RES-7748 Approving Tentative Tract No. 13984RESOLUTION NO. 7748 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE UPHOLDING THE RECOMMENDA- TION OF THE PLANNING COMMISSION OF THE CITY OF ORANGE AND APPROVING THE SUB- DIVISION OF PROPERTY SITUATED ON THE NORTH SIDE OF VIA ESCOLA, 2000 FEET EAST OF MEATS AVENUE. TENTATIVE TRACT 13984 APPLICANT: Tracv DevelODment RECITALS: After report thereon by the Planning Commission and afterduepublichearingsasrequiredbylaw, and after receiving a recommendation from the Planning Commission, recommending, byResolutionNo. PC-89-90, that the subdivisionofpropertysituatedonthenorthsideofViaEscola, 2000 feet eastofMeatsAvenuebeapproved, the city Council consideredTentativeTract13984inconjunctionwithConditionalUsePermit1884-90 and Administrative Adjustment 90-20 and determined that the recommendation of the Planning CommissionshouldbeupheldandTentativeTract13984beapproved. Subject property is more particularly described in ResolutionNo. 7747 approving said Conditional Use Permit.During the pUblic hearing, the City Council found the facts more particularly set forth in Resolution No. 7747.NOW, THEREFORE, BE IT RESOLVED by thecityCouncilofthecityofOrangethatTentativeTract13984 be approved for the following reasons:1. The proposal is consistent withitsGeneralPlanLandUsedesignationandiscompatible with surrounding land uses.2. The proposal isconsistentwiththedevelopmentstandardscontainedintheDevelopmentPlanfortheSouthridgeArea XX planned Community District.BE IT FURTHER RESOLVED that Tentative Tract 13984 be approved subject to the following conditions:NOTE: Mitigation measures frompreviouslycertifiedEIR 854 are denoted with *:1. That all slopes as indicated on ExhibitConfilewithZoneChange1004andTentativeTractMap12082shallbemaintainedbytheHomeownerAssociation, and that easements be 2. Prior to issuance of building permits for single family residences, the applicant shall submit to the Design Review Board and city's Department of Community services for their review and approval landscaping and irrigation plans for all areas to be maintained by the Homeowner's Association and slopes of five feet or greater in height. 3. That the use and development of any of the 70 parcels created by tentative Tract Map 13984 be restricted to the permitted uses of the R-1-6 Zoning Classification only.Conditions 4 - 30 shall be complied with to the satisfaction of the City's Public Works Department:4. Subject to conditions of addendum sheet No. 1.5. A final tract map shall be recorded within 24 months after tentative approval land prior to the sale or lease of any parcel.6. Monuments shall be set based on a field survey.7. A tentative and final parcel map shall be submitted for approval and final recordation, separating the 70 lot project from future area.8. Dedicate and construct streets "A" through "E", and Via Escola, to city standards.9. Retaining wall adjacent to Via Escola along Lots # 1 through #7 shall have a maximum height of 3 feet.10. Grading, landscape, and wall plans shall be designed to provide proper sight distance at Via Escola "E" street intersection.11. Prior to the recordation of Tentative Tract Map 13984, a drainage easement across the parcel to the south of the site is to filed with the county Recorder. The wording of the easement is to be reviewed and approved by the City Engineer and City Attorney.12. Construct storm drain(s) to city standards.13. A fee of $825.00 per dwelling unit shall be paid to the City of Orange to assist in the financing of future Serrano Avenue between Nohl Ranch Road and Mabury Ranch.14. Dedicate a 22' wide easement across Lot 17 to provide access to Lot 16.15 That a traffic signal fee of $120.00 per dwelling unit,payable at issuance of building permit, be required for future signal construction at Via EscolajMeats Avenue and Via Escolajlmperial Highway.Reso No. 7748 16. street lights shall be installed by developer, as approved by Department of Public Works, and system dedicated toCityofOrange. 17. All slopes shall be maximum of 2:1 unless a 1 1/2:1maximumisrecommendedasbeingsafebythesoilsengineerand approved by the City Engineer. 18. Rear down slope of Lots 62 through 70 and Lots 1 through7shallbemaintainedbyaHomeownerAssociation. 19. Rear slopes of Lots 14 through 16, adjacent to waterreservoirsite, shall be maintained by a homeowner association. 20. C, C,&R's shall be reviewed and approved by the CityAttorneypriortoapprovaloffinalmap. 21. That an on-site dedicated circulating water linebeinstalledasdesignedbytheWater Department.22. That a 15 foot easement be dedicated to include thewatermain, meters, detector checks, and fire hydrants.23. That the developer pay all Water Department feesandchargespriortoCityCouncilapprovalofFinal Map.24. Cable television facilities shall be installedasrequiredbyCityfranchisecabletelevision company.25. Subject to paying the major thoroughfare andbridge,transportation system improvement program, police facilities, fire facilities, library facilities, and school development feespriortoissuanceofbuilding permits.26. Erosion control facilities shall be installed topreventwatererosioningradedareasandpreventsiltfromenteringexistingstreetsanddrainage facilities,27. Dedicate and construct all streets to City standards.28. Via Escola shall be designed to meet City safetyandconstructions standards 29. Prior to building permits being issued on the second500unitsencompassedwithintheboundariesofTentativeTractMap12082, Via Escola shall be constructed to two lanes widthminimumfromMeatsAvenuetoLomaStreet, and Loma Street/ImperialHighwayshallbeconstructedtwolaneminimumwidthprovidingaccesstothearterialhighway.system in. the City of Orange.30. Developer shall submit an extensive engineeringdrainagestudyrelatingprojectareatooff-sitedownstreamareas.Construction of off-site drainage facilities may be required.31. That temporary desilting facilitiesbeinstalledtoadequatelypreventstormwatererosioningraded areas of tract.3- Conditions 32 - 36 shall be complied with to the satisfaction of the city's Fire Department:32. The development must comply to the city of orange fuel modification plan.33. All residential buildings will be required to have fire sprinkler systems installed.34. The proposed development is within a climatic and topographic high hazard and fire zone which requires all buildings constructed in the zone to have Class A fire retardant roofs with fire stopped and enclosed eaves. In addition, a spark arrestor is required on chimneys, maximum one-half (1/2) inch screen required. 35. Smoke detectors will be required in every unit and installed in accordance with the approved manufacturer's instructions. 36. All streets shall have a twenty foot clearance maintained for emergency vehicle access. In addition, the cul-de- sac streets must have an adequate tuning radius for fire department apparatus. A 40 foot outside radius is the minimum.Conditions 37 - 40 shall be complied with to the satisfaction of the City of Orange's Police Department:37. All structures shall comply with the requirements of Municipal Code, Chapter 15.52 (Building Security Standards), which relates to use of security hardware, doors, windows, and lighting.Ord. 7-79). Architectural drawings shall include sections of the ordinance that apply under "Security Notes". An " Approved Products List: of hardware and windows is available upon request.38. An illuminated address of 4 inches in height is required.The address shall be contrasting to the background and visible to approaching vehicles. Location to be approved by Crime Prevention Bureau (The address is to be located at the driveway entrance for any structures recessed from lot frontage) ( Ord. 7-79)39. A second address of 4 inches is required for Lots #16 and 17. The addresses shall be individual located at the shared driveway entrance so as to be visible and it shall be illuminated.40.
