WHEREAS, the City Council of the City of Orange certified
Environmental.Impact Report~o. 1278 (the "EIR") and adopted
the East Orange'General Pldn Amendment ("EOGP") on December
19, 1989, and' ,
WHEREAS, pursuant to the EOGP and the EIR, the City has
identified portions of that certain real property known as
Limestone canyon located in the unincorporated area of the
County of Orange as necessary for phased dedication to serve
as mitigation for impacts associated with development
pursuant to the EOGP and to serve for future public
recreation use and habitat mitigation and protection, and
WHEREAS, the City and the Irvine Company (the "Company")
entered into a Memorandum of Understanding (the "MOU") on
May 4, 1989 concerning the phased dedication of Limestone
Canyon to serve as mitigation for impacts from development
pursuant to the EOGP, the EIR and development of the Eastern
Transportation Corridor (the"ETC"), and
WHEREAS, a process for dedication of Limestone Canyon is
required by the state of California to be in place on or
before June 30, 1991 in order to secure certain funding for
the development of the Foothill and Eastern Transportation
Corridors, which is desirable to further the interests of
the City and the county, as well as the Company, and
WHEREAS, the Company has prepared and presented to the
city and the County, for review and determination of
consistency with the requirements of the EOGP and the EIR,a
document entitled "Limestone Canyon Irrevocable Offer of
Dedication" (the "Offer"), providing for the phased
dedication of the Limestone canyon Property to the County of
Orange.
IIOW, TOREPORE, BB IT RESOLVED that the City Council of
the City of Orange hereby finds that the terms of the Offer
in the form attached to this Resolution are consistent with
the EOGP, the EIR, and the MOU to the extent addressed
therein, upon condition that the implementation of the Offer
will be subject to further review and approval by the City
to determine whether each stage of proposed implementation
satisfies the requirements of the EOGP, the EIR and the MOU.
BB IT FURTHER RESOLVED, that the County and the Company
are authorized to record the Offer in partial fulfillment of
the requirements of the EOGP, the EIR and the MOU as to
Limestone Canyon dedications and as setting forth an
acceptable procedure for the final fulfillment of such
requirements, subject to the conditions set forth above.
