The regular meeting of the City of Orange Planning Commission
was called to order by Chairman Greek at 7:30 p. m.

Combining District) on property located on the north
side of Almond Avenue between Shaffer Street and
Harwood Street, addressed 60? E. Almond.
NOTE: This project is exempt from environmental
review.
Mr. McGee presented the staff report. The site plan
for this proposal is attached to the wall for exhibit
and indicates there is an existing residence on the
property along with a carport, which will be removed
and replaced by a second dwelling unit over three
garage spaces. The unit to be added is 1,040 square
feet in size and will contain two bedrooms and two
baths. In addition to that unit, on the first floor
there is a 300 square foot game room fully detached
from the unit upstairs. It does have a bath in the
game room area.
The public hearing was opened.
Edward Thomas, 23981 Raleigh, E1 Toro, applicant and
owner of this property wants to build a second unit for
extra income. They want to build the unit so it will
blend in with the neighborhood. Because there is not
much yard space, they thought a game room would be nice
for the tenants.
Commissioner Hart voiced concern about the recreation
room being modified for a separate apartment. The
proposed bathroom is unusually oversized with nothing
on one end of it, which could accommodate a bathtub.
He suggested changing the floor plan so it doesn't look
suspicious of becoming another apartment.
Mr. McGee stated the plan could be modified to show a
smaller square footage in the bathroom or some other
alternative similar to that.
Those speaking in favor of this application:
Nicky Calagna, 1135 E. Culver, favors this project
because it is consistent with the adopted intent of the
RCD overlay zone, is in conformance with the zoning,
there is enough area for the 3,000 square foot pads
requirement, and it has adequate parking. It is also
in conformance with the adopted Housing Element and is
also consistent with the Historic Preservation Element.

property was not to preclude a second unit or a two
story unit. It was meant so there would be public
hearings and for the Planning Commission to put into
place mitigating measures to make sure there was ample
parking and other amenities to make sure there was no
adverse impact on the community. The RCD overlay was
not a down zoning. The intent of the RCD is a smooth
transition into a higher use. Other places that have
been approved are as follows:
Livingstone property, 316 S. Grand, granted a
Conditional Use Permit and Variance on November 4, 1985
for a two story unit;
James Jonaitis, 461 S. Grand, received a Conditional
Use Permit for a two story unit, August, 1985;
Charles and Mary Haupt, 314 E. Palmyra, received a
Conditional Use Permit for a second story unit, January
6, 1986.
Joel Cantree, 352 S. Center, received a Conditional Use
Permit for a second story unit in June, 1984.
Mr. Wagnew, 335 S. Grand, Conditional Use Permit for a
two story second unit, November 18, 1985.
If this project is not approved, she thinks there might
be a possibility in the future of a lawsuit towards the
City Council, and anyone connected with it, that would
deny a property owner the same rights that are enjoyed
by other people in the surrounding area.
Charley Miles, 1330 Dana Place, thinks this project is
a very good idea. There is a shortage of rental units
and anytime a request like this is zoned properly and
the owner abides by the terms of the City, it should be
granted.
Betty Murrill, 10?41 Crawford Canyon Road, received a
variance for her second story unit in 1980 located at
601 and 603 E. Almond. She is concerned with the game
room becoming an additional rental in the future.
Those speaking in opposition:

Helen Thayer, 100 block S. Harwood, has lived in Orange
since 1922 and the changes she has seen has not been
for the good. She is concerned about the traffic on
Almond. She does not approve of the two story
buildings in this neighborhood.

Mr. Thomas stated he will be removing four cars off the
street by building this unit. The siding will match
the one in front, which will blend in with the
neighborhood.
The public hearing was closed.
Moved by Commissioner Hart to approve Conditional Use
Permit 1574 subject to the conditions shown on the
staff report #1-8; and add to Condition #2 ...and plans
shall be adjusted to eliminate possibility of adding a
bath tub/shower.
The motion died for a lack of a second.
Moved by Commissioner Bosch, seconded by Commissioner
Master, that the Planning Commission deny Conditional
Use Permit 1574.

Mr. McGee stated this decision can be appealed to the
City Council. There is a 15 day appeal period.
IN RE: NEW HEARINGS
CONDITIONAL USE PERMIT 1575 - BATAVIA/ANGUS ASSOCIATES:
Proposed office/retail use within the M-2 <Industrial~
zone, located on a 6.17 acre parcel on the east side of
Batavia Street, south of Angus Avenue.
NOTE: Negative Declaration 1130 has been prepared for
this project.
The staff report was not presented.
The public hearing was opened.
Ron Wilson, Architects Orange, 144 N. Orange Street, is
the architect for the project and agrees with the
findings of the staff report.
Commissioner Bosch questioned if the revised parking
access will be conformed to City Ordinance for a two
way drive access.

Mr. Wilson stated they will conform with this.
The public hearing was closed.
Moved by Commissioner Master, seconded by Commmissioner
Hart, that the Planning Commission accept the findings
of the Environmental Review Board and file Negative
Declaration 1130.

Hart, that the Planning Commission approve Conditional
Use Permit 1575 with the five conditions as stated by
staff .

IN RE: MISCELLANEOUS
REFERRAL FROM CITY COUNCIL:
Request for review and report to City Council on
Residential Survey Clot by lot> of Old Towne Area.
Mr. McGee stated the Council made a motion for a
specific review of the documentation available
regarding the lot by lot survey and asking your
recommendation on whether that meets the intent of the
current request for survey.
Mr. Thompson anticipated doing a very small pilot
survey and graphically illustrate how that survey might
be of benefit in providing more comprehensive reports
to the Planning Commission and City Council. Staff
requests this be deferred and brought back to show the
Planning Commission examples of this survey.
Chairman Greek explained the City Council wants the
Planning Commission to review the documentation that is
available, along with the request on a lot by lot
survey; then offer the Council a recommendation whether
or not the existing documentation accomplishes what is
intended by the lot by lot survey.
Mr. Thompson stated there has been considerable
progress made in Old Towne in improving it, but we have
no benchmark. This survey is to update our data base

only. It is not the intent to physically go
door-to-door. If this survey is done in-house, it will
have a .lesser priority. If a consultant is used, it
would cost approximately $7,000 to X9,000.
Commissioners Hart and Greek feel this study would be
an intrusion of privacy as they encountered bad
experiences in a similar situation in another city.
Mr. Thompson reassured the Commission criteria would be
established before this study was undertaken.
Commissioner Bosch feels this is a rational approach
and wanted to know how long it would take before coming
back to the Commission with a pilot program.
Mr. Thompson estimates approximately 30 days.
Nicky Calagna has some information to submit for this
study. She has four surveys done by the City and her
data is to be coordinated with Mr. Thompson's.
Moved by Commissioner Hart, seconded by Commissioner
Bosch that the Planning Commission ask Mr. Thompson to
come back to them with his ideas of what a survey would
consist of, and collect what available data we have to
determine whether any additional data is necessary.

Moved by Commissioner Hart, seconded by Commissioner
Master, that the Planning Commission adjourn to a point
study session with City Council on Monday, March 23,
1987, at 4:00 p. m. in Conference Room "C" . Planning
Commission's next regular meeting will be Monday, April
6, 198?.
