City of Orange Orange, California PLANNING COMMISSION MINUTES June 3, 1985 Monday, 7:30 p.m. The regular meeting of the City of Orange Planning Commission was called to order by Chairman Master at 7:30 p.m. PRESENT: Commissioners Master, Greek, Mason, Scott ABSENT: Commissioner Hart STAFF John Lane, Administrator of Current Planning and Commission Secre- PRESENT: tary; Jim Reichert, Associate Planner; Gene Minshew, Assistant City Attorney; Gary Johnson, City Engineer; and Toba V. HEARINGS TENTATIVE TRACT 12428, CONDITIONAL USE PERMIT 1430 - SAN CLEMENTE DEVELOPMENT Proposed 13-unit industrial condominium subdivision of 5.35 acres in the M-2 zone on the east side of Main Street, approximately 412 feet south from Barkley Avenue. (Continued from the May 20, 1985, Planning Commission meeting.) NOTE: Negative Declaration 985 has been prepared for this project. ' Mr. Lane .said the applicant is present and will undoubtedly request a continuance i.n order to consult with his architect regarding a change in plans. Chairman Master opened the public hearing. Keith Cook, San Clemente Development Company, 4540 Campus Drive, Newport Beach, said that San Clemente Development Company has not been able to resolve what appears to be some critical issues in its plan. Also, since Chairman Mason will not be able to vote on this issue due to having missed the previous meeting, and since Commisasioner Hart is not present at this meeting, they .would prefer to postpone the hearing until Commissioner Hart can be present. They also wish to meet with the owner of the property to the north to to try to obtain a second ingress and egress to their property. Therefore, they would like to continue this to the meeting of July 1, 1985. Planning Commission Minutes June 3, 1985 Page Two Chairman Master declared the public hearing closed. AYES: Commissioners Master, Greek, Mason, Scott NOES: None ABSENT: Commissioner Hart MOTION CARRIED IN RE: NEW HEARINGS GEf~ERAL PLAN AMENDMENT 3-84-A, ZONE CHANGE 1015, CONDITIONAL USE PERMIT 1355 - CENTl1RY AMERICAN Proposed General Plan Ame~:ndment from Lo D /nsity Residential and LG~t~~ Open Space to Medium Density Residential, Zone Change from R-1-7 to RM-7, and Conditional Use Permit to allow a 146-unit condominium development on approximately 26 acres on the west side of Tustin Street at LaVeta Avenue. NOTE: .Environmental Impact Report 910 has been prepared for this project. ® Mr, Reichert made the presentation in accordance with the Staff Report and .said Staff recommends approval subject to the 35 condi- tions in its report. He said there is a letter on file from the Santiago Creek Homeowners Association that reugests continuance of this item; also, Century American had requested that the Conditional Use Permit portion of the application be withdrawn but as~.ofi this evening has changed its mind about withdrawing it. Chairman Master opened the public hearing. Barry Cottle, repre- senting Century American, 1428 East Chapman Avenue, Orange, presented a summary of Century American's progress during its involvement of the past 15 months. He showed slides of work leading to the final plan. Commissioner Mason asked what sort of a grade there will be coming into the project. Mr. Cottle said the grade will be level for a while but will then drop down; however, it will be raised enough for visibility. Commissioner Greek asked if the Orange County Flood Control District will maintain the bridge as well as the creek. Mr. Cottle responded that the bridge, which will be 40' wide, will be maintained by .the association. Commissioner Scott asked Mr. Cottle if he knew the amount of increase or decrease in daily trips there would be with homes there instead of the golf course. Mr. Cottle said they would be adding 759 trips per day over the present use. Commissioner Scott asked the amount of open space acreage minus the creek area that will be provided with the condominiums. Mr. Cottle said he didn't have the answer to that but knew that the site plan meets the requirements of the City. Planning Commission Minutes June 3, 1985 Page Three Mr. Cottle said he has four questions regarding the conditions in the Staff Report: 1) Re #2C, on the requirement for northerly ent~an~e transition and sight distance of the entry, he can clarify this with Staff at a later date; 2) Re #17, requirement for garage door slide bolt locks, he's not sure what these are but in the past they have always provided garage door openers and are planning to do so with this project; 3) Re #20, approval of the bike trail by the Police Department, they will have to work out .the bike trail with the Orange County Flood Control District and the EMA and will work with the Police Department to make sure there is no conflict; and 4) Re #29, the Fire Department requirement for specialized fire- fighting equipment, he is not sure what this is but will check with the Fire Department. David W. Clements, 1521 East Fairway Drive, Orange, a vice president of the Santiago Creek Homeowners Association, said he wants to go on ® record as