ORDINANCE AMENDMENT 2-89 - CITY OF ORANGE:
A memo was submitted to the Commission requesting a
continuance to June 19, 1989. The landscape portion of the
grading ordinance is not in a form to be acted upon at this
time; however, the grading portion of the ordinance is.
Moved by Commissioner Scott, seconded by Commissioner Hart,
that the Planning Commission continue Ordinance Amendm?nt
2-89 to June 19, 1989 until the landscape ordinance is
completed and the Commission has an opportunity to review
it.

ITT RE: CONTINUED HEARINGS
CONDITIONAL USE PERMIT 1759-89 - REORGANIZED CHURCH OF
JESUS CHRIST OF LATTER DAY SAINTS:
A proposed Conditional Use Permit to allow establishment of
a pre-school at an existing church site on R-3 zoned
property located on the east side of Tustin Street, 500 feat
south of Palmyra Avenue, addressed 395 South Tustin Street.

NOTE: Negative Declaration 1290-89 has been prepared for
this project.
This item was continued from the May 15, 1989 Planning
Commission Meeting.
Mr. Godlewski informed the Commission of additional
information received pertaining to Conditional Use Permit
1759-89. In the May 23 memorandum, it outlined the fact
that the leases for tenant parkinq on the property run on 30
day terms that can be cancelled by either party with 30 day
notice. It is also noted that the agreement with the auto
repair building next door has been cancelled as of May 16,
1989 and they should be off the property by June 16. On the
second page of the memo there is an outline of the actual
number of parking spaces and uses for the Church.
Commissioner Scott, in reviewing the site, realized that
unless properly fenced to prohibit the intrusion on the
neighboring businesses to continue using that lot, he felt
the C.U.P. should be revoked until sur_h time they are
prevented from using the temporary parking lot.
Chairman Bosch's thoughts were by not allowing the occupancy
permit until some standard of barriers could be built. He
wanted the applicant to address this issue.
Gail Biller, 18732 Fairwood Lane, Santa Ana, stated they had
plans, as soon as the property is cleared, to bull doze it
and put in a sprinkler system and grass. There is a group
of people meeting within the Church to see what is the best
use for the development of that land. A decision should be
made in the near future.
Commissioner Scott asked if she would be opposed to
restricting the occupancy until the time the lot is secured?
Ms. Biller did not oppose; they could handle that.
Chairman Bosch noted, in reviewing the conditions, that
under Conditions 3-5 which relate to the Crime Prevention
Bureau and Building Security Standards, one standard is not.
specifically named that is required by the Building Security
Ordinance. It is with reference to the existing lighting to
be upgraded or should be in compliance with Ordinance 7-79
prior to move-on. He suggested adding that to the motion as

Scott, that the Planning Commission accept the findings of
the Environmental Review Board to file Negative Declaration
1.290-89.

Moved by Commissioner Master, seconded by Commissioner Hart,
that the Planning Commission approve Conditional Use Permit
1759-89, subject to the conditions listed in the staff
report and with the added condition that requires the
erection of barriers approved by the Department of Public
Works to prevent vehicular access onto the unpaved lot and
posting of signs prohibiting parking, as well as adding the
lighting requirements. Also, add a condition to construct,
restore or maintain, as required by previous permits, a
block wall fence along the northerly property line of the
vacant lot adjacent to Orange Engine and a non-climbable,
see-through design fence, acceptable to the Police
Department, along the Tustin Street frontage.

Commissioner Greek questioned the perimeter fencing in Item
5 -- it needs to be more specific. His concern is that
since the adjacent lot is considered part of the property,
even though it is a separate parcel, the fencing should be
along Tustin Street.
Mr. Godlewski stated the Police Department is not actually
requiring fencing be located anywhere, but the condition
only says that any perimeter fencing shall be of a
non-climbable design.
Commissioner Greek would like to revise the condition to
indicate the perimeter fencing be along the Tustin Street
frontage.
Ms. Biller explained the lot being discussing, facing
Tustin, the unpaved area is bordered by Tustin and on the
far side is Orange Engine. There is no fence there. They
would be glad to put up a fence along the property line.
There is a block wall fence enclosing the rest of the area
going back to the river bank area., to the back and along
side the Care Unit and fencing up to the entrance of the
driveway.
Commissioner Greek would like to see a condition as part of
the motion that the fencing be installed along the northerly
property line and westerly property line along Tustin
Street. It would preclude that vacant lot from being used
as a parking lot.
Chairman Bosch, in response to Ms. Biller, thought the block
wall along the northerly boundary and then the non-climbable
metal fence design on Tustin would be fine.

