Wheeler, Recording Secretary. PLEDGE OF ALLEGIANCE IN RE: MINUTES OF APRIL 15, 1985 Moved by Hart, seconded by Commissioner Mason, that the minutes of April 15, 1985, be approved as recorded. AYES: Commissioners Master, Hart, Mason, Scott NOES: None ABSENT: Commissioner Greek MOTION CARRIED IN RE: NEW HEARINGS CONDITIONAL USE PERMIT 1408 - INTERSTATE CONSOLIDATED Proposed expansion of a retail center utilizing greater than 40% compact parking spaces on 3.9 acres at the southeast corner of Tustin Street and Katel7a Avenue. (Continued from April 1, 1985, Planning Commission Meeting) NOTE: Negative Declaration 968 has been prepared for this project. Mr. Lane said this Conditional Use Permit has been withdrawn since the April 7 meeting because the applicant has revised its plan to ® the point where the Conditional Use Permit is no longer necessary; however, Planning Commission approval is still required in relation to the 1.6% reduction in the required number of off=street parking spaces since there will now be four stalls less than what is required, as a result of reducing the number of compact stalls and increasing the number of standard stalls. Chairman Master opened the public hearing. Carol Hoffman, repre- senting the applicant, said Commissioner Greek`s suggestion to redesign the parking area was taken, resulting in coming as close as lacking only four parking spaces of the required amount. She said that since there is a provision that the Planning Commission could grant up to a 15% reduction in required spaces and they are Planning Commission Minutes April 15, 1985 Page Two asking for only a 2% reduction, they hope for approval. Chairman Master declared the public hearing closed. Mr. Johnson said approval of the number of stalls can be granted without conditions but the question of dedication of the right-of- way, which was requested by Staff, still has to be reckoned with. He said there was a discussion between Bernie Dennis and the appli- cant on the dedication, and suggested that such discussion continue after action is taken on the Conditional Use Permit because the right-of-way is needed for upgrading the intersection and is an integral part of the development. He said the City Council may have to make the decision regarding the right-of-way as it will probably be appealed to the City Council by the applicant or referred to it by Staff. Moved by Commissioner Hart, seconded by Commissioner Mason, that the Planning Commission a"llow the 1.6% deficiency in required parking spaces in the integrated commercial center at the south- east corner of Tustin Street and Kate1la Avenue, AYES:. Commissioners Master, Hart, Mason,~~Scott NOES: None ABSENT: Commissioner Greek MOTION CARRIED IN RE: NEW HEARINGS CONDITIONAL USE PERMIT 1412 - SMITH Proposed three story mini-warenouse facility in the C-7 Zone on 2.1 acres at the northwest corner of Chapman Avenue and Wayfie`Jd Street. Continued from the April 1, 1985, Planning Commission meeting) NOTE: Negative Declaration 970 has been prepared for this project. Mr,. Lane made the presentation in accordance with the Staff Report, sand said Staff -recommends approval subject to the 18 conditions in i'~s report,"one additional condition in a memo sent by Staff to the Planning Commission and eight conditions requested by the Fire De- partment, for a total of 27 conditions. He pointed out that this Conditional Use Permit must have City Council approval. Commi sinner Hart referred to Condition No. 4, which states that the residence of the on-site manager shall not be occupied by children under the age of l6, and asked if this wasn`t unconstitu~ tional, Mr. Minshew said he feels this is not an unreasonable restriction and the unconstitutionality of prohibiting children would probably not apply in this case. He suggested leaving the condition and if it turns. out to be unconstitutional then it could not be enforced, He pointed-out that in a true apartment such a restriction would be illegal, but this is not a true apartment and prohibition of children under 16 could be one of the terms of employment of a caretaker. Planning Commission Minutes April 15, 1985 Page Three Commissioner Hart asked if there is a parking code for warehouses and, if not, what rule of thumb applies. Mr. Lane responded that Staff checked with a number of cities in the County and each is doing something different. He said there is no standard; however, surveys performed in relation to specific proposals indicate that the demand for off-street parking is very minimal .and, in fact, not having it is a deterrent to on-site activities other than just stopping long enough to put something in storage or remove it. Chairman Master opened the public hearing. Mark Murphy, 2750 South Harbor, Suite I, Santa Ana, architect for the applicant, R. A. Smith, 662 Ranchwood Trail, Orange, discussion the on•-site ,parking. He said when he prepared the latest revision he had reviewed the Fire Department conditions and consequently excluded the parking spaces which would have been in front of the units on the ground floor. He said the 31 parking spaces include only the two garage spaces, the perpendicular