requesting a continuance of the hearing on this matter to some time after June 27, which is the day the Santiago Creek Home- owners Assocition will meet to discuss this matter. Chairman Master asked him when the SCHA received the Environmental Impact Report. Mr. Clements responded that he has never read it nor has anyone else in the Assocition seen a copy because it was never distributed to ® them. Mr. Reichert said the notice of preparation of 'the EIR was sent to Kathy Rogers, president of the SCHA, on June 26, 1984, and a copy of the draft EIR was sent to her on March 15, 1985. Mr. Clements said the members of the Association were not shown that copy nor was the Executive Board of the Association aware of it or of any corres- pondence on the matter received by Mrs. Rogers. He said he hopes these items will be brough to the Association`s June 27 meeting, at which i.t will elect new officers. Commissioner Greek asked Mr. Clements what was discussed at the May 9 meeting with Mr. Cottle, pointing out that it is difficult for the Planning Commission to understand what is going on if it is told by Staff and by the developer that the Association knew about everything but is told by Mr. Clements that the Association knew nothing. Nick Rani'1l, 1023 Fairway Drive, said Mr. Cottle came to his home and they talked about the basic concept of the project but at no time - did he see a plan or the EIR. He said he thinks it is only fair to those who live in the area to have this matter continued so they have time to review the documentation and present their case since it is their impression that this area was. to remain open space. .Chairman Master asked to whom the paper work should be sent to ensure its receipt, Mr. Clements said it should be sent to the address on the SCHA letterhead--1429 East Fairway Drive, Orange. Commissioner Mason p©inted out that in the report it states the site plan was mailed to the homeowners on May 6 and 7 and that copies of the site plan were hand-delivered to 55 homeowners at that time. Mr. Clements said none were mailed, but 55 were hand- delivered about three weeks ago. He said, in response to Mr. Planning Commission Minutes June 3, 1985 Page Four Cottle remark about having spoken to the homeowners, that in fact he has spoken with only about four of them on two occasions. He said he didn't remember when the first date was but he believes it was on Novemb~.er 8 when there were about six homeowners present at a meeting at Mr. Cottle's office and at that time they were told that a questionnaire~,would be sent to the .homeowners; however it was never received. He said that at that time it was decided that certain SCHA Board members might contact the Orange Planning Director to see what procedures were taking place on this development, but they were told no applications had been received and therefore it was a little premature to discuss the matter with the planning director. He said that after that they were given a progress letter by the project manager of Century American with a site plan enclosed. Chairman Master asked if there was anyone present who had received the site plan; only one person responded in the affirmative. Mr. Cottle said Century American personnel did walk the golf course handing out a site plan and in its files there is a list of the ® homeowners to whom it was given as well as the comments of the 29 homeowners who were home at the time. He said that at the same time the site plan was mailed to the balance of .the homeowners. Mr. Clements admitted receiving this letter and site plan and said fo11owing its receipt he and Mr. Ralph Masek, another vice president of SCHA, met with Mr. Cottle and Mr. Messier in the Century American office. At that time Century American advised them the hearing would probably occur the beginning of June. He said that when Mr. Masek went to the Planning Department shortly after that, he was told-that the hearing would be on June 3, and a notice of this meeting was received on May 25, to which the Association responded with its letter of May 28 requesting a continuance. He said the homeowners feel that this sort of snowba17ed on them and they haven't had time to prepare properly for the hearing. Honor Marsh, 907 East Fairway Drive, said she has lived there for 20 years and did not receive, either in the mail or handed to her personally, a site plan or anything e9 se in reference to this matter until she heard from. the SCHA with information about this hearing and then received the notice from the Planning Department. She said her four neighbors have the same experience and all feel they have been left in the dark by Century American. Wayne Spring, 1243 Fairway Drive, said he received nothing from Century American, nor did his neighbors. He requested that the Planning Commission give them the opportunity to get the Association members together to prepare an intelligent presentation. Myrtle Aarons, 1340 Fairway Drive, said Kathy Rogers was in Europe when the EIR was mailed to her and apparently her teenage sons "buried it" and