The regular meeting of the City of Orange Planning Commission was called to order by Chairman Greek at 7:30 p. m. PRESENT: Commissioners Bosch, Greek, Hart, Scott ABSENT: Commissioner Master STAFF PRESENT: Jack McGee, Administrator and Commission Secretary; Ron Thompson, Director of Community Development; Gene Minshew, Assistant City Attorney; Gary Johnson, City Engineer; and Sue Devlin, Recording Secretary PLEDGE OF ALLEGIANCE IN RE: I~IIMUTES OF NOVEMBER 2, 198? Moved by Commissioner Bosch, seconded by Commissioner Hart, that the Planning Commission approve the Minutes of November 2, 198?, as recorded. AYES: Commissioners Bosch, Hart, Scott NOES: None ABSTAINED: Commissioner Greek ABSENT: Comaissioner Master LOTION CARRIED IN RE: CONTINUED ITEMS TEATATIVE TRACT 13204 - TRIDER CORPORATION: Proposed tentative tract map subdividing an approximate 5.8 acre parcel of land into 17 lots on property located south and west of Santiago Boulevard at Sycamore Street. NOTE: This item was continued from the October 12, 198? ® meeting, Pre-Zone Change 1076 and Negative Declaration relating to this item were approved/ accepted by the Planning Commission on October 12. A staff report was not presented as no one was in opposition to this pro3ect. The public hearing was opened. Comaissioner Hart asked the City Engineer if the Agreement with the Water District was satisfactory to the City? s Planning Commission 1~[inutes Aovember 16, 198? - Page 2 Mr. Johnson said they were aware of that letter and stated it was unusual they would do something like this, but if they indicate they are going to accept it for maintenance, then it has to be taken at face value. Chairman Greek asked if there was a condition in the recommended list of conditions that would satisfy this requirement? lax-. Johnson said there were two conditions. that were pertinent to that -- Conditions #6 and #? (which he read from the staff report). The conditions were written before the letter was received from the Water District. It should possibly be amended to reflect the latest condition. It was their intent the homeowners association would be responsible for that maintenance since they were the benefiting owner. Chairman Greek feels the conditions they are looking for indicate the land shall be dedicated to the top of slope, which can be described in the future once the final maps are prepared, but there is a problem with guaranteeing maintenance of that slope. llx~. Johnson thought with the existing condition the maintenance is beneficial to the people at the top of the slope. Those people would probably want a say in how that slope is maintained. Alan Trider, 12 Corporate Plaza, 8ewport Beach, intends to improve the slope and maintain it. Gary 14cCann, 12 Corporate Plaza, Newport Beach, met with the Water District and obtained the letter the Commissioners had in their packet. They are assuming the slope will be maintained by the Water District. %ved by Commissioner Hart, seconded by Commissioner Scott, that the Planning Commission approve Tentative Tract 13204 with two conditions: Condition #7 - Santiago Creek shall be dedicated and approved as required by the Flood Control District and Condition #8 - the existing south slope shall be landscaped and sprinkled as required by the City Parks Department and maintained by the Orange County Water District. (Discussion continued before voting.) Commissioner Hart wished to stress that "maintained" is a condition that must be met by an agreement with the County that the City is a party to. Planning Commission Minutes Aovember 16, 198? - Page 3 Mr. Johnson thought the question was the level of maintenance. They envisioned a manicured slope. A slope that would have sprinklers, extensive plantings, etc. That type of slope vs. one that would go back to nature after it is established is a matter of semantics. It is their opinion that if it is going to be a manicured slope, then the Water District is not going to maintain it in a manner that the homeowners would find acceptable. That is why Commissioner Hart pointed out landscaping and sprinklers would be required by the Parks Department. Chairman Greek wondered if the landscaping and sprinklers shall be installed and the slope shall be maintained by a homeowners association; ownership shall be granted to the Orange County Water District, would that be enforceable? Mr. Johnson assumed the Water District could own the land and issue a permit for maintenance purposes to the homeowners association for proper maintenance. He does not know if the property owners understand the importance of proper maintenance with regard to their property. Mr. Trider was not in a position of wanting to create a ~. homeowners association unless it was absolutely necessary. There was concern about the County taking over the maintenance and it would be a passive maintenance; then the homeowners would call upon the City to correct the situation. Mr. Trider asked if the map could be approved subject to the maintenance