The regular meeting of the City of Orange Planning Commission was
called to order by Chairman Greek at ?:30 p. m.

CONDITIONAL USE PERbIIT 1631 AHD VARIANCE 1825 - CHILDREN'S
HOSPITAL OF ORANGE COUNTY:
Proposed Conditional Use Permit to remove the existing
(HOC hospital building and construct a 5 story medical
office building and a ? story hospital building in the O-P
and P-I zones. A variance is also requested for reduction
in street side setback from 10' to 6'3" on the 5 story
building which is located in the C-3 zone. Sub3ect
property is located on the northeast corner of Blain Street
and LaVeta Avenue. (Continued from the December ?, 198?

Note; Negative Declaration 117? has been prepared for
this project.
The public hearing was opened.
Two questions were asked at the grior meeting and the
Commissioners received memos from the Public Works
--- Department and City Attorney in response.
Bob VonSchimmelman responded to the necessary dedication
in that the proposed alignments of the right of way will
remain where it stands now so there will be no problem.
Gene b[inshew did not feel it was necessary to respond at
this particular time.
Commissioner Bosch stated the purpose of the continuance
was to resolve the issue with regard to the ultimate right

of way location on Main Street. However, the main issue
revolved around the evidence of hardship for the variance
for the 6'3" setback along Providence Avenue. He wanted
to hear from the applicant about the special hardship
condition that would allow consideration for the variance.
David Oakley, 505 Mission Street, So. Pasadena, said there
was nothing further to add than what was discussed before.
There was no undue hardship, but reference was made to the
property across the street that was closer. They would
like to have more space because hospitals are always out
of space .
Commissioner Bosch feels this is a fine institution and
wants to help in any way they can, but is looking for some
basic fulfillment of the requirements of the Ordinance.
Mr. Oakley thought they could live with the ten foot
setback if they could have the building above the second
floor at 6'3"; that would not reduce the primary research
f 1 oors .
Geneva Fulton, 1801 N. Greenleaf Street, Santa Ana, said
the hospital may have a hardship with a few feet, but does
not believe it should be taken from her property. The
west side of Main Street should not be penalized.
The public hearing was closed.
Moved by Commissioner Hart, seconded by Commissioner
Bosch, that the Planning Commission recommend to the City
Council that it accept the findings of the Environmental
Review Board to file Negative Declaration 11??.

Moved by Commissioner Bosch, seconded by Commissioner
Scott, that the Planning Commission approve Gonditional
Use Permit 1631.

Commissioner Bosch had a problem with making a
3ustification for the hardship for the reduction of the
setback along Providence. He gave the applicant an
example of how the building could be built without using a
variance,
Moved by Commissioner Bosch, seconded by Commissioner
Hart, that the Planning Commission deny Variance 1825.

Mr. McGee stated this action was final unless appealed
within 15 days to the City Council.

IH RE: HEW HEARINGS
`'~~ COHDITIORAL USE PERMIT 1636 - LA VETA LTD.:
Proposed Conditional Use Permit to allow the development
of a skilled nursing care convalescent facility in the C-1
zone, and approval of a subdivision of property whereby a
lot is created without direct access to a public street.
Subject property is a 3.7 acre parcel located on the south
side of LaVeta Avenue between Main Street and the access
ramp to the Garden Grove Freeway, addressed 1000 LaVeta
Avenue.
Note: Negative Declaration 1182 has been prepared for
this project.
A staff report was not presented.
The public hearing was opened.
Keenan Girisqen, 22471 Aspan, Suite 101, E1 Toro, stated
the Planning staff was concerned about three issues. One
was the deficiency of the parking during the construction
stages. They have made some surveys and their findings
were during different hours of the day throughout the
week. Maximum required parking spaces were 248, which
included approximately ten percent of the motorists from
Centrum on the west of the proposed project. They could
comply with all the parking requirements during
construction. Also, by hiring parking attendants they
could meet the requirements.
Chairman Greek would like to know from the applicant why
they should approve the Conditional Use Permit?
Mr. Girisqen does not believe there is a zoning problem
for the development of the convalescent hospital. It does
comply with the zoning.
Leonard Lebowitz, La Veta Ltd., 1888 Century Park East,
Suite 300, Los Angeles, said that due to the high cost of
medical care, many patients are faced with a problem that
they can't afford to stay in hospitals. They are offering
® a skilled nursing care facility with reduced rates that
will be working in conjunction with the local hospitals
and has the support of the doctors.
Commissioner Bosch commented that this would be a
compatible use in that it's proximity to both medical
offices and to the local hospitals would afford a greater
level of care than if the facility were located remote
from the medical center.
Another issue involved was the request to split a piece of
property for some investment reason that does not

