RES-7739 Granting Conditional Use Permit No. 1870-90RESOLUTION NO. 7739 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE UPHOLDING THE RECOMMENDA- TION OF THE PLANNING COMMISSION OF THE CITY OF ORANGE AND GRANTING A CONDITIONAL USE PERMIT TO ALLOW CONVERSION OF EXIST- ING GUEST ROOM OF SINGLE FAMILY RESIDENCE UNIT ACCESSORY SECOND DWELLING UNIT AND CONSTRUCTION OF ADDITIONAL ROOM AS PART OF SECOND UNIT UPON PROPERTY SITUATED AT 376 CHANDLER RANCH ROAD BETWEEN PONY COURT AND CRIOLLO CIRCLE. CONDITIONAL USE PERMIT 1870- 90 APPLICANT: EDWARD FRANKEL RECITALS:After report thereon by the Planning Commission and after due public hearings as required by law, and after receiving a recommendation from the Planning Commission, recommending, by Resolution No. PC-83-90, that Conditional Use Permit 1870-90 be granted to allow conversion of an existing guest room of a single family residence into an accessory second dwelling unit and construction of an additional room as part of the second unit on property situated at 376 Chandler Ranch Road between Pony Court and Criollo Circle, the City Council considered Conditional Use Permit 1870-90 and determined that the recommendation of the Planning Commission should be upheld and Conditional Use Permit 1870-90 be granted. Subject property is more particularly described in Exhibit "A" attached hereto and made a part hereof. A map of the subject area is attached hereto as Exhibit liB".During the public hearing, the City Council found the facts to be as follows:1. The subject property is a flag shaped parcel approxi-mately one acre in size, located on the west side of Chandler Ranch Road between Pony Court and Criollo Circle. (Addressed 376 Chandler Ranch Road)2. Conditional Use Permit application to allow an accessory second dwelling unit in a single family residential district. The applicant is proposing the conversion an existing guest room of a single family residence into an accessory second dwelling unit.Upon conversion, an additional room will be constructed as part of the second unit.Orange Municipal Code Section 17.10.040 allows for accessory second dwelling units in a single family residential district, subject to the approvalofaConditional Use Permit by the city Council.3. The property is currently developed with a 2 story, 7,770 4. The property is situated on a hillside, accessed from a 24 ft. wide driveway shared with the adjacent property to the north. 5. The property is presently zoned R-1-40 ( Residential -Single Family District, one acre minimum lot size), and the General Plan Land use Designation is Residential Estate low Density ( 0-2)units per acre). The property is located within the Orange Park acres area and is designated as Low Density (one acre minimum)under the Orange Park Acres Plan.6. The surrounding properties on the north, east, and west are single family residences zoned R-1- 40 (Residential - Single Family District, one acre minimum lot size). The adjacent properties to the south are single family residences zoned R-1-20 Residential - Single Family District, 20,000 sq. ft. minimum lot size).7. The surrounding properties vary widely in slope and elevation, and consist of both single and two story custom residences.8. Chandler Ranch Road is a Local Street with a 56 ft. wide right-of-way. The nearest major cross street is Chapman Avenue,located approximately 1,000 ft. north of the subject property.Chapman Avenue is an Augmented Primary Arterial with a 100 ft.right-of-way.NOW, THEREFORE, BE IT RESOLVED by the city Council of the City of Orange that Conditional Use Permit 1870-90 be granted for the following reasons:A. The property is flag shaped, over one acre in size, and can easily accommodate the proposed second unit.B. The existing residence is setback over 200 feet from the public right-of-way with only driveway street frontage. Therefore,the new room addition cannot be viewed from the street.C. The proposed project will not increase the height or significantly reduce the floor area of the existing residence.BE IT FURTHER RESOLVED that Conditional Use Permit 1870-90 be granted subject to the following conditions:1. Prior to issuance of building permits, and agreement approved in form and substance by the City Attorney, which sets forth the requirements of Section 17.10.040 H of the Orange Municipal Code, and other conditions of approval, which may be imposed by the Planning Commission or the City Council, shall be recorded with the Orange County Recorder's Office, and on file with the Department of Community Development.2. Prior to issuance of building permits, the building materials, color, and design features, shall be reviewed by 3.
