NOTE: Negative Declaration 1196 has been prepared for this project. (Continued from the January 4, 1988 Planning Commission Meeting.) He felt uncomfortable making a decision without any ri' background and suggested postponing the item until February 1?, 1988. The applicant concurred with the suggestion. Commissioner Greek suggested the applicant attend their study session on the 8th. Mr. McGee stated a specific time could be stated on the agenda to discuss temporary standards. Moved by Commissioner Hart, seconded by Commissioner Master, that the Planning Commission delay action on this item to the February 17, 1988 meeting, and invite Chapman College to meet with them on February 8 at 6:00 p. m. (study session on parking standards). AYES: Commissioners Bosch, Greek, Hart, Master, Scott ROES: Rone MOTIOA CARRIED Jim Sinsimer, Vice President of Tishman West, Los Angeles, manager of The City Mall, said they were in the process of developing another temporary lot similar to Chapman College. He asked if this study could be expedited and a solution to the problem be arrived at so they could continue with their project. They have been delayed for about four weeks. John Cassidy, 5608 Soto Street, Huntington Park, desires to lease the sub3ect property. There will be no detrimental effect on the area. Commissioner Bosch wanted to know the time frame for the future two silos. Mr. Cassidy stated this was a new venture and it was hard to pin point a date. Commissioner Hart asked if the mixing process would be confined, Mr. Cassidy stated it would be. They are required to be permitted by the South Coast Air Quality Management District. The public hearing was closed. C. zone in IIpper Peter's Canyon located on approximately 230 acres situated south of Chapman Avenue and Santiago Canyon Road, east of Rewport Boulevard and north of Peter's Canyon Reservoir. ROTE: Regative Declaration 1199 has been prepared for this project. Commissioner Bosch excused himself from the meeting due to a conf 1 ict of interest. The public hearing was opened. Joan Volff presented the staff report and summarized what was being proposed. The proposed ordinance amendment contains modifications to the High Density Residential Development Standards contained within the Upper Peter's Canyon Specific Plan. The changes in the Specific Plan are needed prior to any site plan review of the High Density planning areas. The proposed changes being requested at this time relate primarily to the setback requirements. The way the plan is written now, it has been discovered, that some of the High Density Standards are more restrictive than some of the Medium Density Standards. The specific changes that are proposed include distinguishing between private streets and private drives and decreasing the setbacks required adjacent to private drives from ten feet down to three feet. Another proposed change has to do with establishing alternative setbacks for garages and carports that are adjacent to common private drives in order to assure that cars parked in driveways do not overhang into the common drive areas. The third change that is included has to do with setting provisions for projections into setback areas. The public hearing was closed. AYES: Commissioners Greek, Hart, Master, Scott HOES: Hone ABSENT: Commissioner Bosch MOTION CARRIED IN RE: HEW HEARINGS TENTATIVE TRACT MAP 13346-88 - STANDARD PACIFIC OF ORANGE COUNTY: Proposal to subdivide an existing lot into 96 lots for a single family residential development located at the northeast corner of Newport Boulevard and i~Thite Oak Ridge Road, adjacent to the south side of the Santiago Hills residential development. NOTE: Negative Declaration 1198 has been prepared for this project. Commissioner Bosch excused himself due to a potential conf 1 ict of interest. A staff report was not presented. The public hearing was opened and then closed because the applicant was not present. Commissioner Greek asked if the street standards were different from other standards. Gary Johnson said the hill side standards were not different from other standards out there. Commissioner Greek asked about the fencing in the tract boundaries tCondition #5). Mr. Johnson said it pertains to the requirement that originally the Irvine Company had shown the fencing to be within the street right-of-way or green belt area; the City did not want fencing to be a part of the maintenance responsibility. Therefore, it is clarified as inside the tract boundaries. Commissioner Greek inquired about the lighted addresses. Mr. Johnson stated it was a code requirement by the Police and Fire Departments that each address be lighted. U Planning Commission Minutes February 1, 1988 - Page 6 Commissioner Hart thought there was a problem with Condition #12 and asked if it were staff's recommendation that it be eliminated? Mr. McGee did not have a problem with adding a statement to that condition that if there are other means of providing the school district fees, that they would suffice in this instance. Commissioner Greek asked Mr. Johnson if there was a problem with the anticipated construction of the Jamboree Road because of the thousand unit occupancy number. Will the road by needed prior to the thousand houses being occupied? Mr. Johnson thought it would definitely take some of the pressure off of Chapman Avenue to have that road in advance of the development of the thousand units, but to say it is absolutely essential, it is hard to say. The public hearing was re-opened for input by the applicant, who 3ust arrived. Bob Shioto, Standard Pacific, 1565 West MacArthur, Costa Mesa, was concerned with Condition #21. There is a grade differential of 15 feet and 6 feet and it is broken by the extension of Mulberry Street. It is their feeling that it is in the best interest of the project to treat both sides of the slope the same in terms of