RES-7823 Approving Amendments to 1988 Orange County Hazardous Waste Management PlanRESOLUTION NO. 7823 A RESOLUTION 01' THE CITY COUNCIL 01' THE CITY 01' ORANGB APPROVING THE AMBNDMBNTS TO THE 1988 ORANGB COUNTY HAZARDOUS WASTB MANAGBMBNT PLAN. WHEREAS, the California state Legislature has declared that the safe and responsible management of hazardous wastes is one of the most important environmental problems facing the state at the present time; and WHEREAS, The California state Legislature has declared that a solution to the safe and responsible management of hazardous wastes requires an effective planning process that involves local and state governments, the public, and industry; and WHEREAS, the California state Legislature mandated local governments to develop comprehensive county hazardous water management plans pursuant to Article 3.5, Chapter 6.5 of Division 20 of the California Health and Safety Code (AB 2948 Tanner, 1986); and WHEREAS, on January 25, 1989,.. the County of Orange Board of supervisors adopted the. 1988 O~ange County Hazardous Waste Management Plan (OCHWMP), which provides countywide policy direction and action programs to address current and future local hazardous waste management issues and certified Final Program Environmental Impact Report (EIR #490); and WHBREAS, the City Council of Orange certified Final Program Environmental Impact Report (EIR #4890) and ratified the 1988 Orange County Hazardous Waste Management Plan at a public hearing held in April, 1989; and WHEREAS, on February 19,1991, the Orange County Board of Supervisors adopted the amendments to the 1988 Orange County Hazardous Waste Management Plan as prescribed by the state Department of Health Services which provides interpretation, clarification, and additional information on the existing plan; and WHBREAS, on February 19, 1991, in accordance with the Orange County Board of Supervisor's policies regarding implementation of the California Environmental Quality Act of 1970, the County of Orange as Lead Agency made a finding that Final Program EIR No. 490, previously certified on January 25, 1989, was determined adequate to serve as a program EIR for this project, and, therefore, satisfied all requirements of CEQA; and NOW, THBREI'ORE, the city Council of the city of Orange does hereby resolve as follows: SECTION 1: The amendments to the 1988 Orange County Hazardous Waste Management Plan are hereby approved. SECTXON 2: Ackowledge that the prov1s1ons set forth (as amended by Assembly Bill 2295) in Subdivision C of section 25135.7 of the California Health and Safety Code, required that within 180 days after receiving written notification from the County that the County Hazardous Waste Management Plan has been approved, each city within that county shall do one of the following: 1. Adopt a city hazardous waste management plan containing all of the required elements (per subdivision (D) of Section 25.15.1) which shall be consistent with the approved County Hazardous Waste Management Plan. 2. Incorporate the applicable portions of the approved County Plan, by reference into the City's General Plan. 3. Enact an ordinance which requires that all applicable zoning, subdivision, conditional use permit, and variance decisions are consistent with the portions of the approved County Plan which identify general areas or siting criteria for hazardous waste facilities.
