OF ORANGE AMENDING SECTION 3.13.060 OF
THE ORANGE MUNICIPAL CODE TO INCREASE THE POLICE

WHEREAS,
in July, 1989, the City Council adopted Ordinance 18-
89 to require that new development in the city contribute
fair share of the costs of the construction of the City'S
police headquarters facility and certain other improvements
additions to the Civic CenterJ and
WHEREAS, said ordinance did provide that such fees may be
increased by Resolution of the city council, and
WHEREAS, the city Council has determined that the fees
should be increased because of increased construction costs of
the new police headquarters facility and the related Civic
Center improvements, and therefore, the fee as currently
constituted does not fully reflect new development's fair share
of the cost of the new police headquarters facilitYJ and
WHEREAS, the General Plan sets forth the relationship
between new development and the needed facilities, and the
City's capital Improvement Plan gives the basis for estimating
the costs of those improvements not already incurred in the
construction of the new police facilitYJ and
WHEREAS, After considering the information contained in
the General Plan, Capital Improvement Program, the documentation
for the Certificates of Participation for the construction of
the new police headquarters facility, the Staff Report, and the
testimony received at this public hearing, the city council
finds that:
A. 'l'he purpose of!tWd fee is to recover new development's
fair,shate of.the cost of constructing the new police
headquarters facility, to mitigate the impacts caused by
and to service new development within the boundaries of the
city of Orange.

B. The fees collected pursuant to this resolution, shall
be used to finance exclusively the acquisition and
development of the new police headquarters and improvements
to existing Civic Center facilities as described in the
city's Capital Improvement Program, and to pay for new
development's fair share of the costs thereof.
C. The facts and evidence presented establish that there
is a reasonable relationship between the need for the
described public facilities and the impacts of the types of
developJllent described below, for which the corresponding
fee is charged, and, also there is a reasonable
relationship between the fee's use and the type of
developJllent for which the fee is charged.
D. The fees expected to be collected by the city of Orange
from any affected development project will not exceed the
total of those costs attributable to the impact of that
project.
NOW, THEREFORE be it resolved by the City Council of the
city of Orange that Section 3.13.060 is hereby amended in the
following particulars:
1. The new fee for New Residential Development shall be
354.89 per dwelling unit;
2. The new fee for New Non-Residential Development shall
be 206 per square foot of floor
space.BE IT FURTHER RESOLVED that the provisions of
this Resolution shall become effective 60 days after its adoption
as required by California Government Code Section
65962.BE IT FURTHER RESOLVED that any judicial action
or proceeding to attack, review, set aside, void or annul
this resolution shall be brought within 120
days.ADOPTED this 18th day of June
1991.