having it maintained by a common entity such as the maintenance district. In both cases there is a drainage ditch at the bottom and handles the drainage between the two projects. It is conveyed to Mulberry Street and it is important to them to have the slope maintained in a quality fashion to keep the drainage device clear of any obstructions. Chairman Scott questioned Mr. Johnson on staff's position on the maintenance. Mr. Johnson replied their position is that in the past they have asked slopes of this height be maintained by a homeowner's association. They have embarked in the area with a policy of allowing a maintenance district to be established and that appears to be the way the Irvine Company will be going from the standpoint of maintaining common slopes. The City's thought was that areas to be maintained by the district should have benefit to the entire area that is paying fees; not to dust maybe adjacent properties. The City does not want to be forced in the future to take over this type of maintenance. • Planning Commission Minutes February 1, 1988 - Page ? ` Commissioner Greek liked staff's policy. The problem he ~+' sees with this particular development is the fact that the downhill slope belongs to the uphill house and there is no way it will be taken care of. A better solution needs to be sought. The maintenance district should not have to maintain someone's backyard. The public hearing was closed. Commissioner Hart asked what the suggested solution would be to the downhill maintenance by the uphill owner. Commissioner Greek suggested moving the property line. Mr. Johnson thought it was feasible, but may not be practical. Commissioner Hart stated if the grading plan were elevated, there would not be a problem, and Mr. Johnson agreed. 1rloved by Commissioner Greek, seconded by Commissioner Hart, that the Planning Commission recommend to the City Council that it accept the findings of the Environmental Review Board to file Negative Declaration 1198. AYES: Commissioners Greek, ROES: Hone ABSENT: Commissioner Bosch Hart, Master, Scott I~LOT I OH CARRIED Commissioner Greek stated the tentative tract presents severe problems and he did not like the solutions. He suggested giving the applicant one month to come up with a better solution. He preferred a separate maintenance agreement. There was a motion by Commissioner Greek to postpone this item for 30 days, but there was no second. Scott Stowell, Pro3ect Manager, Standard Pacific, said there were no other alternatives available to them. They would like approval of the tentative map as is. Commissioner Hart asked if there was a way to condition an approval? Commissioner Greek stated the slopes were created by the grading operation. Chairman Scott understood the applicant's position of needing action at this meeting. . IH RE: COUNCIL REFERRED ITEMS G GENERAL PLAN AI~LfiNDMENT 4-87TA, ZONE CHANGE 1080 AND CONDITIONAL USE PERMIT 1625 - MOHLER CORPORATION: This is a referral from the Gity Council to the Planning Commission. This application was heard by the Flanning Commission in December, 198?. The Council heard this item last week. In the interim between the Commission's review and recommended approval on most of the project and denial on the Conditional Use Permit, and the Council's public hearing, there was an amendment made to the plan. The basic revisions are removal of the two second floor units on the east end of the project, which brings the height of the project into conformance with the zoning development standards for the requested R-3 zone. Additionally, security fencing and gates have been added to that plan. The Council referred it back to the Commission based primarily upon the change to the plan in the interim and has asked for a report from the Commission to be received by the Council at their next meeting. Commissioner Hart commented they were back to approving a precise plan and that is not what the Commission is suppose to be doing. What was Council's reaction to the zone change? Mr. McGee stated the Council has not acted on any part of this application as yet. Jim Mohler, 874 North Batavia, I+tohler Corporation, informed the Commission of the changes that were made. They have met with the neighbors and have revised the site plan at Whitecap and Orange-Olive. He feels the neighbors are happy with the revisions. Commissioner Hart re-iterated the site plan was not the issue. His ideas have not changed; he feels it is a proper zone for the area. ' ~ Planning Commission Iriinutes February 1, 1988 - Page 9 Those speaking in opposition: Terry DePaola, ?36 East Whitecap, said she did like the new plans better, but the residents still have concern with two things they think the apartments may worsen and she believes that is why the City Council sent it back to the Commission: C1) parking, which is already congested because of the bar across the street; and C2) traffic on Orange-Olive Road, which already backs up down past Whitecap, making it difficult to get in or out at 8:00 a. m. and 5:00 p. m. Commissioner Hart stated had it been developed according to the zone, there would still be as much traffic. l~rs. DePaola said if it were developed as commercial, traffic would be dispersed throughout the day rather than people coming home at 5:00 p. m. or going to work at 8:00 a . m. Chairman Scott asked for the parking ratio requirement. Mr. RcGee stated for a two bedroom unit, it was 1.8 per unit plus .2 guest parking or two spaces per unit. Commissioner Greek asked if anything were being done to relieve the traffic on Orange-Olive? Mr. Johnson said Orange-Olive was a secondary highway. It has been developed to secondary standards. The road has as much capacity now as it will ever have. Commissioner Greek asked the reason for all the congestion? Mr. Johnson stated most people perceive Orange-Olive as being a residentially oriented