development of 75 residential units within the RM-7 (Resi-
dential Multi--Family) FP-2 .(Flood Plain Combining District) Zone,
with unit sizes smaller than required by ordinance, and less parking
spaces and enclosed parking spaces. Proposal is on a 15-acre parcel
on the east side of Shaffer Street adjacent to (and including a
portion of) Santiago Creek.
NOTE: Negative Declaration 1042 has been prepared for this project.
Commissioner Greek asked to be excused from the hearing due to a
potential conflict of interest.
Mr, Soo-Hoo made the presentation in accordance with the Staff
Report,-and said Staff recommends acceptance of the Negative
® Declaration and approval of the Conditional Use Permit and the
Variance subject to the conditions in its report.

Commissioner Hart asked if, in the final grading,. this site would
be as high as the adjoining property. Mr. Soo-Hoo said it would be
approximately the same elevation. Chairman Master questioned if
Condition 3 on Page 6 was worded correctly, that "the Fire Depart-
ment connection shall not be affixed to the building," etc., and
was told by Mr. Soo-Hoo that this is now a standard condition.
Chairman Mason opened the public hearing. Bruce Johnson, President,
Orange Senior Housing, said Mr. Soo-Hoo had interpreted and clarified
a number of issues that that there were additional issues needing
clarification which he would like to have done at the present time
by his architect. Joseph Woollett, 58 Plaza Square,=Orange, the
architect, discussed various issues in the Staff Report and said
he is satisfied that there is good understanding with City Staff
regarding the flood plain, zoning, improvement of the creek adjacent
to the site, etc. He said the area of the one-bedroom unit should
be noted as 536 square feet instead of 586, obviously a typographical
error, pointing out that the maximum allowed by HUD is 540 square
feet. He pointed out that. the three wings of the building are
similar but not identical. He said he met with the Fire Department
to obtain clarification of its conditions so they could be met in
the construction,
Chairman Mason declared the public hearing closed. Commissioner
Master asked if Conditions 3 and 4, v~h_ch Mr, Wob'llett had referred
to as having been discussed with the Fire Department, had indeed
been clarified by Staff. Mr. Soo-Hoo said he knows of no amendment
passed on to Staff by the Fire Department and suggested that perhaps
re~pording of the conditions might accomplish what the applicant needs.
He suggested that Condition No, 3 be changed to read, "Fire Depart-

Commissioner Greek returned to the meeting.
IN RE: NEW HEARINGS
CONDITIONAL USE PERMIT 1481 - COCO'S
Proposed expansion of a restaurant within the 0-P (Office-
Professional) Zone located on a 27,468-square foot parcel on
the northeast corner of Chapman Avenue and Shaffer Street.
NOTE: Negative Declaration 1037 has been prepared for this project.
Commissioner Hart asked to be excused from the hearing due to a
possible conflict of interest.
Mr. McGee made the .presentation in accordance with the Staff. Report
and pointed out that Condition No. 8 did not mean there~~would be
any physical change in the site since the five feet along Chapman
Avenue had been taken when that street had been widened, that all
that was necessary was the formal dedication to gain the public
right-of-way to be consistent with the rest of the street. He
said Staff recommended acceptance of the Negative Declaration and
approval of the Conditional Use Permit subject to the eight
conditions listed in each report.
Chairman Mason opened the public hearing. There being no comments,
Chairman Mason declared the public hearing closed.
Moved by Commissioner Greek, seconded by Commissioner Scott, that
the Planning Commission accept the findings of the Environmental
Review Board to file Negative Declaration 1037.

garage in the RD-6 (Residential Duplex) RCD (Residential Combining
District) Zone located on a 6,500-square foot parcel on the south
side of Palmyra Avenue, approximately 95 feet east of Grant Street
(314 East Palmyra Avenue).
Mr. McGee made the presentation in accordance with the Staff Report,
and said Staff recommends approval subject to the conditions in its
report.
Commissioner Scott questioned whether or not the parts on the land
use map containing an asterisk had been approved previously. Mr.
McGee said they had. Commissioner Mason asked if any consideration
had been given to making all the alleys in the area one-way. Mr.
McGee said Staff and the Environmental Review Board have had some
preliminary discussions concerning this and he feels that with
more and more receipt of proposals of this nature some action will
have to be taken in the future but nothing definite has been done
as yet.

