PLANNING COMMISSION MINUTES

Moved by Commissioner Bosch, seconded by Commissioner
Master, that the Planning Commission approve the
Minutes of November 21,-1988 as recorded.

IN RE: ITEMS TO BE CONTINUED
1. Conditional Use Permit 1695-88 - Chapman College -
requests a 30 day continuance.
Moved by Commissioner Master, seconded by
Commissioner Bosch, that the Planning Commission
continue Conditional Use Permit 1695-$8 to January
4, 1989.
AYES: Commissioners Bosch, Greek, Hart, Master,

NOES: None MOTION CARRIED
2. Conditional Use Permit 1721-88 - I.D.M. - request
did not specify a length of time. Staff is
working with the City of Anaheim trying to resolve
some conflicts between the two cities and would
feel comfortable with a 30 day continuance.
Moved by Commissioner Master, seconded by
Commissioner Bosch, that the Planning Commission
continue Conditional Use Permit 1721-88 to January
4, 1989.

IN RE: NEW HEARINGS
CONDITIONAL USE PERMIT 1710-88 - DELTA FINANCIAL &
INVESTMENT, INC.:
A proposed Conditional Use Permit to convert an
existing office building to a motel and a Conditional
Use Permit to allow a motel use in the C-1 zone.
Section 17.42.040-K of the Orange Municipal Code
requires a Conditional Use Permit for a motel use in
the commercial zones.
NOTE: Negative Declaration 1250 has been prepared for
this project.
There being no opposition, a staff report was not
presented and the public hearing was opened.
Proponent:
Andy Duong, 9211 Bolsa Avenue #219, Westminster,
explained why he wished to convert the existing office
building into a motel.
Commissioner Bosch noted the Environmental Review Board
had three major concerns about the project: (1)
service vehicles would not be able to enter or leave
because of the low vertical clearance into the existing
parking garage beneath the building; (2) a major
increase in traffic; and (3) the lack of visibility for
that onto Chapman Avenue. He did not notice any
mitigation measures from the applicant and wanted to
know if these concerns would be addressed.
Mr. Duong responded those concerns have been mitigated
and would agree for access to be made available,
although a written agreement from the car wash has not
been obtained.
Chairman Scott said the Traffic Division stipulated
that there would be "right turns only" in and out from
the site. Would this be a problem if converted to a
motel?
Mr. Duong realizes this is a problem.
The public hearing was closed.
Chairman Scott asked if the room size meets code
® requirements?

Mr. Godlewski stated the only code requirements would
be for unit size -- a full living type unit. This is
just a motel room; there are no limitations.
Commissioner Greek thought if the architect had more
information, it should be postponed until he was
available to make a presentation. Based on the
information available and the problems with the site,
he did not feel it was a proper use for the site. A
need for a motel in the area is not warranted.
Moved by Commissioner Greek, seconded by Commissioner
Master, that the Planning Commission deny Conditional
Use Permit 1710-88.

Commissioner Bosch gave the applicant their reasons for
denial. They have studied at some length the motels in
the various portions of the City (particularly East
Chapman Avenue). The positive measures they saw on
other difficult applications of difficult sites are not
even present on this one. The site is over-built as an
office building. He believed if the Conditional Use
Permit were approved, it would cause deterioration of
the immediate vicinity and have a substandard project.
Mr. Godlewski pointed out there is a right of appeal if
the applicant wished to appeal the Commission's
decision to the City Council.
IN RE: MISCELLANEOUS
Request by the City of Orange Water Department to have
certified a Negative Declaration for the construction
of a water reservoir located on Lot "A" of Tract 12082.
Commissioner Greek said at previous meetings of the
East Orange Steering Committee the City Council
commented they preferred not to see exposed tanks built
in the future. The proposed tank looks like it will be
some twenty feet above the houses. He preferred to
postpone the request in order to meet with Public Works
to discuss it in further detail. Also, in approving
the Negative Declaration, the Commission needs to make
certain there are no seismic faults in the area.
Information verifying there are no faults through the
particular site is requested.
Commissioner Hart wanted someone to answer Item 18.

Chairman Scott suggested their representative to the
Planning Commission meet and clarify said information
back to them.
Moved by Commissioner Greek, seconded by Commissioner
Bosch, that the Planning Commission continue this item
for 30 days to obtain the necessary information before
a decision is made.

IN RE: ADJOURNMENT
It was moved to adjourn to Thursday, December 8, 1988
at B:OO a.m. for a joint meeting with the City Council
for the purpose of receiving the proposed General Plan
Amendments and a briefing on same; then adjourn to the
next regular meeting December 19, 1988 at 6:30 p.m. for
a study session; public hearing at 7:00 p.m.
The meeting adjourned at 7:27 p.m.