IN RE: NEW HEARINGS
CONDITIONAL USE PERMIT 1762-89 - INDEPENDENCE CHRISTIAN
SCHOOL:
A proposed Conditional Use Permit to allow the addition of a
pre-school to an existing church school on property zoned
R-1-8 located on the south side of Meats Avenue between
Tustin Street and Park Lane, addressed 1820 East Meats
Avenue.
NOTE: Negative Declaration 1291-89 has been prepared for
this project.
There was no opposition. Mr. Godlewski explained the
applicant has two existing Conditional Use Permits on the
property; one for the original church school, and another
one for a large addition to the facility which was only
partially built. In addition to that, they are requesting
the addition of the pre-school on the site. The existing
church and school has a parking requirement for 63 parking
spaces. Sixty-five parking spaces are provided on the site.
The evaluation of the daily code requirement for parking is
in the staff report, Page 3.
The public hearing was opened.
Applicant
Ross Boydell, 1125 East Mayfair, represented the church. He
felt there was an obvious need for this type of facility
within the City of Orange. He spoke about Condition 1 in
regards to that piece of property deeded over when Target
was built. That property contains the major access to the
church. He referred to the staff report, Page 2, Item 7,
that the Public Works Department indicated this parcel may
be sold at some future date. Staff indicated to Mr. Boydell
that since that piece of property originally belonged to the
church, that the church would have first option to get it
back. There is another driveway up on Park, but this is the
main driveway for the church.
Commission wanted Mr. Johnson to elaborate on the piece of
property being referred to for the record.
Mr. Johnson has not done a title search on the property.
The reason why the right-of-way exists is because it was
part of the realignment of access point on Meats in
conjunction with the development of Target. This property
was originally bought by the State and turned over to the
City, with some strings attached. It was bought for highway
purposes and should remain as a highway. There is very

little chance that since the State bought the property, that
it would be returned to the church. His understanding is
that the property was acquired in fee by the State and
turned over to the City subject to a director's deed.

Commissioner Greek would like a condition added that the
parking lot be constructed or upgraded to current City
standards. It needs landscaping and the lighting needs to
be upgraded as part of Condition 8.
Commissioner Scott stated, in reading the staff report,
staff recommended the landscaping be deleted because i.t is
being used as a playground and is so striped.
Chairman Bosch thought the intent of staff was because there
was more than enough excessive landscaping elsewhere on the
site, it more than offsets the negative impact of lack of
landscaping distributed throughout the parking area. The
multiple use, therefore, is something that does not cause
detriment to the property.
Commissioner Greek felt there should be consistent
standards.
Chairman Bosch wanted to encourage staff on the upgrading of
the zoning ordinance this year to more stringently codify
continuity of standards across all uses. Then, have a
method of enforcing it after a project is built.

IN RE: MISCELLANEOUS
ADMINISTRATIVE ADJUSTMENT 89-11 - Request to approve the
temporary installation of a cellular phone antenna and relay
switching facility at 1920 East Katella Avenue.
ADMINISTRATIVE ADJUSTMENT 89-12 - Request to approve the
temporary installation of a cellular phone antenna and relay
switching facility at 1922 East Chapman Avenue.
These two items were brought before the Zoning
Administrator, but because a Conditional Use Permit of a
similar nature was previously before the Planning
Commission, the Zoning Administrator felt it best a decision
be made by the Commission. Both are requests from PacTel
Cellular to install temporary cellular telephone relay
stations in the City. The importance of coming before the
Commission was made known to PacTel at their earlier C.U.P.
application and they are now bringing in the Administrative
Adjustme nts in order to be in compliance with the City
codes.
Commissioner Scott asked if a permit was required when
installing a 60 foot wooden pole?
Mr. Godlewski said there was a debate on that and he was not
the authority at this point to answer that. He was advised
that the wooden poles do not require a permit, but that was
from the applicant. In response to the question of
temporary utility poles requiring a permit, it was his
understanding that they do not and these fall into that
category. Temporary power poles, however, do require a
permit.
Commissioner Greek asked if the P.U.C. had been contacted?
Mr. Godlewski stated a request has been sent to the P.U.C.,
but they won't have a response back until the C.U.P.,
previously looked at, comes back to the Commission.
Commissioner Scott thought they requested a response from
other cities on how they handled this regarding location,
permits, etc.
Commissioner Greek said there needed to be some process for
these types of uses. They are a dangerous structure and
need to be inspected for proper construction. He prefers to
wait for additional information before action is taken.
~~Ir. Godlewski clarified that these two requests are for
temporary facilities. If they decide to put in a permanent
facility, the applicant understands a Conditional Use Permit

before the Planning Commission is required before a
permanent facility can be placed there. Staff is still
looking into Commission's previous requests.
Commission felt some kind of permit needs to be issued for
this type of use.
!4oved by Commissioner Scott, seconded by Commissioner Greek,
that the Planning Commission continue these Administrative
Adjustments for 30 days or until the first meeting in July,
at which time the answers can be acquired by staff to answer
Commission's concerns. Staff to report on what action must
occur or can occur, or can the Commission recommend to
Council if in fact they don't have recommendations that lead
to final action by that time.

Moved by Commissioner Hart, seconded by Commissioner Scott,
that the Planning Commission adjourn to a study session on a
proposed development - Hewes Park - 11:30 a.m., June 12,
1989 at the site on Esplanade, north of LaVeta; then adjourn
to a study session with City Council on the Irvine Company
East Orange Update, 7:00 p.m., Conference Room "C", same
date.