Chairman Mason declared the public hearing closed.

the Planning Commission approve Conditional Use Permit 1484 subject
to the conditions in the Staff Report.

IN RE: NEW HEARINGS
CONDITIONAL USE PERMIT 1487, TENTATIVE PARCEL MAP 85-449 - NU WEST, INC.
Proposed reparcelization of two existing parcels into three parcels
and development of office uses within the M-2 (Industrial) Zone
located on 8.1 acres on the southeast corner of Kate1la Avenue and
Main Street.
NOTE: Negative Declaration 1041 has been prepared for this project.
Mr. McGee made the presentation in accordance with the Staff Report,
and said Staff recommends acceptance of the Negative Declaration and
approval of the Conditional Use Permit and Tentative Parcel Map for
the reasons stated in its report and subject to the conditions in
its report.
Commissioner Mason asked if it has become the policy to change the
industrially zoned areas if they have an arterial access. Mr. McGee
said Staff has used the arterial access and frontage as something
of a criteria in reviewing affice'prbposals, in the industrial area,
most of which have been on one of the few major arterials passing
through the industrial area.

Commissioner Master said he is aware that the City Council has
directed Staff to review the use of M-2 properties, particularly
as a result of the office building complex on Katella on which,
apparently, the City Council is holding up action. He said he
believes Councilman Smith raised the issue of too much M-2
property being converted to office use.
Commissioner Scott said part of the concern is that the require-
ments in the industrial zone for office use is not as stringent
as it is in a commercial zone. He asked if this proposed
development would meet all of the requirements if it were being
developed in a commercial zone. Mr. McGee said that in terms of
parking and those kinds of things it would.
Commissioner Greek pointed out that there was no tentative parcel
map in the Commissioners' packets and asked how that map can be
considered for approval without its being seen by the Commission.
Chairman Mason opened .the public hearing. Steve Prothero, 741 East
Briardale, Orange, representing the applicant, said he has reviewed
the Staff report and has to objections to it; however, he did meet
Public Works Department requirements for submission of a tentative
® map.
Chairman Mason declared the public hearing closed.
Bert K. Ya~asaki, Director of Planning and Development Services,
said the City Council,. at the urging of Councilman Smith, instructed
Staff to conduct a study on commercial a~d~offceg=uses in the
industrial area. He said Staff has always interpreted the Code
as allowing, under ~orrditional use permit, offices in the industrial
zone. He said there were three locational factors originally that
were used to weigh conditional use permit applications: 1) whether
it was integrated development,-i.e~.~, did it have commercial as well
as industrial andJor office uses combined in the proposal; 2) whether
or not it was on a major arterial highway, and 3) whether or not it
had any impact upon the adjacent property. He then added a fourth
factor that was considered, an area requirement, something like a
seven-acre or four-acre minimum size. He said that when the compre-
hensive code change was made in the early '80's, Staff proposed
that the minimum size of the development be eliminated from the
Code restrictions because there was almost a granting of the
variances of development size. He said Councilman Smith objected
to that but a majority of the City Council eliminated it as one of
the conditions of approval.. Mr. Yamasaki said that at this stage
Staff is evaluating these applications based upon whether or not
it is on a major arterial and in most cases these developments
have some integrated feature about them, although this one does not.

plotting the various conditional use permits which allow some office
either exclusive or an an integrated portion and will probably be
applying those as part of the studies; however, he is not sure
exactly when this will be done.
Chairman Mason asked if this had been presented to the City Council
and whether. or not it had indicated any preference. Mr. Yamasaki
said that at this stage he is giving the Planning Commission a
preview of what seems to be developing as Staff begins to complete
each stage of the research studies and the report has not been
presented to the City Council as yet.

the Planning Commission accept the findings of the Environmental
Review Board to file Negative Declaration 1041.

Mr. McGee made the presentation in accordance with the memorandum
of December 26, 1985, to the Planning Commission from Planning and
Development Services. He said Staff recommends denial.
Moved by Commissioner Greek, seconded by Commissioner Hart, that
the Planning Commission deny Administrative Adjustment 85-28.
