A RESOLUTION OF THB CITY COUNCIL OF THB
CITY OF ORANGE SUPPORTING THE ORANGE
COUNTY TRANSPORTATION COMMISSION'S
STRATEGIC PLAN TO BXPEND MEASURE "K"
FUNDS FOR FULL RIGHT OF WAY ACQUISITION
FOR WIDENING OF THE INTERSTATE 5 FREEWAY
BETWEEN STATE ROUTES 22 AND 91 AND TO
ACCELERATB ACQUISITION OF CERTAIN PARCELS
LOCATED WITHIN CITY BOUNDARIBS.
WHEREAS, the Interstate 5 Freeway was initially
constructed in 1956 and was last improved in 1964; and
WHEREAS, a Record of Decision relative to the
Environmental Impact Report was entered in June, 1991, to
allow the widening and improvement of the Interstate 5
Freeway; and
WHEREAS, the right-of-way acquisition
for this improvement requires the full or partial
acquisition of approximately 600
parcels; and WHEREAS, the parcels continue to increase in value
at a rate which may render acquisition financially
infeasible in the future if acquisition is
delayed; and WHEREAS, section 100.21(b) of the streets
and Highways Code allows the purchase of parcels contained
within the main line corridor of the proposed freeway,
provided that the alignment of the freeway is not at issue,
upon adoption of a resolution by the city council of
the
affected municipality.NOW THEREFORE, BE IT RESOLVED BY THE CITY
COUNCIL OF THE CITY OF ORANGE
AS FOLLOWS;1. That the Orange County Transportation
Commission be encouraged to expend funds as identified in the
Measure "M"strategic plan for the accelerated acquisition of
parcels in connection with the widening of the Interstate
2. That the state of California, Department of
Transportation (Caltrans) be authorized to acquire parcels
as provided in section 100.21(b) of the Streets and Highways
Code.