necessarily relate to the use nor the availability of
,,,~.., ~ excess land, but yet they are asking for something unusual
for that part of town. Commissioner Bosch asked the
reason for the property split?
1+[r-. Lebowitz stated the basic ownership of the structure
itself will be by the same group that owns and operates
the medical building. They will have a skilled operator,
who has been working with St. Joseph, to give them an
incentive so they need to split that piece of land.
Chairman Greek asked if they had read the staff report and
referred to Page 6, Item 24.
Commissioner Hart asked if they have explored the
possibility of a long-term ground lease to the building?
The applicants had a problem with that because it was
basically a single use type structure. Aground lease
would be complicated to do.
Commissioner Ir(aster asked how they were going to
accommodate the parking for the existing medical complex?
The applicant stated they would provide valet parking at
their own expense and also work out taking spaces in the
Centrum parking tower. They have discussed this with
Centrum.
Commissioner Bosch was concerned about the lack of
evidence of their agreement regarding the parking issue.
Mr. Lebowitz said Centrum has signed an agreement
regarding the parking and I~Ix-. 1[inshew has seen it.
However, Centrum does not want a blanket easement on the
property. Concerns from Fire and Police about the
reciprocal parking issue have been worked out.
The public hearing was closed.
Commissioner Bosch appreciates the centralization of
health care and thinks there is good support for this kind
of use. He has ma3or concerns though with how the site
plan will work. He is concerned with the long-term
aspects for access and parking at the medical building
than with the short-term construction phase. He will
insist upon approval that prior to any permits being
issued of a temporary parking plan. The use is
appropriate, but the way the use is arranged on the site
.seems to give great difficultly in terms of accessibility
for the medical building.
Chairman Greek would like to allow the applicant a couple
of weeks to look at the pro3ect again and resubmit it for
consideration.

( Scott, that the Planning Commission postpone this item to
`~• the January 18, 1988 public hearing for the applicants to
review the staff report and come up with reasons for
approval. They are to also review the Tentative Tract Map
because of the problem of splitting the parcel into two
properties.

CONDITIONAL USE PERMIT 1639 - FIILL SPECTRUM COMM(THICATIOH:
Proposed Conditional IIse Permit to allow the erection of a
120 foot microwave communication tower in the M-2 zone on
property located at the southwest corner of Taft Avenue
and Batavia Street, addressed 810 West Taft Avenue.
Note: Negative Declaration 1186 has been prepared for
this project.

The public hearing was opened.
Mark Voss, 8484 Wilshire Blvd., Beverly Hills, spoke about
the microwave tower and its being erected for the use of a
mayor communication center between the three facilities --
Santa Ana, Anaheim and their new corporate offices which
will be occupied in February at the Taft location. The
120' tower is required to provide a direct line of
communication with the two other facilities. The FCC
permit has been requested and applied for in compliance
with their regulations. As far as compliance with the
Uniformed Building Code, the tower has been designed by a
civil engineer and complies with wind structural design.
The tower is placed behind the building and cannot be seen
from Taft Avenue. The tower can be seen from Main Street.
Directly behind that are mayor power lines so the tower
does not significantly impact the beauty of the site.
Commissioner Scott asked about the height of the Edison
towers to which Mr. Voss responded, 180 feet.
For the record the exact location of the tower would be in
the southeast corner.
Chairman Greek asked about the distance of the tower from
the building?
Mr. Voss responded the tower would be 150 yards from the
front of the building; 50 yards from the back of the
building.

Commissioner Scott asked about the required parking and
f.~,,, ~ the applicant responded that the parking lot would not be
altered in any way.
The public hearing was closed.
Moved by Commissioner Scott, seconded by Commissioner
Bosch, that the Planning Comaission recommend to the City
Council to accept the findings of the Bnvironmental Review
Board to file Aegative Declaration 1186.

Master, that the Planning Commission approve Conditional
IIse Permit 1639 subject to the conditions so listed,
adding that the tower location will be on the southeast
corner of subject property.

ORDINANCE AMEADMEAT 5-87 - CITY OF ORA$GE:
Proposed amendment to Chapter 17.44 of the Orange
Municipal Code, modifying the lists of permitted uses and
conditionally permitted uses within the C-2 zoned areas of
the City.
Aote: Aegative Declaration 1190 has been prepared for
this project.
Mr. McGee said the basic intent of the Ordinance is to
implement what is currently existing as an urgency
Ordinance addressing permitted uses within the C-2 zone,
auto related and other heavier commercial uses that were
previously permitted outright. The Ordinance would
require a Conditional IIse Permit for those uses when they
are on parcels directly adjacent to residential
properties.
The public hearing was opened and then closed as there was
no discussion.

Scott, that the Planning Commission recommend to the City
Council that it accept the findings of the Environmental
Review Board to file 1legative Declaration 1190.

REQUEST FOR EXTENSION OF TIME - CHAPMAN COLLEGE:
Conditional Use Permit 1463 was approved for Chapman
College to allow two temporary trailers for a two year
period. The College now requests a two year extension as
the initial two year approval period has expired.
Commissioner Scott asked staff if the original conditions
of approval were still in effect and if the College were
adhering to those conditions?
Mr. McGee responded in the affirmative to both questions.
Chairman Greek asked about the status of the master plan
for Chapman College.

The plan is for the entire campus including some areas
they do not currently own for ultimate growth of the
campus.
Moved by Commissioner Scott, seconded by Commissioner
Bosch, that the Planning Commission grant a two year
extension on original Conditional Use Permit 1463.

Proposed five lot industrial subdivision including
acres on the north side of Taft Avenue, west of Glassell
Street.
A copy of the tentative map and a copy of the proposed
site plan indicating building locations is posted on the
wall for review.
Chairman Greek asked Mr. Thompson if there were any
problems with the project as it relates to redevelopment.