control where the County will have to establish it, but if not acceptable, a homeowners association would have to be created. Commissioner Hart did not have a problem with that as long as they understood it. Commissioner Bosch said a pre-agreement by the Water District was needed as part of the agreement for them to maintain it or it goes to the homeowners association. Commissioner Scott stated that part of the condition would be that this would be resolved before recordation of the final map. The public hearing was closed. Moved by Commissioner Hart, seconded by Commissioner Scott, that the Planning Commission recommend to the City Council that it approve Tentative Tract 13204 with the added condition that sprinklers are required by the Parks Department and an agreement as to the maintenance of the Planning Commission Minutes November 16, 1987 - Page 4 slope to the toe will be entered into and maintained by the Orange County Water District or a homeowners association, through standards that are acceptable to the City Parks and Recreation Department, as required. AYES: Commissioners Bosch, Greek, Hart, Scott ROES: None ABSENT: Commissioner Master MOTION CARRIED Mr. McGee asked if it were the intention of the Commission that this maintenance plan be returned to the Commission prior to recordation? Commissioner Hart responded if it is acceptable to the Public Works Department, no. IN RE: NEW HEARINGS TENTATIVE TRACT 13098 REVISED, CONDITIONAL USE PERMIT 1626 - EMBERTON DEVELOPMENT CORPORATION: Chairman Greek excused himself from the meeting due to a potential conflict of interest. Proposed subdivision of 10.6 acres on the south side of Walnut Avenue at Santiago Greek to create a residential Planned Unit Development containing 84 residential units. On July 24, 2984 the City Council approved by Resolution of Intent, a zone change to R-3 for this site. NOTE: Negative Declaration 1179 has been prepared for this project. A staff report was not presented. The public hearing was opened. Jack Emberton, 326 West Katella, presented a revised map to be considered for approval. Representatives from the engineering firm were also present. The overhead projector was used for their presentation. Previously, they ran into some problems at the City Council level. They have been identified and the project has been revised as a result. Originally the street was against the west property line; however, in discussing the project with the neighbors, they preferred moving the street and putting the single story homes on the west property line with the back yards back to back. They felt there would be less noise and more security. The new site plan was discussed; the design is that of a planned unit development and is compatible for the neighborhood. Moved by Commissioner Hart, seconded by Commissioner Bosch, that the Planning Commission recommend to the City Council that it accept the findings of the Environmental Review Board to file Negative Declaration 11?9. AYES: Commissioners Bosch, Hart, Scott ROES: None ABSENT: Commissioners Greek, Master MOTION CARRIED li[oved by Commissioner Hart, seconded by Commissioner Bosch, that the Planning Commission recommend to the City Council that it approve Tentative Tract 13098 revised, and Conditional Use Permit 1626 subject to the conditions shown on the staff report. I SB I LL Proposed development of two, two-story residential units in the R-2-6 zone surrounded on three sides by single story development. The property is on the west side of Hewes Street between Washington and Philo Avenues <234 South Hewes Street.) NOTE: This pro3ect is exempt from environmental review. A staf f report was not presented. The public hearing was opened. Paul Waterman, architect on the pro,~ect, stated they are trying to upgrade the area. It would be economically feasible and at the same time provide upgraded housing. Planning Commission Minutes November 16, 198? - Page 6 Commissioner Hart wanted Mr. Vaterman to comment on the idea of no windows on the second floor, from an architect's standpoint. Mr. Waterman stated, in general, he liked to provide windows; however, because of privacy he could understand why the windows were not wanted. The public hearing was closed. Moved by Commissioner Bosch, seconded by Commissioner Scott, that the Planning Commission approve Conditional Use Permit 1632 subject to the conditions in the staff report. AYES: Commissioners Bosch, Greek, Hart, Scott NOES: None ABSENT: Commissioner Master MOTION CARRIED Mr. McGee clarified this action was final unless appealed within 15 days. IN RE: ADJOURNMENT Moved by Commissioner Scott, seconded by Commissioner Bosch, that the Planning Commission adjourn to an adjourned regular meeting Tuesday morning, November 1?, 198?, 8:00 a. m., to meet with City Council to discuss East Orange; it was also moved that the Planning Commission adjourn to an adjourned regular meeting November 30, 198?, at 5:00 p. m. to review the land use policy on the General Plan Update.
