A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE ADOPTING THE CITY OF
ORANGE MITIGATION MONITORING PROGRAM
MANUAL (1991)
WHEREAS, the State of California has adopted Assembly Bill 3180, which mandates
that each city adopt a program for monitoring environmental mitigation measures adopted in
accordance with the California Environmental Quality Act for the approval of any development
project to assure compliance by the developer; and
WHEREAS, the City of Orange has adopted Ordinance No. 22-91 which
requires compliance with the City of Orange Mitigation Monitoring Program and the regulations
set forth in the program Manual as adopted by resolution from time to time by the City
Council;
and WHEREAS, the protection of the environment by assuring compliance with
mitigation measures so adopted is of great importance to the City of Orange and its citizens;
and WHEREAS, the proposed City of Orange Mitigation Monitoring Program
Manual 1991) contains requirements and procedures which will help assure that mitigation
measures are complied with in the City;
and WHEREAS, it is the public policy of the City of Orange to take all
reasonable measures to ensure compliance with all environmental mitigation measures imposed upon
any development project in the
City.NOW, THEREFORE, BE IT RESOLVED, that the City Council of Orange
does hereby adopt the City of Orange Mitigation Monitoring Program Manual (1991) as the
official rules, regulations and policies of the City of Orange for the implementation of Ordinance
No.22-91 and Assembly Bill
No. 3180.RESOLVED FURTHER, that the Director of Community Development
is hereby authorized to take all actions necessary to implement and enforce the regulations
and policies contained in
said Manual.RESOLVED FURTHER, that the City's Master Schedule of Fees and
Charges is hereby amended to add the following fee for the Mitigation Monitoring Program
for projects approved based upon mitigated
negative declarations:Mitigation Monitoring Program Fee (Mitigated

RESOLVED FURTHER, that the Director of Community Development is hereby
empowered to determine the reasonable anticipated cost of monitoring the mitigation measures
adopted as to each project based upon an Environmental Impact Report and to require a deposit
of funds in the amount of that anticipated cost from each Project Proponent prior to the
granting of any approvals by the City to commence any work of development (including, but
not limited to grading permits and building permits). The Project Proponent shall be entitled
to accountings at reasonable intervals for the expenditure of such funds upon request. The
Director may require additional deposits as and when the Director determines such additional
deposits are reasonably needed to pay for anticipated costs of such mitigation monitoring for
the project.