just a week ago when she spoke to Mrs. Rogers and asked her what was happening, Mrs. Rogers said she had not heard a thing. Planning Commission Minutes June 3, 1985 Page ~Fi ve David Hamill, 1136 East Rosewood Avenue, said he was given the site plan. He asked for the price range of the proposed units and that the western triangle of the area be kept as a park or greenbelt. He said he is not opposed to the development; in fact, he is g1 ad to not have the golf course which has been a nuisance. Cecil Pumphrey, 1422 East Chalynn, said he was not. contacted by Century American and thinks this is an attempt to railroad the prpject past the homeowners without their having an opportunity to get together and respond. He asked how many acres in th® phoject will be built upon after the creek area .has been subtracted from the total acreage and what the resultant density will be. Arnold Pearlman, 1337 East Fairway Drive, said approximately a year ago, in response to a notice from Century American, he wrote a letter with questions about the development, with copies to the ® Planning Commission and City Council, and received a very innocuous answer from Century American. He wrote again and got no answer. He attended the November meeting, at .which time Century American said the questions of the .homeowners would be answered in personal interviews. and discussions would be held, but this did not transpire. He said the notice and site plan he received in May was reduced to the point of being almost unreadable, and that he was home at the time it was delivered and no attempt was made to discuss it with him. He requested that this matter be continued so the homeowners can get together to make a presentation. Paul Belden, owner of the property, said it was important to his family to pick the right developer for thier property and they feel that have it in Century American. Mr. Cottle said he feels Century American is very concerned and sensitive to the feelings of the neighbors and what the impact will be on them. He feels Century American has extended itself this time in doing things it has never done before, such as going door-to-door and mailing things out. He thinks that perhaps the neighborhood feels this is Century American`s responsibility and a1 so should give everyone a copy of the EIR, but it is not up to them to do this. He said Mrs. Rogers was at home when he walked the area and distributed the site plan; also she called his office after looking at the site plan because she had some questions about it, so she should not have told Mrs. Aarons just a,~~week ago that she had heard nothing. In response to Mr. Hamill and Mr. Pumph~rey, he said the average price will be about $130,000 and the density for the whole area is 8.6 dwelling units per acre and after the creek bed is deducted the density will be 10.2 dwelling units per acre; they started with 26.35 acres and will end up building on 14.35 acres. Jack Tyson, 1047 East Fairway Drive, repeated that at the November meeting with Century American the homeowners were told there would Planning Commission Minutes June 3, 1985 Page Six be a get-together with them, en masse; then, when someone came around and gave him the letter and site plan, he was told that again,-that before the project came before the Planning Commission there would be a meeting between Century American and. the home- owners. When he received no notification of this meeting, he called the Century American office and was assured there would be a meeting. He said he feels this is the point that is being missed in this dis- cussion, that there never was a meeting even though the homeowners were repeatedly assured there would be a meeting. He said he feels the homeowners should have the opportunity to get together with Century American and discuss the project before it is before the Planning Commission and, in fact, the site plan distributed to the homeowners has so little detail that they really don`t know what it is they are faced with. He said he was told they had no completed plan because it was expensive to do that, that they would like to get the matter before the Planning Commission and then they would get into the details of the plan; consequently, it seems to him that it is premature to pass on these issues at this meeting. Mr, Cottle reiterated his previous statements regarding Century American's calibre of work and its plans and said he spoke to half of the 55 families who reside adjacent to the golf course. Mr. Pumphrey said the Planning Commission is supposed to represent the citizens of the City of Orange and therefore should grant their request fora continuance. Chairman Master declared the public hearing closed. Commissioner Mason said she received the EIR just Thursday evening herself so she only had a chance to read through it as thoroughly as she could in the period of time since then but it would appear to her that all of the questions and conberns~;,of the homeowners are answered in it; however, %t is unfortunate that the one sent to Mrs. Rogers, which should have