The regular meeting of the Orange City Planning Commission was called to order
by Chairman Hart at 7:30 p.m.

Commissioner Vasquez referred to page 3, paragraph 4, asking that
this paragraph be deleted from the minutes, as he had not attended
the meeting referred to by Commissioner Coontz and his remarks
had been misinterpreted. He also referred to page 9, paragraph 5,
wherein statement was made that you must go toward Orange in order
to get on the freeway. Statement should have read "...you must go
toward Santa Ana ...".

approve the minutes of April 4, 1983, as corrected.

TENTATIVE PARCEL MAP 83-753, CONDITIONAL USE PERMIT 1265,
VARIANCE 1716 - SOUTHERN PACIFIC COMMUNICATIONS CO.:
A request to subdivide a lot into 3 parcels and to permit the
construction of a 165 foot telecommunications repeater tower
that exceeds height limits in the industrial zone on land
located on the southeast corner of Batavia Street and Angus
Avenue (695 North Batavia Street). (NOTE: Negative Declaration
823 has been filed in lieu of an Environmental Impact Report.)
Jere Murphy explained to the Commission that a letter had been
received from SPCommunications indicating that they have additional
technical studies which they wish to perform with regard to trans-
mission of communications as related to the proposed tower in other
similar facilities. He pointed out that it would be at least a
couple of months before they have answers in their study and,
therefore, have asked for withdrawal of the application, rather than
a continuance.
Moved by Commissioner Vasquez, seconded by Commissioner Coontz to
accept withdrawal of Tentative Parcel Map 83-753, Conditional Use
Permit 1265 and Variance 1716, as requested by the applicant,

IN RE: NEW HEARINGS:
TENTATIVE TRACT 11910, CONDITIONAL USE PER~~IIT 1260 -
CENTURY AMERICAN CORPORATION:
A request to subdivide land into 55 lots to develop a 54-unit
townhouse project and to form lots without frontage on a
public street on land located on the south side of Palm Avenue
approximately 461 feet west of the centerline of Cypress Street.
(NOTE: Negative Declaration 819 has been filed in lieu of an
Environmental Impact Report.)
Jere Murphy presented this application to the Commission, stating
that this property contains 3.61± acres of land located on the
south side of Palm Avenue, approximately 461 feet west of the
centerline of Cypress Street. The property has approximately 528
feet of frontage on Palm Avenue and a 20-foot emergency access
driveway onto Park Street on the south property line.
Mr. Murphy pointed out that the property is currently vacant and
that Zone Change 983 rezoned it to R-h1-7 (Residential Multiple-
Family District) by a resolution of intent, dated March 8, 1983.
He also pointed out that Palm Avenue is a commuter street with a
width of 66 feet.
The applicant proposes to construct a 55 lot condominium subdivision
consisting of 54 townhouse units, under the provisions of the
Planned Unit Development Ordinance; some without frontage on a
public street.
Staff has reviewed the proposal and expressed several concerns:
1. That the emergency access area should be posted, maintained
and gated, with a see-through material.
2. That guest parking be specifically identified in the
development. Particular concern was addressed to the
westerly portion of the project's limited open parking
space count.
3. That the entry .area allow two parking spaces on the street
entry side only.
4. That the Palm Avenue wall be designed or landscaped to
preclude vandalism of the wall.
Staff recommends that the Planning Commission accept the findings
of the Environmental Review Board to file Negative Declaration 819.
Staff further recommends that Tentative Tract Map 11910 be approved,
subject to the 12 conditions listed in the Staff Report; and that,
with the appropriate conditioning, Conditional Use Permit 1260 is
recommended for approval for two reasons:
1. That use of the property for multi-family residential is a
logical and desirable transition between the lower density
residential uses to the south and west and the industrial
uses to the east and north.
2. That the proposal is in conformance with the intent of the
General Plan.

Conditional Use Permit 1260 is recommended for approval, subject
to the 18 conditions listed in the Staff Report, together with
the addition of Special Condition #3, which would state:
Traffic Engineer.

Commissioner Coontz asked for clarification of the recommended
special condition and Mr. Murphy explained this in further detail.
Chairman Hart asked about the turnaround within the complex, stating
that this takes away some of the parking. Mr. Murphy explained
this in greater detail.
Chairman Hart opened the public hearing.
Roger Hobbs, President of Century American Corporation, 1428 E.
Chapman Avenue, Orange, the applicant, addressed the Commission in
favor of this application, explaining that they are proposing a 55-
lot subdivision of which one will be in common. He pointed out
that they have had several formal and informal hearings as to the
type of project which will be developed on this property and many
concerns have been discussed between the applicant and concerned
citizens, together with Staff, and, as a result, he felt that the
public hearing would probably be quite short. He pointed out that
his company thinks this will be one of their finest products in the
City of Orange and went on to explain all of the details which will
go into the project, as far as design is concerned. The units will
sell for $90,000 to $100,000 and they feel that this will be a
complete amenity package. They hope to break ground by July 1st.
Bill Petty, owner of duplexes at 234-236 N. Parker, Orange, addressed
the Commission, asking if Parker will be widened at that point and
what kind of an outlet will there be into Parker from the project.
It was explained to him that there will be an emergency fire entrance

There being no one else to speak for or against this application,
the Chairman closed the public hearing.
Moved by Commissioner Master, seconded by Commissioner Vasquez to
accept the findings of the Environmental Review Board to file
Negative Declaration 819.

CONDITIONAL USE PERMIT 1270 - LAGUNA LAND AND CATTLE CO., INC.:
A request to permit a 17,000 square foot office use in the
Industrial zone on land located on the north side of Struck
Avenue approximately 250± feet east of the Katella Avenue
and Struck Avenue intersection. (NOTE: Negative Declaration
829 has been filed in lieu of an Environmental Impact Report.)
By consensus of the Planning Commission, no presentation was
given.
Chairman Hart opened the public hearing.
Doug Scott, 230 S. Pasadena, Unit A, Tustin, the applicant,
addressed the Commission in favor of this application. He brought
up one of the concerns of the Staff stated in 9a, page 2 of the
Staff Report: "Katella Avenue needs to be improved and dedicated
to City standards as per Engineering Department requirements.'',
stating that he had talked to Jack Brotherton and was told that
Katella is at its full width at that point and he wondered if
sidewalks will be required there since projects on both sides of
the street have no sidewalks. Chairman Hart told him that this
would be the concern of the City Engineer.
Gary Johnson explained that Katella has a couple of different zones,
and in an industrial zone, if there is a development that iias the
ability to generate pedestrians, then they would normally require
sidewalks. However, normally, that is not the case. Most industrial
developments do not generate pedestrian traffic. However, they have
seen industrial developments in the Katella area become commercially
oriented and, therefore, they feel that a study should be made of
that area so that they can come up with some answers there. The
problem is with redevelopment when commercial activity comes into
the picture. He explained that this is a normal condition which
is placed upon all conditional use permits and stated that a side-
walk is required by ordinance. If the condition can stay the way
it is and give them an opportunity to do a study to find out whether
pedestrian traffic is being generated, that is their intention.
He pointed out that this will be accomplished before these plans
are approved. It was decided that this condition could be worked
out with the Engineering Department and the applicant.
There being no one else to speak for or against the application,
the Chairman closed the public hearing.

Negative Declaration 829.
