RES-7809 Conditional Use Permit Approval No. 1890-91RESOLUTION NO. 7809 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE UPHOLDING DESIGN REVIEW$ ACTION ON DRB PROJECT NO. 2640 AND UPHOLDING PLANNING COMMISSION ACTION BY APPROVING CONDITIONAL USE PERMIT 1890- 91 FOR TRANSITIONAL GROUP HOME FOR WOMEN AND CHILDREN AT 357-371 SOUTH LEMON STREET AND DENYING DESIGN REVIEW BOARD APPEAL NO. 1-91 AND PLANNING COMMISSION APPEAL NO. 385.ORANGE COUNTY RESCUE MISSION Recitals:The Planning Commission adopted Resolution No. PC-8-91 on March 4, 1991, granting Conditional Use Permit No. 1890-91 to permit the construction of a group home facility upon property situated in the R-4 District at 357- 371 South Lemon Street; more particularly described as:Property A at 357 South Lemon- Lots 17 and 18 of Block B,McCoy Addition to the City of Orange, Book 15, pages 15-17 Property B at 371 South Lemon - Lot 16 of Block B, McCoy Addition to the city of Orange, Book 15, pages 15- 17 The Old Towne Preservation Association filed two appeals.These were:1. Design Review Board Appeal No. 01-91 alleging that the subject project (DRB Project No. 2640) approved by the Design Review Board on December 19, 1990 was not consistent with Old Towne Guidelines because the design was not in a pre-1940 architectural style and the structure would be out of context with the neighborhood.2. Appeal No. 385 requesting that the Planning commission be overruled and Conditional Use Permit No. 1890 be denied because the mass, scale and density of the proposed structure would be out of context with the neighborhood. This matter came before the City Council on April 16, 1991,and the following facts were determined: 1. The proposed structure would be a 2-story, 14,984 square foot building designed in the Craftsman Style and would have a low pitched roof, wide clapboard siding and stone detailing.2. The structure would provide temporary housing for 20 adult women and their children, along with resident managers,under the sponsorship of the Orange County Rescue Mission. NOW, of Orange that the action of the Planning Commission to approve Conditional Use Permit No. 1890-91 be upheld and Appeal No. 385 be denied for the following reasons:1. The group home facility, providing transitional housing for women and children, is a use which will benefit the community.2. The building design is consistent with the Old Towne Design Guidelines.3. The size of the building and the number of residents proposed are reasonable and consistent with the type of the development allowed in the R-4 (Residential, Maximum Multiple Family) district.BE IT FURTHER RESOLVED that Conditional Use Permit No. 1890-91 be granted subject to the following conditions:1. Except for the qualified resident manager( s), occupancy of this "House of Hope" shall be restricted to those screened applicants meeting the established criteria as stated by Orange county Rescue Mission.2. The use of this facility shall be limited to 20 adult women and their children under the age of 12 years. Maximum occupancy including two resident managers shall be 47 persons. The maximum stay for residents shall be 18 months.3. Any change in client criteria, screening standards or expansion and/or expiration of use shall require a new conditional use permit and full review. Quarterly reporting of occupancy in conformance with Condition No.2, to the Department of community Development shall be required.4. Final project shall be in substantial conformance with approved plans.5. The applicant shall submit landscaping and irrigation plans to the Design Review Board for approval.6. That the building elements and material match in quality and type as used on Old Towne residential structures such as wood or vinyl clad wood double or single hung, or windows and individual lap siding.7. That the applicant submit a grading plan to the Public Works Department for approval, and pay appropriate fees as required.8. Common property line between project parcels shall be eliminated in a manner approved by the Department of Public Works.9. Lighting shall be installed in such a manner that direct glare of illumination shall be confined to 10. Encompass City of Orange Security Ordinance No. 7- 79 within plan set for plan CCC review.11. All fencing surrounding the yard areas, shall be approved by the Police Department and Design Review Board.12. Exterior lighting relating to the parking lot, all access ways and walkways to and from, as well as the yard area,including all accessways and walkways, shall be installed and maintained as required by the Security Ordinance, as approved by the Police Department.13. A photometric printout of this project showing the light levels by use of "point to point" or "contour" analysis.Please include the information data sheet with these photometries to show the type of luminaire, mounting height, and wattage of bulb used for analysis.14. All illuminated address number of at least 8 inches,contrasting to the background be placed upon the structure so that it is visible/legible to approaching vehicles, as approved by the Police Department. Actual location may be specified by the Police Department.15. All unit doors to each indivdual suite will be required to have a 180 degree door viewer, not to be mounted moe than 58 inches from the bottom of the door.16. The Fire Department connection shall not be affixed to the building. The Fire Department connection must be located at least 40 feet away from the building, within 40 feet of a fire hydrant, and 0 the address of the building.19. Provide one on-site fire hydrant and mains capable of supplying the required fire flow. The hydrant model and on-site location shall be approved by the Fire Department and have a three (3) foot minimum clearan~e around the circumference of the fire hydrant. The on-site hydrant shall not be controlled by the control valve (P.I.V.) for the sprinkler system so that water flow to hydrants is not impaired should the sprinkler system be shut down for any reasons. U.F.C. 10.206 and 10.301 Plans Must be submitted to the Building Department.20. An approved fire sprinkler system must be installed throughout the building per O.M.C. 15.32. 080 Section 10.306(a).The system shall be designed per N.F.P.A. 13, U.B.C. Chapter 38 and U.B.C. A Fire Department approved key box for Fire Department access shall be installed in a location approved by the Fire Department and shall contain keys to gain access to each building. O.M.C. 15.32.100 and U.F.C. 10. 209.25. Fire facility fees will be required.26. TSIP fees will be required in accordance with City Ordinance.27. Within 15 days of the approval of this project, the applicant/developer shall deliver to the Planning Division a cashiers check payable to the County Clerk in an amount required to fulfill the fee requirements of Fish and Game Code section 711.4(d) (2) and the County administrative fee, to enable to the City to file the Notice of Determination required under Public Resources Code section 21152 14 Cal. Code of Regulations 15075.If the Planning Commission determined that there is no potential impact to wildlife resources, the fee shall be $25.00. If the applicant/ developer has not delivered the required fees within such 15 day period, the approval for the project granted herein shall be void.28.