spaces in the southeast corner of the site, the parking spices an the second floor ramp and the 90° parking on the second floor. He said the plan still includes the area where people might stop to put something in or remove something from their unit, which is in question and-will have to be worked out with the Fire Department on how it should be posted, and he intends to comply with whatever the Fire Department will require. h1r. Murphy said the soatheasterly portion of the site. is somewhat in question as to development rights--it is within the applicant's parcel but a lawsuit has been filed by the owner of the property against Mobil Oil to clear up development rights; however, the building proposed to be erected on this piece of land is included in the application with the indication that it might have to be built later, although the parking area on that portion of the site wild still be provided. He said Staff has been provided with a traffic report and a report on mini.-storage warehouses regarding storage units and parking ratios which includes the information that if the unit is 110,000 square feet at 93% occupancy, the daily average traffic flow is 17 vehicles total. He said other on-site parking would be at the office area for persons wishing information or making an application to rent a unit, and the rest of the parking ® area would be for people servicing their units and that is clustered in the area that is most closely acceptable to the vertical transport on the two- and three-story buildings. He said elevators will be provided to give lessees easier access to their units when loading or unloading. Mr. Murphy brought up the matter of the exit driveway furthest to the south and said they had attempted to combine into an existing mutual access agreement with Mobil Oil at that driveway location which would create 'a grade exit as shown on the plan and then go out the mutual driveway, but he thinks a suggestion was made that that driveway exit straight out to Wayfie1d and he has no difficulty with that, although he is wondering how it will affect the driveway Planning Commission Minutes April 15, 1985 Page Four immediately south of it which would be roughly ten or fifteen feet away. Mr. Lane said the requirement for the straight access out onto Wayfield is included as one of the conditions. Mr. Murphy presented the Planning Commission with some photographs showing the site from different angles and discussed the actions they would take to decrease the visibility of their buildings. Moved by Commissioner Hart, seconded by Commissioner Mason, that the Planning Commission accept the findings of the Environmental Review Board to file Negative Declaration 970. IN RE: NEW HEARLNGS VARIANCE 1754 r GRACE RESTAURANT COMPANY Proposed 40-foot freeway--oriented sign which exceeds the 30-foot allowable height limit for Reuben's and Cocos Restaurants on 1.99 acres in the C~2 Zone on the east side of Tustin Street, approximately 430 feet north from Heim Avenue, NOTE: Negative Declaration 973 has been prepared for this project, Mr. 1,ane made the presentation in accordance with the Staff Report, and said Staff recommends approval subject to the two conditions in its report.. Chairman Master opened the public hearing. Joe Beasley, 3225 Lacey Street, Los Angeles, representing the applicant, said he has no problems with the Staff Report. AYES: Commissioners NOES: None ABSENT: Commissioner IN RE: NEW HEARINGS Master, Hart, Mason, Scott Greek MOTION CARRIED CONDITIONAL USE PERMIT 1416 - COVENANT PREBYTERIAN CHURCH Proposed use of existing facilities for an elementary and secondary school at Covenant Presbyterian Church of Orange on 4.5 acres in the C-1 Zone at the northeast corner of Orange Olive Road and Briarda1e Street. NOTE: Negative Declaration 974 has been prepared for .this project. Mr. Lane made the presentation in accordance with the Staff Report, and said Staff recommends approval subject to the six conditions in its report. He said a similar proposal was approved by the Planning Commission in 1980 but at that time the church was not able to carry out its plans . Chairman Master opened the public hearing. Ray Cook, coordinator of the Christian School at the church, .gave a brief summary of plans for the school as set forth in thb Staff Report. Commissioner Mason .commented that the playground area looks 'like a driveway. Mr. Cook said it is not meant to be a driveway; there is no driveway there. Commissioner Mason asked if it will be a grassy area. Mr, Cook said the area is completely cemented and they have removed some cement and rep"laced it with sand on which to erect playground equipment. Commissioner Mason asked if that will be an adequate playground area. Mr, Cook responded that it will since only one cuss at a time will be using the area. Commisioner Mason asked about the church`s plans to expand the school to include junior high level. Mr. Cook responded that if and when this is done, there will be additions made to the property;. however such an increase is ® quite a bit into the futureR-right now they wi]1 have the school for only kindergarten through fourth grade and .hope to add fifth and sixth grades in a year or two, all of which will fit into the present building. HABICHT Proposed zone change from RM-7 to 0-P and conversion of an existing single-family residence to office use with provision of 46% compact parking on .27 acres on the south side of LaVeta Avenue, approximately 370 feet west from Parker Street. NOTE: Negative Declaration 976 has been prepared for this project. Mr, Lane made the presentation in accordance with the Staff Report, and said Staff recommends approval subject to the conditions in its report. Chairman Master opened the public hearing. Rick Habicht, 14181 Yorba Street, Suite 204, Tustin., the applicant,'said this is a 1904 River- stone home lived in by one lady since the 1930s and his main objective is to keep the home as it looks now since it is listed in the City of Orange historical si e registryw He said he has no problems with the conditions in the Staff Report. Commissioner Mason asked if there will be two different driveways, one for ingress and one for egress; Mr. Habicht responded that they plan to add a driveway on the other side of the house so that one driveway will be for entering and one for exiting. Evel n Cates and Johanni.E, Johannsen, both residents at 700 West ~LaVe~a, the LaVeta Monterey Homeowners Association,~spoke against approval of the application due to problems of increased traffic and lack of enough parking spaces on the site in question. They also objected to the amount of doctors this proposed office use will accommodate; as well ~ as the possible amvot~t of.patients v~ho; would not have enough parking space. They also objected to the possible removal of a magnolia tree: on the property in order to construct the additional driveway. Commissioner Hart pointed out that this property is zoned for multiple housing and if it i.s not used for this project it will probably be sold to someone who will raze this building and build more apartments,~which would create an even worse traffic and parking problem. Chairman Master pointed c Planning) Commission Minutes April 15, 1985 Page Seven out that the applicarr.t is providing 13 parking spaces for 2500 square feet of house and that other houses of that-size would not be likely to have that much parking nor does the apartment complex in which Mrs. Cates and Mr. Johannsen reside have that high a ratio. He also said the roots of the magnolia tree could be cut to make room for the driveway and it would not have to be removed. Brenda Martin, 285 East Third Street, Tustin., the broker repre- senting the applicant, said the building will house four psychia- trists and twor~seeretaries., that patient app6intments would be made in one-hour segments with no overlapping and no waiting room full of waiting patientsy consequently there would not be a parking prob1 em. Moved by Commissioner Mason, seconded by Commissioner Scott, that the Panning Commission accept the findings of the Environmental Review Board to file Negative Declaration 976.. Planning Commission Minutes April 15, 1985 Page Eight Mr. Lane made the presentation in accordance with the Staff Report, and said Staff .recommends approval subject to the five conditions in :its report. He said a letter had been received this day from JD Property Management, which manages some of the adjacent property to the south, indicating concern about noise from the speakers on the applicant's property and requesting they be used only from 9:.00 a.m. to 7:00 p.m. and if additional speakers are installed they be aimed away from the adjacent residential properties, Chairman Master opened the public hearing.. Bill Selman, 18952 Ridgewood Circle, Villa Park, President of Selman Chevrolet, said the additional bays would be located near the body shop and would be used for used car reconditioning which is light mechanical work; therefore the noise of the body chap would drown out what little noise would come from the new bays; also no speakers would be added. He said he thought the speaker noise was resolved three to five years ago since he has not. had complaints since then, .Commissioner Hart mentioned that he lives five. blocks away and can hear the speaker noise. Mr. Selman said he will take steps to cut down the speaker noise but the fact remains that speaker noise has nothing to do with the current project application. ® Vera Finn, 235-245 South Oak, said she and her husband own a small apartment complex and all their tenants complain abqut_both~spealeer noise and mechanical noise coming from Selman Chevrolet. She said the noise has reached the l eve`1 of being completely i.rito1 erabl e,' that it goes on day and night and is making her complex unrentable. She read a letter from anot"her apartment house owner on Oak Street appealing to the Planning Commission to deny this ~pp~licatian and requesting that Set man Chevrolet be required to cut down the noise, she presented a petition signed by residents on Oak Street and also presented seven additional letters from property owners on Qak Street. She said she feels the problem cannot be solved by anything less than a noise barrier similar to those used for freeway noise