a portion of Parcel No. 2 of Parcel Map No. 86-268accordingtoamapfiledinBook233Pages29-30of
PM, Records of the County of Orange, State of California.Duringthepublichearing,
the City Council found the facts to be as follows:1. The Tentative Tract Map is for an irregularly shaped parcel 17.4 acresinsizelocatedonthenorthside
of Via Escola 2,000 feet east of MeatsAvenue.The Tentative Tract Map
is located within the "Southridge Development XX Planned CommunityDistrict".2. The applicant is requesting approval of Tentative Tract Map 13984 toallowtheSubdivision
of 17.4 acres into 70 single family residential parcels.Also included is a request for approval of an AdministrativeAdjustmenttoallowcreationofninelotslocatedaroundcul-de-
Chaoter 16.08 of the Orange Municipal Code sets forth regula-
tions pertaining to Tentative Tract Maps.
Section 17.94.070-8 of the Oranae Municioal Code allows for
an exemption from lot frontage requirements on cul-de-
sac and knuckle lots in
single-family residential zones.The site under consideration is surrounded
by vacant
land on all sides.The site's northern boundary is adjacent
to the City of Anaheim. The adjacent site is designated by
Anaheim's General Plan Land Use Map and Zoning Map
for residential development and recently, a parcel map was approved subdividing
this site
into four residential parcels.Otherwise, the site is bordered by
the "Southridge Area XX Planned Community District" Planning Area "E"
on the east, Planning Area "c" to the south, and Planning Area "A" to
the west. Area "A"permits single family uses and Areas "c" and "
E" permit Low/Medium Residential developments, 6 to 15
dwelling units per acre.4. The administrative Adjustment
request is to allow creation of nine lots with lot width less than
the 50' minimum lot width allowed by the "Southridge
Area XX Planned Community District" in "Planning Area D". The lot number

requirements on cul-de-sac
and knuckle lots in single-family residential zones.All of the lots listed
are located either at the end
of a cul-de-sac or on a street knuckle.Also,
the nine lots listed have buildable pad areas areas at lease as large
as a lot developed with the minimum 50' lot width.
5. The proposed lot sizes and dimensions, with the exception of
the lot widths noted above, conform to the
development standards of the "

XX Planned
NOW, THEREFORE, BE IT RESOLVED by the city Council of the CityofOrangethatConditionalUsePermit1884-90 andAdministrativeAdjustment90-20 be granted for the
following reason:The proposal's design assures safe and permanent accesstotheparcelwithoutdirectaccesstoapublicstreet, and totheninelotswithnarrowerlotwidthsthanallowed
by code.BE IT FURTHER RESOLVED that Conditional Use Permit1884-90 be granted subject to
the following conditions:NOTE: Mitigation measures from previously certifiedEIR854
are denoted with *:1. That all slopes as indicated on Exhibit ConfilewithZoneChange1004andTentativeTractMap12082shallbemaintainedbytheHomeownerAssociation, and that easementsbegranted
for this purpose.2. Prior to issuance of building permitsforsinglefamilyresidences, the applicant shall submit to theDesignReviewBoardandCity's Department of Community Services fortheirreviewandapprovallandscapingandirrigationplansforallareastobemaintainedbytheHomeowner's Association and slopesoffivefeetor
greater in height.3. That the use and development of any ofthe70parcelscreatedbytentativeTractMap13984berestrictedtothepermittedusesoftheR-

