PAlUtBR STREBT.Conditional Use Permit 1913-91 Social Hodel Recovery systems, Inc.)WHEREAS, the City Planning commission of the city of Orange did receive an application for a conditional use permit from Social Model Recovery Systems, Inc. upon certain real property located within the City of Orange, legally described as follows:Lots 17 and 18 and the South 80 feet of Lot 19 of Tract No. 749, as per map recorded in Book 22,Page 16 of Miscellaneous Maps, in the office of the County Recorder, Orange County, California; and.WHBREA8, the City Planning Commission did hold a public hearing upon said application at the Civic Center in the city of Orange, notices of which public hearing were duly given as required by law; and WHBREAS, said Commission, after due inspection,investigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. PC 24-91 Conditional Use Permit No. 1913-91; and WHBREAS, thereafter, within the time prescribed by law, an interested party caused the review of said Planning commission action at a duly noticed public hearing; and WHBREAS, at the time and place fixed for said public hearing, the city Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHBREAS, the city Council finds, after careful consideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that:1. The proposed project provides a service required by the community in keeping with sound land use principles.2. The project will not cause a deterioration to bordering land use or create special problems in the neighborhood.3. The project is in conformance with General Plan land use goals for the site.4. Conditions have been included in the project which preserve the general 5. The project is categorically exempt from the provisions of California Environmental Quality Act (CEQA) pursuant to section 15301 of the CEQA Guidelines. NOW, THBREFORE, BB :IT RESOLVED by the City Council of the City of Orange that, for the reasons hereinabove stated, the action of the City Planning Commission granting said conditional use permit be, and the same is hereby upheld and that Conditional Use Permit No. 1913-91 be, and the same is hereby, granted permitting an adolescent residential treatment facility in the R-3 (Residential Multiple Family) zone on the hereinabove described real property, subject to the following conditions:1. Construct a 6 foot high block wall along the north and south property lines replacing the existing chain link fence. 2. site.The project is limited to one company vehicle based on 3. The company vehicle based on site must be able to park on site without extending into required drive aisles.4. Program participants shall not be permitted to bring personal vehicles to the site.5. Program participants shall not be permitted to leave the facility without being accompanied by a facility staff member or adult guardian.6. Submit a copy of required State license allowing operation of an adolescent alcohol treatment facility prior to building occupancy for inclusion in this file.7. All structures shall comply with the requirements of Municipal Code Chapter 15.52 (Building Security standards, Ord.7-79), which related to hardware, doors, windows, lighting, etc.Approved structural drawings shall include sections of the security code that apply. Specifications, details, or security notes may be used to convey the compliance. This will be reviewed in a plan check by the Crime Prevention Bureau prior to approval.8. Existing hardware shall comply with, or be upgraded to meet current building security standards.9. Existing lighting shall comply with, or be upgraded to meet current building security standards.10. An illuminated address of 6 inches in height is required. Shall be contrasting in color to the background and visible to approaching vehicles (location to be determined during the plan check process).11. A maximum of 24 program participants are permitted to reside on sited.Reso No. 12. Final plans shall indicate compliance with trash enclosure standard plan no. 409. 13. Payment of a TSIP fee as required by city ordinance. 14. An approved fire sprinkler system must be installed throughout the building per Orange Municipal Code 15.32.080 section 10.306(a). The system shall be designed per N.F.P.A. 13, U.B.C. Chapter 38 and U.B.C. Standard 38-1. The sprinkler system requires 24 hour supervision (back building only).15. The Fire Department connection shall not be affixed to the building. The Fire Department connection must be located at least 40 feet away from the building, within 40 feet of a fire hydrant, and on the address side of the building.16. Provide on-site fire hydrant(s) and mains capable of supplying the required fire flow. The hydrant model and on-site location shall be approved by the Fire Department and have a three (3) foot minimum clearance around the circumference of the fire hydrant. the on-site hydrants shall not be controlled by the control valve (P.I.V.) for the sprinkler system so that water flow to hydrants is not impaired should the sprinkler system be shut down for any reason. U.F.C. 10.206 and 10. 301 Plans must be submitted to the Building Department.17. The number of required hydrants will be determined when the location of existing hydrants are indicated on the site plan.18. Approved numbers or addresses shall be placed on the building to be plainly visible and legible from the street or road fronting the property and contrast with their background.Addressing must comply with Orange Municipal Code section 15. 52. 19.for every distance.One 2A 10BC rated fire extinguisher 3000 square feet of the building or U. Use of the property by Social Model Recovery Systems,Inc., shall continue unless the operator is found to be non-compliant with these conditions or until such time social Model Recovery Systems, Inc., no longer 25. Upon presentation of evidence to the City that additional off site parking has been secured, the applicant may modify the site plan to allow angle parking, thus permitting retention of an existing block screen wall and saving existing Ficus trees. BE IT FURTHER RESOLVED that the City Council does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such conditions, or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void.