and suggested the construction of an eight-foot wall between Selman Chevrolet and all the Oak Street properties, Chairman Master asked for Mr. Minshew's advice regarding the relation of the California Environmental Quality Act to the Negative Declara- tion. Mr. Minshew said he is concerned that the complaints about the noise are a challenge to the Negative Declaration and he feels the Planning Commission will have to resolve the Negative Declaration before it can take action on the Conditional Use Permit. Mr. Master said he feels there is already a problem without the addition planned in the current project, that that problem should be addressed because it is possible an ordinance is being violated, but the comments are on a noise level that currently exists and has northing to do with the current project--they are two separate items. Commissioner Hart Q agreed and said this hearing is on the application for new bays and if the residents of the area want to discuss the existing noise they can do so at ;the end of th %s hearing, Commissioner Mason asked if Planning Commission Minutes April 15, 1985 Page Nine those in opposition are aware there is a Code 17.42 that states "public address systems shall not be and ible from any exterior boundary.," and that they could fight the problem from that stand- point. Mr. Lane said the person to contact in that case would be Chris Carnes, the code enforcement person in his office. Mr. Selman said there will be three mechanics there working on mech- anical reconditioning of used car~,.'there will be no increase in ;~ noise, there will be no additional speakers. He said the problem has been pointed out to him and whatever the Code is, it is his job to meet the Code. He said if he has to pull out the speakers in the back he will pull them out. He said the first thing he wi]1 do is get a consultant to show him the best way to solve the prob1 em.. and if he has to cut out the paging he will do so. He said he will do whatever he has to do to comply with the law, but the noise that exists now hasn`t anything to do with the addition of the new bays. Commissioner Hart said he feels the existing situation does not pertain to the Negative Declaration as it pertains to the applica- ation for new bays. He said he knows Mr. Selman and is sure that now that he is aware of the situation he wild take steps to alleviate it. Commissioner Scott suggested. that the property owners on Oak Street work with Mr. Selman to correct the problem and if any nega- tive situations arise they can contact the code enforcement officer to pursue the matter, Chairman Master closed the public hearing. Mooted by Commissioner Hart,, seconded by Commissioner Scott, that the Planning Commission accept the findings of the Environmental Review Board to file Negative Declaration 977. Commissioner Mason asked that the people in opposition receive a copy of the Staff Report on the application since the standard conditions address the fact that the mechanical apparatus shall be baffled for sound, Chairman Master recommended that these people work directly with Mr, Selman and said he is sure Mr, Selman wil l be responsive to their problems and suggestions. Planning Commission Minutes Apri l 15, 1985 Page Ten IN RE: NEW HEARINGS CONDITIONAL USE PERMIT 7421, VARIANCE 7756 - ERASER ENTERPRISES Proposed expansion of an existing office use., provision of 52% compact parking spaces and construction of a new entrance addition which encroaches into the front yard setback on .5 acres in the M-2 Zone on the west side of Manzanita Street, approximately 260 feet north from Katella Avenue. NOTE:. This project is exempt from environmental review. Mr. Lane made the presentation in accordance with the Staff Report and. said Sluff recommends approval subject to the eight conditions in its report. Chairman Master opened the public hearing, ® Darlene Lacombe, 13141 Lewis, Garden Grove, architect for the appli- cant, said the present use of this building is by Fraser Enterprises and there is no p1 an to increase personnel,~merely to make it easier for the present 16 employees to work by enlarging the office space. She said these 16 employees~wil1 use 16 of the 27 parking spaces provided.. Milt Helms, 1856 Conejo Lane, Fullerton,,representing Helms Foster Corporation-, owners of the property on the northeast corner of Manzanita and Katella, said there are already parking problems on Manzanita Street which he feels will be aggravated if Fraser Enter- prises cuts down the amount of ,parking it has currently. He showed photographs he had taken of the area i.ndics~ting the parking there on the last three working days prior to this meeting, Commissioner Hart asked if Mr. Helms thought the problems wwould be caused by this project or were from other businesses in the area that didn`t nave enough parking. Mr. Helms responded that the problems wouldn't exactly be from this project.