RES-7810 Approving Zone Change No. 1129-90RESOLUTION NO. 7810 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE RECONSIDERING AND RESCIND- ING CITY COUNCIL ACTION OF NOVEMBER 13, 1990, TO NOW APPROVE THE RECLASSIFICATION OF PROPERTY SITUATED AT 1515, 1527, AND 1541 EAST WALNUT AVENUE, BETWEEN TUSTIN STREET AND LINCOLN STREET, FROM R- I-6 SINGLE FAMILY RESIDENTIAL) TO R-2-6A RESIDENTIAL DUPLEX, SINGLE STORY OVERLAY) .Zone Change 1129-90 Applicant: James Schulze WHEREAS, on September 5, 1990, the Planning Commission adopted Resolution No. PC- 65-90, which recommended that the city Council approve a zone change request to allow the reclassification of property located on the north side of Walnut Avenue, between Tustin street and Lincoln street, at 1515, 1527,and 1541 East Walnut Avenue, more particularly described as follows:Chapman Tract Lot 8 Block E 82.5 feet West 322.5 feet South East 80 feet West 240 feet South 293.6 East 80 feet West 160 feet South 293.6 feet.The recommended change was from the R-I-6 District to the R-2-6 District.On November 13, 1990, the City Council adopted General Plan Amendment 3-90 to allow the most westerly parcel to remain Low Density Residential 2-6 units per acre, while changing the designation of the remaining two parcels to Low/Medium Density Residential 6-15 units per acre. The Council then adopted Zone Change No. 1129-90 which changed the classification of all three of the subject parcels from the R-I-6 (Single Family Residential)to R-2- 6 (Residential Dyplex). Later, there was concern that this change of classification was inconsistent with General Plan Amendment 3-90.At the public hearing on April 16, 1991, the City Council reconsidered and re~cinded its action on General Plan Amendment 3-90 as adopted on_November 13, 1991. It was determined that the Council's earlier action on Zone Change 1129-90 should be reenacted to ensure compliance with procedural requirements.At the public hearing of April 16, 1991, the following facts were established:1. Three rectangular parcels of land with a total net area of 61,498 square 2. Surrounding land use includes single family residences north and south of the site, commercial development east of the site fronting on Tustin Street and Walnut Avenue and two single story duplex buildings adjacent to the west property line of the site. Adjacent single family residences face onto Orange Grove Avenue one block north of Walnut Avenue and the proposed land use and zoning boundary is the rear property line of adjacent residences and the project site. Therefore, it appears that the proposed low/medium density land use designation will not intrude into the adjacent low density single family development. Additionally, Walnut Avenue is an arterial roadway with moderate traffic volume which may not, under existing traffic conditions, be ideally suited to single family use. The site is in a transitional area located between low and low/medium density residential development to the west and more intensive commercial development to the east. 3. Surrounding land use and zoning is as follows: North - Single family residences, zoned R-l- 6,South - Single family residences across Walnut in a planned unit development zoned R- 1-6.Commercial zoned C-1.Multiple family zoned R-2- 6A (Single Story OVerlay District).East West 4. Surrounding residential properties are single story.NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange that Zone Change 1129- 90 be approved reclassifying the subject property to the R-2-6A Residential Duplex, Single Story OVerlay District because R-2-6 will permit development at a density and scale which is compatible with adjacent single family residences and appropriate to the site.