been made available to the homeowners,-was not passed on to them; had Mrs. Rogers called a meeting of the SCHA when the EIR was received and had. a study group go through it and answer the concerns of the homeowners,-then all of their questions would have been answered before this hearing,-as they should have been. She said she feels that their having a meeting on June 27 is too far in the future and she thinks they should have it much sooner than that. She said she would like to see this matter continued to give them time to prepare a response, but continued only for two weeks, during which time they could obtain copies of the EIR and get their questions answered. Mr, Spring responded that June 27 was the first available date to use the Civic Center Council Chambers for the SCHA meeting. Chairman Master suggested they use another facility; Mr. Spring said the notice of the June 27 meeting at this location has already been sent to the homeowners. Commissioner Greek said he was a little upset to see that there were so many meetings over a period of a year and a • Planning Commission Minutes June 3, 1985 Page Seven half and yet the homeowners were not contacted by Century American and no discussions were held with the Association. He said he reads blueprints fora living and he had difficulty determining the setback and the size of the units, so he feels it is not unreasonable for the homeowners to request a continuance since it is apparent a lot of questions have not been answered. He asked Mr, Lane for how long this matter could be postponed. Mr. Lane said there is no time limit. C'J E~ Moved by Commissioner Greek, seconded by Commissioner Scott, that this item be continued until the meeting of July 15, 1985. Mr. Cottle said he is agree~ble,to a continuance but not for 45 days and suggested other places for SCHA to meet prior to June 27. He offered to meet with the homeowners as early as tomorrow. Commissioner Greek said his concern is why hasn't Century American met with the homeowners up to now, and said that is one of the things that should have been done, so her feels it is not unreasonable for them to have two or three weeks to get their concerns together to present to the Planning Commission. Chairman Master reopened the public hearing. Mr. Cottle said Century American has met with the homeowners, that when he contacted Ralph Masek, who told him he was acting president of SCHA, and set up the November meeting, he told Mr. Masek that it was to be an open invita- tional meeting. However, Mr. Masek said he wanted certain members only to be present as a hand-picked group to represent the entire Association; therefore, Century American thought, from Mr. Masek's statements, that he and the narle~or ten.-others:present'at the November meeting were representing the entire Association and that what was discussed at that meeting was then. relayed to the entire Association. Also, when the City of Orange sent a copy. of the EIR to the president of SCHA, Century American assumed it would be relayed to the entire Association. He said it is not Century American's fault, or the fault of the City of Orange, if the SCHA president was out of town and her children lost the EIR and she didn`t see it, or that Mr. Masek `s halr~d- p:icked:~.group of .representatives at the November meet%ng didn`t relay the outcome of that meeting to the others i_n the Association. He said Century American would like SCHA to meet prior to the Planning Commission June 17 meeting so this matter can be heard on June 17, Chairman Master asked Mr. Cottle if Century American could assist SCHA i_n finding a p1 ace to meet prior to June 27, if indeed the Association could meet before then. Mr. Cottle-said he though SCHA could meet at Chapman College and he wi11 arrange a meeting for whenever Mr. Clements thinks he can get the homeowners together. Mr. Clements said he thinks he can arrange to have the meeting by ~~une 5, Commissioner Greek withdrew his original motion Moved by Commis- sioner Greek, seconded by Commissioner Scott, that this matter be continued to the meeting of July 1, 7985, Planning Commission Minutes June 3, 1985 Page Eight AYES: Commissioners Master, Greek, Mason, Scott NOES: None ABSENT: Commissioner Hart MOTION CARRIED IN RE: NEW HEARINGS ZONE CHANGE 1034, TENTATIVE PARCEL MAP 85-240, CONDITIONAL USE PERMIT 1428 - KNOWLETON INDUSTRIES Zone Change from R-1-7 to RM-7, reconfiguration of two parcel boundaries and Conditional Use Permit to allow the development of a two-story, 28,625 square foot mini-warehouse on the east side of Orange Olive Road, approximately 500 feet north from Heim Avenue. NOTE: Negative Declaration 983 has been prepared for this project. Mr. Lane made the presentation in accordance with the Staff Report and said Staff recommends approval subject to the 28 conditions in its report. Commissioner Greek asked if by approval of this would the Punning Commission be creating a standard lot on Delta Street. Mr. Lane said he believes it's a little bigger than the 7,000 square ® foot minimum. Commissioner