road. The peak hour traffic is much more bunched than other streets in the area. Maybe by striping the area for left turn pockets, this will solve some of the problems. In conjunction with the maintenance project this summer, this area may be changed in the striping patterns. I4r. IrlcGee added that when the Council took action requesting a report from the Commission, they also requested a report from the Traffic Engineer regarding Orange-Olive Road and it's current status. Iir-s. DePaola described the traffic problem at Orange-Olive and Lincoln. Planning Commission Iriinutes February 1, 1988 - Page 10 Commissioner Greek thought there was an abnormal left hand turn movement at that intersection. Commissioner Hart thought the complaint was valid; however, the project should not be punished for the problem. Conditions need to be made. foved by Commissioner Greek, seconded by Commissioner Hart, that the Planning Commission direct a report to the City Council stating their report is based on the observations and review of the plans, and that the zoning is still reasonable. Based on the public's input, there is a problem with the traffic movement on Orange-Olive and they recommend the maintenance pro3ect that is planned for the summer of 1988 include re-analysis of the turning movements on the traffic signal at Lincoln Avenue to allow for controlled left-hand turns and a longer stacking lane for left turn movements. Commissioner Bosch concurs on the general recommendation. He would like to see the Traffic Division look at what the dynamics of the intersection are. AYES: Commissioners Bosch, Greek, Hart, faster, Scott HOES: Hone NOTION CARRIED IH RE: COUNCIL REFERRED ITEfS GENERAL PLAN AIKENDMBNT 4-87-B, ZONE CHARGE 1081 AHD CONDITIONAL USE PERM[ I T 1626 - IrIOHLER CORPORATION: The Commission recommended denial of Conditional Use Permit for any second story construction on this particular proposal. That Conditional Use Permit is still required for the project as built. The applicant has made some revision to the site plan, which includes providing some additional landscaping on the east edge of the property, some additional height to fencing on the parcel, but the two-story height is still there. The Commission may want to look at its recommendation on the Conditional Use Permit. Commissioner Hart asked if the denial was based on the setback? fr. McGee stated the code requirement that requires the Conditional IIse Permit is the restriction of the two-story development within 70 feet of a single family residential zone. Lost all of this parcel is covered by that ?0 foot restriction. The Council is asking for a report on this proposal. • Planning Commission Minutes February 1, 1988 - Page 11 Commissioner Bosch thought they recommended approval of the basic issue of the zoning to a higher density of residential and it is true there are restrictions on the site in addition to that that would perhaps limit that density to less than the maximum allowed under the zone recommended. The ?0 foot setback is intended to help the single family residences and in absence of strong support from the residences to the contrary, he still feels the action made last time is appropriate. Bob Colin, JFP and Associates, working with Mohler Corporation, stated that since the first Planning Commission Meeting, they have taken the time to revise the plan. They have met with the neighbors of that area. They have gotten approval from their neighbors to the south, north and east of them. He asked the Commission to reconsider their denial of the Conditional Use Permit and grant them approval. Mr. McGee stated the Commission was being asked to report back to the Council. If the circumstances have changed, it could be stated in the report. Mr. Minshew said the Commission could report the way they wanted to. The matter is before the City Council; they will take final action. Commissioner Hart stated the one problem he has is that the applicant is telling them the neighbors say it is ok, but he doesn't hear any of the neighbors saying it is ok. John Cevas, 2570 Horth Delta, has a basic understanding that if the zoning and the general plan amendment are denied, someone else is going to come in with another request. If it is approved, then they don't know how dense it will be. With the changes Mr. Colin has made, everyone was content. He personally feels something is going in there as the land is too valuable to be vacant. The site plan changes are acceptable. Commissioner Basch appreciates what the neighbors are saying. He said it was a very tough piece of property to develop. He feels he must stand with his previous recommendation. ® Moved by Commissioner Bosch, seconded by Commissioner Hart, that the Planning Commission report to the City Council that their previous recommendation with regard to the denial of the Conditional Use Permit stands. 0 e Planning Commission Minutes February 1, 1988 - Page 12 Commissioner Greek thought the report should indicate that the plan has been revised from the first plan; that the adjacent neighbors are no longer opposed to it. Commissioner Bosch amended his motion to include Commissioner Greek's statement. I H RE : ADJ OURHMEHT ~J lsld Moved by Commissioner Bosch, seconded by Commissioner Scott, that the Planning Commission adjourn to a February 8, 1988, 5:00 p. m. study session in the Weimer Room to review the Rancho Santiago Master Plan presentation and at 6:00 to review the Police and Fire input for the overall issue of temporary parking lots and facilities; and further, to ad3ourn to a 3oint session with the City Council and Design Review Board on February 9, at 8:00 a. m. in the Weimer Room for a study session to review the sign code review draft ordinance; and note that the next regular meeting will be Wednesday, February 17, 1988 at ?: 00 p. m. , with a 6:30 administrative session.
