The site is currently used as a tennis club, and the project, as proposed, requires approval of the following permits: General Plan Amendment Amendment - To amend part of the land use Current designation of Recreation (Tennis Clu Low Density Residential. 3-89 and Orange Park Acres Plan the Orange Park Acres Plan, which is element of the City's General Plan. the property is "Open Space and b)"; proposed designation is Medium Zone Change 1119-89 - To reclassify the property from the R-O zone (Recreation-Open Space) to the R-1-10 zone (Single Family Residential Minimum 10,000 square foot lot size.) AYES: Commissioners Bosch, Greek, Hart, Master, Scott NOES: None MOTION CARRIED IN RE: CONTINUED HEARINGS CONDITIONAL USE PERMIT 1776-89, ADMINISTRATIVE ADJUSTMENT 89-18 - EL POLLO LOCO: Conditional Use Permit application to allow a drive-up window in a fast food restaurant located in the C-2 zone, and an Administrative Adjustment Permit to allow the utilization of uniform parking stall size on property located on the north side of Chapman Avenue between Main Street and Feldner Road, addressed 1519 West Chapman Avenue. Planning Commission Minutes October 2, 1989 - Page- 3 NOTE: Negative Declaration 1311 has been prepared for this project. (This item was continued from the August 21, 1989 Planning Commission Meeting.) A staff report was not presented as no one was in opposition to this project. The public hearing was opened. Applicant Steve Lewis, Manager of Architecture at E1 Pollo Loco, 3345 Mickelson Drive, Irvine, concurs with the staff report from the August 21, 1989 Planning Commission Meeting (which was continued). He .did not assume there were any changes from the previous meeting. They are within conformance of the existing zone and E1 Pollo Loco is a very community-oriented company. They recently had a project approved at the intersection of Tustin and Katella, which is now under construction. The Administrative Adjustment was a recommendation from staff, which would make their parking easier to work with. They were using the compact vs. the standard size stalls and now they will use the uniform size stalls. The public hearing was closed. Commissioner Greek was concerned about the exiting radius of 10 feet. Will that be adequate for vehicles to get out and still stay on their side of the driveway? Chairman Bosch responded Commissioner Greek's concerns were voiced at the previous meeting regarding the drive access to the site. But since there was not a public hearing, the comment was continued to this meeting. Commissioner Greek stated it was not such a major concern to deny the project, but wishes the City Engineer would look at it and maybe taper it or something to allow the turn to be made without having the vehicles turn into that incoming traffic lane. He felt it would create a back up of traffic. Commissioner Scott assumed the Traffic Engineer has reviewed the plans and thought it was adequate as far as the turning radius is concerned. AYES: Commissioners Bosch, Greek, Hart, Master, Scott NOES: None MOTION CARRIED IN RE: NEW HEARINGS TENTATIVE TRACT MAPS 13841 AND 13842, ZONE CHANGE 1105-88, CONDITIONAL USE PERMIT 1738-88, VARIANCE 1855-88 AND ADMINISTRATIVE ADJUSTMENT 88-13 - ORANGE HOMES: The applicant is requesting approval of two Tentative Tract Maps and related submittals to allow the subdivision of 70.8 acres into a single family development and a multi-family development. Tentative Tract 13841 is for a 73 lot single family development on a 16.4 acre site. This subdivision includes requests for a Variance to allow creation of a lot with lot width less than the minimum allowed by Ordinance and an Administrative Adjustment to allow creation of twelve lots located around cul-de-sac or street knuckles with lot width or lot depth less than the minimum allowed by Ordinance. Tentative Tract Map 13842 is for 485 condominiums on a 54.4 acre site. This subdivision includes a request to change the zoning on a portion of its site from R-1-6 (Residential, single family, minimum lot size 6,000 square feet) to R-3 (Residential, Multi-family) and to change the location of an R-0 (Recreation, Open Space) site. Also included is a request for a Conditional Use Permit to allow for a Planned Unit Development and the creation of lots without direct access to a public street. Subject property is located west of Prospect Street, south of Collins Avenue, east of the Santiago Creek, and north of Walnut Avenue. NOTE: Supplemental Environmental Impact Report 861 has been prepared for this project. Planning Commission loiinutes October 2, 1989 - Page 5 Commissioner Greek was excused from the meeting due to a potential conflict of interest. The staff report was presented by Chris Carnes. The site is the former Conrock grading site. It is presently zoned with a combination of multi-family and R-1-6. It contains a small one acre site for recreation, open space. The project is broken up into two components -- Tentative Tract Map 13841, which is for a 73 single family lot; and Tentative Tract Map 13842 for multi-family development. The project includes several major street improvements: specifically, a new alignment for Prospect Street connecting it from where it turns east at Spring Street to the Collins curve, and to extend Walnut Street 800 feet to the west and cul-de-sac it at the proposed park site. It also proposes two minor realignments for Prospect Street. The curve will be removed at Walnut and Prospect and replaced with a T-intersection. Bond Street will be extended approximately 150 feet west from the existing Prospect Street to the new Prospect Street. The existing General Plan and zoning was approved by the City Council in 1984. Council was reviewing a project at that time which included 650 dwelling units for a total of 110 acres. This project is only 70 acres of that 110 acres. The Council and Commission have approved a 10 acre development on the west side of the creekbed - Emberton