Greek asked if there would be a problem Commissioner Mason said she would th on one side with the 80' de . p like to see some sort of a plan that shows where the buildings are going to be located on the property and where the house is going to be moved in relation to the mini-storage warehouse. Mr. Lane said Staff does not have the information as to where the house will be located on Delta and that the applicant may not even be involved in the relocation of the house; however, it would have to comply with the building setback requirements and all the other development standareds in the R-1-7 Zone. He said the Code requires a minimum lot depth of 100'- and if that lot is on the cul-de-sac as it shows on the parcel map, it has only an 80`± dimension on the north side, although it does have a 100' depth on the south side. Chairman Master opened the public hearing. Grant Wise, representing Knowleton Industries, 881 Dover, Newport Beach, said they have reviewed this with Planning Department Staff according to multiple residential standards to conform to proper setbacks and have kept the height of the building the same as normal two-story family residences. Also, regarding moving the existing home back to the other property that they are trying to subdivide, the owner of that property will conform to all the zoning requirements and as far as the lot line is concerned, he feels there are other parcels in that area that have a non-conforming lot line that is a little bit smaller. Commissioner Greek asked what the easterly elevation of the project is going to look like. Mr. Wise said it will be 6` split face block wall, heavily landscaped, with a 10' rear yard setback. Bob Bennyhoff, 10642 Plirada Drive, Orange, said the City Council Planning Commission Minutes June 3, 1985 Page Nine decreed that mini-warehouses cannot be built in a single-family residential zone and if single-family residential is going to be rezoned multiple to get around that "there`s going to be a war ~~ because we 11 change that ordinance again. Chairman Master said the property along Glassell was R-1-7 at one time, including the telephone company property,. and was found generally unsuitable for R-1-7, so zone changes have been made along there and the change to R-M-7 is not really out of order. Commissioner Mason quoted from the Land Use Element of the General Plan, page 49: "While no residential building site should be created with frontage on an arterial highway, those which are developed on arterial would most likely be multi-family." Therefore she feels this particular street fits into this category. Chairman Master said he is concerned as to whether or not the setbacks meet the requirements of the R-M-7 Zone. He said he thinks there is a lack of sensitivity to the impact this may have to the adjacent single-family residences on the north • and east since they will probably never go commercial because they are residential in character and on cul-de-sac streets. Commissioner Mason said that Item 7 of the Land Use Element of the General Plan states from the Design Review Board that when it is in a residential area it desires high quality appearance for such developments; there- fore, she shares Chairman Master's concern with. having a tall building ~ so close to a single-story residence~~. Mr. Wise said Knowleton Industries is not opposed to putting any elevation desired on this particular project; that it felt this type of elevation would be the best for that particular area because it is believed that that side of Orange Olive will be developed commer- cial some day. However Knowleton would have no problem putting some kind of a residential look on the project; in fact, it would save money to do so. He said he feels the setbacks are more than adequate and have reviewed them with Planning Department Staff. Knowleton feels there is a need for mini-storage in this area and is willing to do anything that is called for to accomplish it. Warren Hollabaugh, 2560 belta, said his property is right behind this property and he is very pleased with what he has heard about this proposed development~~benause it will protect his property from the traffic on Orange Olive Road as we17 as shield it from the rail- road tracks. He said the 10' setback is .great because it gives him more privacy in his back yard; it is preferable to having a two-story house adjacent to his property. Chairman Master declared the public hearing closed. Commissioner Greek again asked if the Planning Commission will be developing a legal lot on Delta. Mr. Johnson said it appears to him that lots like this are subject to some interpretation, but the fact is that if the minimum dimension of that lot is 100'- by Code, then it needs a variance. He said it appears that the intent was to create a lot line as a prolongation of the existing lot line so there would not be a jog in the property line. Commissioner Greek pointed out that Planning Commission Minutes June 3, 1985 Page Ten if the Planning Commission creates a lot that's less than the minimum depth of 