-but by losing two of their spaces they would probably use off-street parking which is already too heavy. He said there were vehicles that parked overnight and had been there for considerable length of time as well as a mobile home that had been parked there for a long time. Commissioner Greek recommended that Mr. Helms contact the police department to enforce the parking regulations on the street. Mr. Helms said the curb in front of Fraser is painted green, for limited parking; consequently Fraser employees park in front of his building. He asked how Fraser had accomplished getting the curb painted green; Mr. Johnson said he would have to research the f Iles to find out. Gene White, 155 Jewel Place, Orange, Vice President of Fraser ® Enterprises, said the green curbing had been approved by the City Council and that the parking problem is-not created by Fraser Enterprises since itsiparking lot is more than adequate; in fact, other businesses in the area use Eraser`s lot. He reiterated Ms. Planning Commission Minutes April 15, 1985 Page Eleven LaCombe's statements regarding the purpose of the expansion. Com- missioner Mason said it appears that the problem is not with the Fraser parking lot but with the street parking and there are other avenues that can be addressed to take care of that.. Moved by Commissioner Mason, seconded by Commissioner Scott, that Conditional Use Permit 1421 and Variance 1756 be approved subject to the conditions in the Staff Report. AYES: Commissioners Master, Greek, Hart, Mason, Scott NOES: None MOTION CARRIED IN RE: MISCELLANEOUS TENTATIVE PARCEL MAP 85-191 -DELTA DEVELOPMENT Proposed six-lot subdivision of a 1.78-acre portion of a 7.48-acre parcel in the M-2 Zone on the west side of Batavia Street at Southern Avenue. NOTE: Negative Declaration 981 has been prepared for this project, Mr, Lane made the presentation in accordance with a memo from the Q Environmental Review Board, and said Staff .recommends approval subject to the five conditions on the tentative parcel map. Com- missioner Hart asked why the Planning Commission is getting tentative parcel maps and Mr. Lane responded because this is in ah industrial zone. Commissioner Greek said he receives the impression that a funny kind of parcel would be created if this were approved. He said there is an office building-and a 35` driveway that isn`t adequate fora public street and if these lots were approved there wouldn't be adequate access to the rear portion of the property if at some future time someone would want to build on it. He said he feels provision should be made for adequate access and proper devel- opment of the rear parcel, Moved by Commissioner Greek, seconded by Commissioner Mason,. that the Planning Commission recommend denial of Tentative Parcel Map 85-? 91 without prejudice. AYES: Commissioners Master, Greek, Hart, Mason, Scott NOES:. None MOTION CARRIED Mr. Lane suggested that the applicant be notified of the reason for denial so the application does not go to the City Council. Commis- sioner Greek said that if it does go to the City Council he feels there should be a statement included that the reason for Planning Commission denial was the desire to redesign the accessway to the rear portion of the property. IN RE: OTHER BUSINESS Chairman Master brought up the Staff memorandum regarding the Planning Commission Minutes April 15, 1985 Page Twelve American Way Cultural~;C®nter (Richard & Marty Adair).. He said he agrees with Staff's comment about letting them proceed with their plan and submitting an application for hearings before the Planning Commission and the City Council. He requested Mr. Lane to communicate with Mr, and Mrs. Adair regarding Staff's memorandum and the Planning Commission's concurrence with the approach; also to tell them that the Planning Commission is not endorsing their plan, merely wishing it to be applied for through proper procedure, and that no approval of the p1 an is guaranteed, Chairman Master said a letter from Councilman Perez indicates. the wish of the City Council for a joint meeting with the Planning Commission at 5:30 p,m. on April 23 regarding the East Orange Plan. Mr. Johnson said that several weeks ago there was a presentation to the City Council on the Eastern Corridor Study ~at which he feels the Planning Commission should also .have been present. After some dis- cussion it was decided that the Planning Commission should attend the brief ,joint session with the City Council on April 23 following which Mr, Johnson would make the presentation on the Eastern Corridor Study to the Planning Commission in a separate session. Bob Bennyhoff., Orange Park Acres, said it is the present intention of the Orange Park Acres Homeowners Association to formally request that the Planning Commission and the City Council go on record as opposing the westernmost alignment and .they will be making that request in formal sessions in the next couple of weeks. Chairman Master mentioned the meeting of the California Association of Local Economic Dwe1opment in San Francisco, April 24-26. Commissioner Mason asked what happened to the problem of satellite dishes which was bro~.ght before the Planning Commission some time ago and was supposed to have been brought back, Mr. Lane said the City Cvunci'1 directed Staff to prepare an amendment to the Code to deal with satellite dishes and. it is currently being worked on.