Development - for 84 homes. At the time the Council approved that General Plan Amendment and Zone Changes, they set a maximum density for the overall site of 8 units per acre. The applicant is not proposing to develop the remaining portion of that 110 acres, which is south of Walnut Avenue. In 1988 the Council denied a request for this site and a portion of the site south of Walnut Avenue due to a lack of information on grading of the site and the new proposal for the alignment of Prospect Street. In January, 1989 the City Council did approve a rough grading plan for this site. The rough grading plan included filling the existing pits, removing existing structures and clearing the site of debris. The grading plan did not propose any import or export. of soil to the site. The applicant was able to achieve- this without any import due to the overaii lowering of the site and some fill material available from the widening of the creekbed. The project does include improving the Santiago creekbed, including a bicycle trail along the east side.. Staff's review and concern is with the property south of Walnut Avenue. It is not going to be covered by the Environmental Impact Report that was done in 1984 or the Supplemental Environmental Impact Report that was done for this project. The zone change proposed is necessitated by Planning Commission Minutes October 2, 1989 - Page 6 the proposed new alignment of Prospect Street. The new alignment, without the zone change, will create nine acres on the west side of Prospect Street zoned single family and separated from the single family tract being proposed. It will also leave the proposed park site in the center of the development and away from any street access. The park site is proposed as part of the Regional Bike Trail System. It will be a rest stop and access point for that bike trail. The public hearing was opened. Applicant Tom Grable, Orange Homes, Inc., 111 Del Mar, #215, San Clemente, presented the Orange Homes project. Their various chemical consultants were available to answer specific questions. The project is a result of some combined interests of various groups that have a stake in the site. They have met with the City and neighbors and many concerns have been addressed and incorporated into the project expressed by the neighbors in the immediate area. A year ago they sat down with City staff during the re-design process and went over the City's concerns regarding the site. He explained those concerns and provided exhibits of their project. The proposed Prospect alignment does not encroach upon the neighborhood to the east and directs traffic away from the single f amily neighborhoods, and provides a north/south tie in to Collins so that a right hand turn is not needed. There will be three signalized intersections. It also achieves the Collins curve, which will provide some safety on that curve. It also provides a natural zoning boundary and that is the reason for the zone change request. They propose to improve and construct the improvements to the creek per the City, County of Orange, U.S. Army Corps of Engineers and the Federal Emergency Management Agency standards for the creek. They will not be widening the creek, but doing the improvements within the 200 foot right-of-way; they will be deepening the creek. The bike trail and rest stop will also be provided. They will be improving, landscaping and dedicating that to the County as part of their Master Plan of Countywide Bikeways and Riding Trails. He spoke briefly on the single family development of 73 detached homes and the town home development of 485 units. They expect this project to be phased between 3 1/2 to 4 years to complete. The Prospect re-alignment will occur during the first phase. They have reviewed the 76 conditions of approval and agree to comply with them. The public hearing was closed. Planning Commission-Minutes October 2, 1989 - Page 7 Moved by Commissioner Master, seconded by Commissioner Hart, that the Planning Commission accepts the findings of the Environmental Review Board to certify that Supplemental Environmental Impact Report 861 has been prepared in accordance with CEQA and that the mitigation measures outlined in the Supplemental EIR 861 will eliminate or reduce to an acceptable level any adverse environmental impacts associated with the project. IN RE: NEW HEARINGS CONDITIONAL USE PERMIT 1789-89 - MARK FAWCETT: Proposed Conditional Use Permit to allow a hand wash car wash in the C-1 zone, on property located at the northeast corner of Chapman Avenue and Earlham Street, addressed 4301 East Chapman Avenue. NOTE: Negative Declaration 1316-89 has been prepared for this project. Commissioner Greek was absent from the meeting. A staff report was not presented. Mr. Godlewski commented the proposal was on a piece of property the Commission has seen previously for Quaker State Minit Lube. That application is no longer being pursued by the owners of the property. There are two properties that are proposed to being developed as a hand wash car wash. Staff was initially concerned that these two properties should probably be consolidated before any single use by permitted over two separate properties; however, the applicant has indicated it is not their desire to combine the properties, but rather keep them under separate ownership and provide a lease to the operator of the car wash. The public hearing was opened. Applicant Mark Fawcett, 149 S-age Hills Road, proposes a hand auto detail business. They feel it will be a quality project. They propose to move the cars off of Chapman Avenue, down Earlham Street to the entrance on the back side. Currently there is a residence on the property. They :vill remodel that residence for the cashier's office, as well as a boutique for car items. They will be recycling a majority of the water. He presented a letter to the Commission, which was given to the owners of the project from the City Council of the City of San Dimas.