100` called for by the Code, it will be creating a non-buildable lot; he said he`s not opposed to it but if some- thing illegal is created then the problem of illegality should be solved also. Chairman Master reopened the public hearing. Alberta Dennis, 2587 Orange Olive Road, said she owns the house and back on Delta it is a little shorter on the north side because she had to dedi- cate part of the lot to the City in order to get the cul-de-sac. She said she does have almost 8,000 square feet in her lot and will be moving her house back there. Commissioner Greek pointed out that the Zoning Code requires that in R-1-7 zoning the lots have to be 70' wide and 100' deep, but that doesn't mean that a variance can't be made. Mrs. Dennis kept insisting that she had more than the 7,000 square foot required minimum and the reason one side was only 80` was because she had to dedicate a portion of the lot to the City; she couldn`t seem to understand either Commissioner Greek or Chairman Master when they tried to explain the Code requirements. Finally, Chairman Master requested that the Planning Department initiate a variance to take care of the .matter. Mr. Lane said if ..the Planning Commission's decision is to act favorably upon the application, it will have the tentative parcel map which in effect will create the. parcel shown and would in effect by a de facto action be granting a variance to allow the depth along the north online to be less than the 100' required by Code:, and since the squa re footage of the property is more than the minimum 7,000 square feet required, there is no problem with that; so, in effect, if the Planning Commission approves the parcel map, it is approving the variance and not creating an illegal lot. He said the alternative would be to inform the developer to file an appli- cation fora variance, and pointed out that this should have been caught and done in the first place; however, he feels it won`t serve any useful purpose at this point. Commissioner Greek asked if the Planning Commission can approve a variance without a public hearing; he suggested that it would be better to do it correctly at the next meeting. Mr. Minshew advised requesting the variance and having it approved. Mr. Lane said in that case the continuance would have to be for more than two weeks to allow time for the legal notice to be published. Mr. Wise was asked if he understood what was being discussed and he said he did and would concur with a continuance to July 1. Chairman Master declared the public hearing closed. AYES: Commissioners Master, Greek, Scott, Mason NOES: None ABSENT: Commissioner Hart MOTION CARRIED Planning Commission Minutes June 3, 1985 Page Eleven IN RE: TENTATIVE TRACT 12434, CONDITIONAL USE PERMIT 1431,- STOVALL AND O'CONNELL Proposed conversion of a 30-unit apartment complex into a 30-unit condominium development on 2.14 acres on the north side of Fletcher Avenue, approximately 850 feet east from Batavia Street. NOTE: Negative Declaration 986 has been prepared for this project. Commissioner Greek excused himself due to conflict of interest. Mr. Lane made the presentation in accordance with the Staff Report and said Staff recommends approval subject to the seven conditions in its report. Chairman Master opened the public hearing. Ward Dawson, 2808 East Katella, Orange, architect for Stovall and O'Connell, said they concur with all conditions in the Staff Report. ® Chairman Master declared the public hearing closed. He said he attended the Eastern Corridor presenta- tions, both here and by the County, and found no reference to the impact on Loma and vice versa; therefore, he feels a comment should be passed on to the consultant that he address this matter, i.e., the Eastern Corridor and its relationship with Loma Street. Planning Commission Minutes June 3, 1985 Page Twelve Moved by Chairman Master, seconded by Commissioner Scott, that an official communication be made to the consultant who prepared the Loma Street Project Environmental Impact Report to inform him that the Planning Commission is concerned about the need for some quali- tative statements in the Environmental Impact Report about the implications of the construction of the Eastern Corridor on the Loma Street alignment. AYES: Commissioners Master, Greek, Mason, Scott NOES: None ABSENT: Commissioner Hart MOTION CARRIED Mr. Bennyhoff requested that Weir Canyon be included in this along with Loma Street. Chairman Master amended his motion to include Weir Canyon Road; this was acceptable to Commissioner Scott who, seconded the motion and to Commissioners Greek and Mason. ® Commissioner Mason asked Mr. Lane if the General Plan has been kept up to date and said she would like a Study Session on the General Plan. Mr. Lane said the General Plan does have all the elements required by law but whether or not it meets the guide- lines for preparing general plans as squired by the State Office of Planning and Research is a value judgment; however, the City has not been challenged in a court on the validity of the General