Williams, Assistant Planner; PRESENT: Gene Minshew, Assistant City Attorney; Gary Johnson, City Engineer; and Toba V. Wheeler, Recording Secretary. PLEDGE OF ALLEGIANCE IN RE: MINUTES OF APRIL 21, 1986 Commissioner Master pointed out an error in the list of those present _ at the meeting and said it had a1 ready been corrected. Moved by Commissioner Master, seconded by Commissioner Greek, that the minutes of April 21, 1986, be approved as corrected. AYES:. Commissioners Mason, Greek, Hart, Master NOES: None ABSENT: Commissioner Scott MOTION CARRIED IN RE: NEW HEARINGS ZONE CHANGE 1051, CONDITIONAL USE PERMIT 1504 - R. C. HOBBS Proposed zone change from R~7~7 to C-1 (Limited Business) and request to establish a drive-through window in conjunction with a restaurant on a 1.71~acre parcel located on the southwest corner of Chapman Avenue and Swidler Place. NOTE: Negative Declaration 1061 has been prepared for this project. Since the Planning Commission had reviewed the Staff Report, there was no presentation made. Chairman Mason declared the public hearing open. Barry Cottle, Hobbs. Company, 1428 East Chapman Avenue, Orange, said he is in agreement with the Staff Report and will answer any questions the Commission might have. Chairman Mason declared the public hearing closed. Proposal to expand a church school within the C-1 Zone on a 4.5-acre parcel located on the northeast corner of Orange-Olive Road and Briarda1e Avenue. NOTE: Negative Declaration 1063 has been prepared for this project. Since the Planning Commission had reviewed the Staff Report, there was no presentation made. Greek, Hart, Master None Commissioner Scott MOTION CARRIED IN RE: NEW HEARINGS TENTATIVE TRACT 12649 - IRVINE PACIFIC Proposed three-lot, 236-unit air-space condominium development within the P-C (Planned Community) Zone and Upper Peters Canyon Specific Plan on a 14,9-acre parcel located on the north side of future Canyon View Avenue, east of Newport Avenue, NOTE:. Environmental Impact Report 868 has been prepared for this project. Planning Commission Minutes May 5, 1986 Page Three Mr. McGee made the presentation in accordance with the Staff Report and said Staff recommends .approval for the reasons given in its report, subject to the conditions in the report. He listed other information items that were given to the Planning Commission, namely a copy of the development standards excerpted from the Upper Peters Canyon Development Plan applying to a medium-density project, which this is; a memo from Staff indicating that this is the first of .the tentative maps within the Upper Peters Canyon area; a letter fr.~m the Orange Unified School District stating that it does not oppose the project at this time but is in the process of discussing with The Irvine Company means of providing schools for the area because it wants to retain the right to oppose this or future projects if it appears to them that the projects don`t appear to be going in a successful direction; and a letter from the Orange Park Association, received only today, raising questions that Staff has not had, time to address. He said Staff will be providing the Commission on a regular basis an inventory of the numbers of units approved, numbers of building permits approved and numbers of occupancies within the total area so track can be kept of conditions of approval within the Specific Plan and the Master Tentative Map itself. Chairman Mason declared the public hearing open. David DiRienzo, Project Manager for Irvine Pacific, 610 Newport Center Drive, Newport Beach, California 92660, discussed in detail plans for the accesses to the site, the recreation areas, the parking facilities, building designs, floor plan designs, landscaping and overall appear- ance, and facilities for the handicapped, He thanked Staff for its assistance in design and preparation of the plans. Ted Botens, 10802 Meads, Orange, president of Orange Park Association, presented the views of the Association regarding drainage problems and facilities, recreation and park areas, playgrounds and equestrian trails. He asked who would be liable if there is flooding in the future .and what provisions are being made to prevent sediment and silt during construction from going into the drainage channel. He said he couldn't see that provision had been made for adequate open space and park requirements, specifically for baseball, soccer and other community uses. He said he believes that much of the park area is on land that is subject to inundation in a ten-year rainstorm. He said the Specific Plan projects that there will be landscaped areas on each side of the Equestrian Trail proposed for the south side of Canyon View Avenue and in that case the Association feels the maintenance of the trail should be included with the maintenance of the landscaped strips on either side of it. He also wanted to know if the City will require adequate streets into the area prior to the beginning of construction for the use of the Police and Fire Departments during construction if their access to the area becomes necessary, He also requested that low-profile lighting be required for the streets in the area, for esthetic reasons. Planning Commission Minutes May 5, 1986 Page Four Mr. Johnson said that as long as people can file lawsuits, the City could be in a position of being liable if the drainage plan fails and there is downstream flooding. Mr. Minshew said if it is just a case of water flow into Handy.Creek,-it won`t make the City or The Irvine Company liable; however, he isn`t sure what is meant by "if the drainage plan fails." Mr. Johnson said he thinks that once the water is conveyed via a dedicated system,=then the City or the County has the duty to make sure that it doesn`t endanger any of the new homes being built. He discussed des i1tation and the retard ing basin and said there should not be a siltation problem after the area is fully