RES-7792 Revocation of Conditional Use Permit No. 1795-89RESOLUTION NO. 7792 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE REVOKING A CONDITIONAL USE PERMIT TO ALLOW THE USE OF A MODULAR BUILDING AS AN OFFICE ADDITION AT AN AUTOMOTIVE SERVICE STATION FOR FAILURE TO SATISFY CONDITIONS IN A TIMELY MANNER. REVOCATION OF CONDITIONAL USE PERMIT NO. 1795- 89 CITY OF ORANGE RECITALS:Orange Municipal Code Section 17.92.104A states that a Conditional Use Permit shall be revoked if it has not been used in accordance with the terms of approval. When the conditions or terms of a Conditional Use Permit are alleged to have been violated, Orange Municipal Code Section 17.92.140C states that the City Council shall hold a public hearing, determine the facts, and take appropriate action.The subject property is located on the south side of La Veta Avenue between Crest and Bedford Roads at 1650 West La Veta Avenue. The business is Tony's Unocal 76 service station in the C-1 (Limited Business) District.On November 9, 1989, the Zoning Administrator approved a Conditional Use Permit to allow a modular building to be used as an office addition for an automotive service station. The structure had already been installed on the premises when application for the CUP was made. The Conditional Use Permit was subject to eight conditions.The revocation proceedings were duly noticed and the matter was heard by the City Council on April 9, 1991. The property owner was represented by legal counsel.The Council found and determined that none of the eight conditions had been satisfied. The owner claimed that he was now able and willing to comply with all conditions except Condition No.7 which required the dedication of 10 feet of right-of-way across the frontage of the property and to make a cash payment for future improvement of La Veta Avenue.