project from future area.8. Dedicate and construct streets "A" through "E", and Via
Escola, to city standards.9. Retaining wall adjacent to ViaEscolaalongLots #1 through #7 shall have a maximum
height of 3 feet.10. Grading, landscape, and wall plansshallbedesignedtoprovidepropersightdistanceatVia
Escola "E" street intersection.
11. Prior to the recordation of Tentative Tract Map 13984, a
drainage easement across the parcel to the south of the site is to
filed with the County Recorder. The wording of the easement is to
be reviewed and approved by the City Engineer and City Attorney.
12. Construct storm drain(s) to city standards.
13. A fee of $825.00 per dwelling unit shall be paid to the
City of Orange to assist in the financing of future Serrano Avenue
between Nohl Ranch Road and Mabury Ranch.
14. Dedicate a 22' wide easement across Lot 17 to provide
access to Lot 16.
15 That a traffic signal fee of $120.00 per dwelling unit,
payable at issuance of building permit, be required for future
signal construction at via Escola/Meats Avenue and Via
Escola/Imperial Highway.
16. Street lights shall be installed by developer, as
approved by Department of Public Works, and system dedicated to
City of Orange.
17. All slopes shall be maximum of 2:1 unless a 1 1/2:1
maximum is recommended as being safe by the soils engineer and
approved by the City Engineer.
18. Rear down slope of Lots 62 through 70 and Lots 1 through
7 shall be maintained by a Homeowner Association.
19. Rear slopes of Lots 14 through 16, adjacent to water
reservoir site, shall be maintained by a homeowner association.
20. C, C,&R's shall be reviewed and approved by the City
Attorney prior to approval of final map.
21. That an on-site dedicated circulating water line
be installed as designed by the Water
Department.22. That a 15 foot easement be dedicated to include the
water main, meters, detector checks, and fire
hydrants.23. That the developer pay all Water Department fees
and charges prior to City Council approval of Final
Map.24. Cable television facilities shall be installed
as required by City franchise cable television
company.25. Subject to paying the major thoroughfare and
bridge,transportation system improvement program, police facilities,
fire facilities, library facilities, and school development fees
prior to issuance of building
permits.26. Erosion control facilities shall be installed to
prevent water erosion in graded areas and prevent silt from
entering existing streets and drainage

27. Dedicate and construct all streets to City standards.
28. Via Escola shall be designed to meet City safety and
constructions standards
29. Prior to building permits being issued on the second 500
units encompassed within the boundaries of Tentative Tract Map12082, Via Escola shall be constructed to two lanes width minimum
from Meats Avenue to Loma street, and Loma street/Imperial Highwayshallbeconstructedtwolaneminimumwidthprovidingaccesstothe
arterial highway system in the City of Orange.
30. Developer shall submit an extensive engineering drainagestudyrelatingprojectareatooff-site downstream
areas.Construction of pff-site drainage facilities may
be required.31. That temporary desilting facilities be
installed to adequately prevent storm water erosion in graded areas
of tract.Conditions 32 - 36 shall be complied with to the satisfaction
of the City's Fire
Department:32. The development must comply to the city of Orange
fuel modification
plan.33. All residential buildings will be required to have
fire sprinkler systems
installed.34. The proposed development is within a climatic
and topographic high hazard and fire zone which requires allbuildingsconstructedinthezonetohaveClassAfireretardantroofswithfirestoppedandenclosedeaves. In addition, a spark arrestor
is required on chimneys, maximum one-half (1/2) inch
screen required.35. Smoke detectors will be required in every
unit and installed in accordance with the approved
manufacturer'
s instructions.36. All streets shall have a twenty foot
clearance maintained for emergency vehicle access. In addition, the
cul-de-sac streets must have an adequate tuning radiusforfiredepartmentapparatus.A 40 foot outside
radius is the minimum.Conditions 37 - 40 shall be complied with to
the satisfaction of the City of Orange'
s Police Department:37. All structures shall comply with
the requirements of Municipal Code, Chapter 15.52 (BuildingSecurityStandards), which relates to use of security hardware, doors, windows, and lighting.Ord. 7-79). Architectural drawings shallincludesectionsoftheordinancethatapplyunder "SecurityNotes". An "Approved Products List: of hardware and windows
is available upon request.38. An illuminated address of 4
inches in height is required. The address shall be contrastingtothebackgroundandvisibletoapproachingvehicles. Location to

Prevention Bureau (The address is to be located at the driveway

and 17. The addresses shall be individual located at the
shared driveway entrance so as to be visible and it shall be
illuminated.40. All landscaping shall be maintained so that it does
not interfere with the required