developed and landscaped, He said the. concept of eliminating the des i1tation basin would be one of the increments of the total plan; i.e., there will be a retarding basin developed on the park site and there will be a storm system that will convey the ten-year storm down into the creek area, and any water above the ten-year storm will go into the retarding basin, the top of the storm will be topped off, and there won`t be any flooding downstream resulting from storms of a frequency greater than ten years. Mr. Johnson said the only time there might be a problem is between now and the time the property. is fully developed and landscaped, therefore, each master pad will have its own erosion control plan and as each master pad develops the strategy needed to protect that area from erosion will change from one of desiltation, sandbagging, etc., to one of working within the developed streets to eliminate erosion. He said a plan has been prepared for erosion control that will change as development progresses in order to take care of ongoing erosion. He said it is in the City Code that developers provide erosion control facilities and suggested that a Condition can be added in this case to assure that it is done before, during and after development of this project. Commissioner Hart commented to Mr. Botens that the Upper Peters Canyon development standards regarding pets prohibits the keeping of horses; therefore, he feels it is unfair to require that they perform the maintenance on the equestrian trail as Mr. Botens suggested, Mr. Botens said the equestrian trail will undoubtedly be used by walkers and joggers,'as well as horseback riders, not residing within Oranges Park Ades,-°and he feels Orange Park Acres residents should be responsible for maintenance of the trails only within its own boundaries. Brian Austin, Project Manager for Upper Peters Canyon, The Irvine Company, 550 Newport Center Drive, Newport Beach, California 92660, spoke on drainage and erosion, detailing what the company`s plans are regarding those items. In response to other questions raised by Mr. Botens,-he said when the Specific Plan was approved, there was a requirement for l3~ acres of park for the entire development if 2,000 units were developed, and there was a formula developed to be~~used in the event there would be less than 2,000 units. He said the developer has provided in the park site about 9.5 acres, Planning Commission Minutes May 5, 1986 Page Five including the retention basin and the Handy Creek corridor down to Canyon Uiew Avenue, out of which about four acres is inundated for a 1~- to 2-hour period. In addition, another 3,5 acres has been provided in the Handy Creek corridor and 2.5 acres in the Canyon View area for the equestrian trail and related landscaping, as established by the Specific Plan. He said this makes 15.5 acres being provided just on those two facilities, p1 us another 4.5 acres in the paseos and along Canyon View which were not included in the original Specific Plan. Of all this land, about 76 .acres are not subject to any inundation or impact,-he said, which more than meets the park requirements. With respect to the school site, The Irvine Company agreed to provide an eight-acre school site, he said, and has agreed with the School District that the company has a fair share of responsibility for this depending upon the amount of students its development generates. He said the School District, based on today's conditions, has indi- cated that the school site will. not be needed for another four years, and the company is confident that between now and when the school is needed it will find a way to help the School District fund it. Regarding Street construction, The Irvine Company hopes to be con- strutting all the streets within the development at about the same time and feel it is complying with Fire Department requirements regarding street availability during the construction phase. As for street lighting, Mr. Austin said the company is working with the City in designing the lighting and providing fixtures that will be safe and adequate for City purposes and fit in with the rural atmosphere of the area. Mr. Austin said that landscaping will be performed to fit in with the uniqueness of the area for the benefit of the area. He said the equestrian trail in the plan was included primarily at the request of the. Orange Park Association and it was discussed at the time that it would be the Association's maintenance responsibility although no agreement was made at the time. He said if it appears that the trail will be advantageous to the residents of the proposed development, it could be included in the development`s maintenance district if the City so desires. ~ Chairman Mason said that on the Specific Plan there were a specific number of units that were the limits for each area and she notes that this initial development will have four less units. than the limit. She asked if this means those four units will be lost to the total area or if they will be picked up at a later date and added to another area. Mr. Austin said he believes the Specific Plan allows the movement of units from one area to another within a density category as long as the total amount of units is not exceeded. He said they will work with the Planning Commission and Staff to make sure they are not overloading any particular area. Planning Commission Minutes May 5, 1986 Page Six Lyn Rae Swain, 931 Ridgeline Road, Orange ~~expressed her concerns regarding schools and future possible floods. Mr. Johnson pointed out that the flooding potential in that area will be less by 2~ to one after the development is built than it is now. Commissioner Greek pointed out that the intention of the retarding basin is not to help The Irvine Company but to control the overflow through Handy Creek, so it is to the City's advantage to have it as opposed to existing conditions. He