A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE UPHOLDING THE RECOMMENDA-
TION OF THE PLANNING COMMISSION OF THE
CITY OF ORANGE AND APPROVING THE
SUBDIVISION OF PROPERTY SITUATED ON THE
NORTH SIDE OF BUENA VISTA STREET BETWEEN
PALM AND ORANGE AVENUES.
TENTATIVE PARCEL MAP 90-
322 APPLICANT: GORDON
DAVIDSON
RECITALS:After report thereon by the Planning commission and
after due public hearings as required by law, and after receiving
a recommendation from the Planning Commission, recommending,
by Resolution No. PC-81-90, that the
subdivision of property situated on the north side of Buena vista Street
between Palm and orange Avenues be approved, the city
Council considered Tentative Parcel Map 90-322 and determined that
the recommendation of the Planning Commission should be upheld
and Tentative Parcel Map 90-322 be approved.
Subject property is more particularly described in Resolution
No. 7734 granting Pre-Zone Change.Upon the public hearing
before the City Council, the facts more particularly set
forth in Resolution No. 7734
granting Pre-Zone Change 1131-90 were found.NOW, THEREFORE, BE
IT RESOLVED by the City Council of the city of Orange
that Tentative Parcel
Map 90-322 be approved for the following reasons:1. The
proposed project is in conformance with the City'
s General Plan Land Use Policy Map designation
of low/medium density residential (6-15 units
per
acre).2. The proposed project complies with applicable
zoning regulations.3. Conditions have been included with
this project
mitigating potential impact of the development as two condominium units.
BE IT FURTHER RESOLVED that Tentative
Parcel Map 90-322 be approved subject to the
following conditions:1.
Design Review Board approval of final site, building and
landscape plans.'2. Recordation of a deed restriction stating that
parking
is not permitted in Building B's driveway off the
alley.3.
4. Final grading plans shall indicate that no obstruction
exceeding 42" in height will be located within required
driveway visibility zones (10' triangular area located at
the intersection of the driveway and public
right-
of-way) .5. The formation of a homeowners association
for the maintenance of all common areas and CC&R's
shall be reviewed and approved by the city Attorney prior
to final
map approval.6. Compliance with Building Security Ordinance
7-79 as approved by the
Crime Prevention Division.Conditions 7-15 shall be completed to
the satisfaction of
the Public Works Department:7. A final parcel map shall be recorded
within two (2) years after tentative approval and prior to
the sale of
lease of either unit.8. Monuments shall be set based
on a field survey.9. Northerly portion of parcel, adjacent
to alley, shall be designed to prohibit any
alley
drainage from entering parcel.10. Each residence shall be
water metered separately unless otherwise approved
by the Water Superintendent.11. Developer shall pay all Water
Department fees and charges prior to Council
approval of final map.12. Subject to
paying drainage assessment fee.13. subject to paying the following fees
prior to issuance of building
permits: Transportation System Improvement Program; School development,
Fire,
police and Library facilities,14. A grading plan shall be reviewed
and approved prior to
issuance of any permits.15. Method of providing sewer service to
be approved prior to
