RES-7863 Denying Conditional Use Permit No. 1911-91RESOLUTION NO. 7863 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE UPHOLDING APPEAL No. 388 OVERRULING THE DECISION OF THE PLANNING COMMISSION OF THE CITY OF ORANGE AND DENY- ING CONDITIONAL USE PERMIT No. 1911- 91 TO ALLOW THE ESTABLISHMENT OF A RESIDENTIAL ALCOHOL AND DRUG REHABILITATION FACILITY WITHIN AN EXISTING BUILDING CURRENTLY USED AS PROFESSIONAL OFFICES UPON PROPERTY SITUATED ON THE CORNER OF CHAPMAN AVENUE AND GRAND STREET, (307 EAST CHAPMAN).CONDITIONAL USE PERMIT 1911-91 AL RICCI. APPELLANT RECITALS:After report thereon by the Planning Commission and after due public hearings as required by law, and after receiving a recommendation from the Planning Commission,recommending, by Resolution No. PC- 23-91, that Conditional Use Permit 1911-91 be granted to allow the establishment of a residential alcohol and drug rehabilitation facility within an existing building currently used as professional offices upon property situated at 307 East Chapman Avenue.The City Council Considered Conditional lUse Permit 1911-91 and determined that the decision of the Planning commission should be overruled and Conditional Use Permit 1911-91 be denied.During the public hearing, the City Council found the following facts:1. That the proposed use is inconsistent with neighboring land uses.2. That the proposed use would adversely affect surrounding properties due to inordinate traffic and parking requirements.3. That the proposed use is inappropriate for the site and existing building in that it would not provide adequate safety protection or outdoor recreation space for the children proposed to be housed there.NOW, THEREFORE, BE IT RESOLVED by the City Council of the city of Orange ADOPTED this 13th day of August, 1991.