asked Mr. Johnson if he has enough information to establish the boundaries and alignments in the middle of the property. Mr. Johnson said the tentative maps are being processed on an indivi-dual basis and Staff has not seen seen the plans for some portions of the property and there is some diffi- culty in seeing that each master pad has all of the things that are essential to good development. Commissioner Greek asked Mr. Johnson if he anticipates that Canyon View will be totally constructed prior to the occupancy of these units. Mr, Johnson said he anticipates that Canyon View will be constructed in its entirety between Newport and the Loop Road and that the Loop Road will be constructed in its entirety over to Newport Avenue, these being the two main arteries which will serve the projects that are already on the~map. He said the realignment of Chapman, which is a project of major concern, will depend on the phasing of the development. He said he thinks it might be informative at this point. to have The Irvine Company explain how it envisions this will take place; however, he thinks the City and The Irvine Company are on the same wavelength in this regard and there have been several meetings on this issue as to what is needed-- what figures are needed at what point in time,-what streets will be needed at what point in time,- etc. Mr, Austin said The Irvine Company is in the process of creating and making the improvements to Newport Avenue from Chapman Avenue down the length of the project, the storm drain is in the process of completion and street improvements will be made. as soon as a water 11ne can be installed. He said grading is already being done and they hope the roads will be improved by September or October. He said they anticipate that the first units will not be occupied until the beginning of 1987, and they are planning on getting everything installed, including the landscaping,-prior to model openings and sales activities, which are scheduled for the end of 1986 and early in 1987. He said The Irvine Company is working with the City to form an assessment district. Mr. Johnson added that the City and The Irvine Company have had many, many meetings and .will continue to have meetings, working together to assure that everything is done properly] and he is comfortable with the fact that the projects are ready to proceed. Moved by Commissioner Hart, seconded by Commissioner Greek, that Planning Commission Minutes May 5, 1986 Page Seven the Planning Commission recommend to the City Council that it approve Tentative Tract 12649 subject to Conditions 1 through 16 listed in the Staff Report. Commissioner Master suggested that Condition No. 17 be added requiring that erosion control devices be added as part of the development plans. None ABSENT: Commissioner Scott MOTION CARRIED IN RE: MISCELLANEOUS T ~,~scussion with The Irvine Company and Staff regarding Planning Program for East Orange Sphere of ,Influence area. City Council has requested a recommendation from the Planning Commission on this proposed study. Jeri Murphy commented that if the Planning Commission wishes to leave the opportunity available to make a recommendation tonight, it either complete its discussion on the planning program for the Irvine Ranch as a part of its regular meeting or adjourn the regular meeting to a study session so a formal recommendation can be made to the City Council, After some discussion among the members of the Planning Commission, Chairman Mason announced that the Commission has adjourned to a Study Session and the continuation of the discussion of this item shown as a Miscellaneous Item on the Addendum Agenda for this meeting. Monica Florian, a vice president of The Irvine Company, said the discussion of the company regarding its work program had been completed at the study session held earlier in the evening prior to the commencement of the regular meeting. She said she~;~hoped there could be some action or specific direction for the program on the. part of the Planning Commission. Chairman Mason, in looking at the chart showing future action on this matter,-.asked .why the City Council is not being brought in earlier than November, 1986. Burt Yamasaki, Director of Planning and Development Services, said-the City Council will get this in October, 1986, and prior to that time there will be a series of committee and Staff reviews and technical reviews before the development plans are presented. He said the City Council first appears. in August, 1986, in terms of .identifying the development opportunities. Bob Bennyhoff, a resident of Orange Park Acres, said he understood there will be two City Council members on th is committee and he Planning Commission Minutes May 5, 1986 Page Eight thinks there should also be two members of the general public on the committee, one from the downtown area and one from the East Orange area, to give it a more balanced concept, because he is worried about the problems that will arise in trying to make East Orange and West O'range meld into one entity.. Commissioner Greek said this matter should be set for another regular, noticed meeting and he feels the Commission should not be making a decision or having a vote on the matter tonight. Commis sinner Hart said he thinks there should be some public discussion and he would like this to go on a regular meeting agenda in the near future. Commissioner Greek added that it should be a meeting when all five Planning Commissioners are present. Discussion was held as to a good time to pul~this on a regular meeting agenda. At_ths point, at .9:.25 p.m.,-Commissioner Hart asked to be excused from the meeting due to personal business. He said he would be available on either of the dates under discussion. Moved by Commissioner Greek that this matter be put on the agenda as~a regular item for a special meeting on May 29, 1986. The motion died for lack of a second.
