RES-7768 Amending Resolution No. 7768RESOLUTION NO. 7768 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING RESOLUTION NO. n43 PROVIDING FOR ADDmONAL TEMPORARY, PARTIALLY- PAID MILITARY LEAVE OF ABSENCE, FOR CITY EMPLOYEES CAT ,T FD TO ACTIVE DUTY WITH THE ARMED FORCES, AND PROVIDING CONTINUATION OF BENEFITS FOR THEIR DEPENDENTS DURING THE CURRENT CRISIS IN THE MIDDLE EAST. WHEREAS, in compliance with the Military and Veterans Code, Section 395,the City of Orange grants fully paid leave of absence and continuation of benefits foremployeeswhoareorderedtoreporttodutyforamaximumof30dayspercalendar year; and WHEREAS, in support of the current crisis in the Gulf, the City CounciladoptedResolutionNo. 7743 to provide ~ntinuation of benefits to dependents ofemployeeswhoarecalledtoactivedutywiththeU.S. Armed Forces; and WHEREAS, these benefits are being extended for a maximum of 180 days,provided that the dependents were covered for benefits prior to the employees beingcalledtoactiveduty; and WHEREAS, the normal tour of duty to which a Reservist may be orderedwithoutcongressionalactionissixconsecutivemonths; and WHEREAS, in addition to providing continuation of benefits to dependents ofemployees, the City Council wishes to take further action to alleviate financial hardshipwhichemployeesandtheirfamiliesmayexperienceasaresultofbeingcalledintoactiveduty. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City ofOrangethat: 1. In addition to the fully paid military leave provided by the CaliforniaMilitaryandVeterimsCode, Section 395, each employee of the City who has been oriscalledtoinvoluntaryactivemilitaryserviceinconnectionwiththecurrentcrisisintheMiddleEast, shall be entitled to military leave with differential pay for the periodofabsenceactuallyservednottoexceed180days. The salary continuation will become effective on the thirty-frist (31st) dayofanemployee's military leave to serve in the current Persian Gulf Crisis,3, The amount of pay each employee shall be entitled to receive from theCityforsaidadditionalperiodofmilitaryleave, shall be the difference between thegrosspayandallowancesactuallyreceivedbytheemployeefromtheUnitedStatesforsuchserviceandthegrosswagesthatsaidemployeewouldhavereceivedfromtheCityofOrangeifheorshehadnotbeencalledtoactivemilitary duty.4.