Plan. He said a comprehensive review and update has not been done since the General Plan was prepared. He said the City Manager has just approved in the preliminary budget the alloca- tion of $25,000 to hire a consultant to redo and update the seismic element of the General Plan but as far as the rest of the elements are concerned there is no immediate effort to update them except the housing element and that is presently being done in-house by Staff and has been in process for about a year. Commissioner Greek suggested asking Bert Yamasaki to give the Planning Commission a status report and then set up a Study Session; Commissioner Scott suggested that if Mr. Yamasaki thinks this will be too much to cover in one session, it could be done in two sessions. Mr. Lane said he feels such a Study Session would be beneficial for the entire City Staff. Chairman Master asked Mr, Lane to contact Mr. Yamasaki and set things up with him for a possible Study Session on June 24 if that is okay with him. Commissioner Greek sai d he noticed the City Counci l had created an 1~.~`~F ~~~~=` emergency ordinance for TV antennas and he wondered who initiated this and if the Planning Commission should be doing something. about it since the matter had come before the Planning Commision some time ago and had not been resolved. Mr. Lane said that about six or eight weeks ago a Mrs. Creighton appeared before the City Council and complained about a satellite dish antenna in her residential ® neighborhood.. As a result the City Council directed Staff to look into the matter and recommend regulation for satellite dish antennas, and Staff is in the process of doing this. ,~,.~_ Planning Commission Minutes June 3, 1985 Page Thirteen r1r. Lane said subsequent to that action, within the last four weeks, a Mrs. Janet Johnson complained to the City Council about a ham radio operator in her neighborhood who has three elaborate and large radio antennas in his yard. It was discovered that this man had filed a variance for these antennas three years ago and it was approved at a public hearing. However, Mrs. Johnson pursued the matter and this City Council agreed with her and took action to rescind the variance and tell the property owner to get rid of the ham radio antennas. He said that as a result of this, the City Attorney decided it would be appropriate to adopt an interim emergency ordinance to severely restrict ham radio operators and in so doing he included satellite dish antennas in the same ordinance. At present Staff is preparing an amendment to the Code to deal with satellite dish antennas and a separate amendment to the Code to reconsider the ham radio tower portion of the Code because those are already controlled in the Code. He said Staff agreed it would return to the Planning Commission and the City Council with the ham radio pori7ion first and then the satellite dish antennas so they are not set for the same public hearing. Both are in process now and it is hoped to have the pre- liminary draft on the ham radio antennas done this week and the one on satellite dish antennas shortly thereafter. Commissioner Greek asked if it would be reasonable to limit the size of the plans that are. submitted to the Planning Commission because those that are extremely large are difficult to handle. Commissioner Scott interjected that those that are too small are difficult to read and understand, It was agreed that it would be appropriate to set both maximum and minimum sizes. Mr. Lane commented that there are other facets of the plansthat art ubmitted that could be changed to make things easier for both Staff and the Planning Commission, not only the size, and suggested that Staff prepare a 'list of things that it feels would aid both Staff and the Planning Commission, said list to be approved by the Planning Commission and then published as a requirement for submittal of plans in the future. Chairman Master asked when was the last time the. land use element of the General Plan was updated. Mr. Lane said the land use element went through an agonizing appraisal during the proposed downzoning of West Orange which included everything west of Cambridge and south of Collins, which was around 1978, but actually that was not a compre- hensive reevaluation of the land use element. He said he believes it has never been looked at in its entirety. Commissioner Mason requested that when there is an Environmental Impact Report in the packet given to the Commissioners „ she would appreciate receiving the packet earlier so she has time to study the EIR and prepare for. the meeting. Mr. Lane said that in order to do this it may be necessary to amend the filing instructions and set earlier deadlines for submittal. Commissioner Mason suggested addressing this matter at the Study Session on the General Plan and Planning Commission Minutes June 3, 1985 ~'~ Page Fourteen if a change is recommended then it should be done. Mr. Lane said in the future the Planning Commission wi17 receive copies of the draft EIR and not have to wait for the final EIR.
