A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE UPHOLDING THE RECOMMENDA-
TION OF THE PLANNING COMMISSION OF THE
CITY OF ORANGE AND APPROVING THE RECLASSI-
FICATION OF PROPERTY SITUATED ON THE
NORTH SIDE OF BUENA VISTA STREET BETWEEN
PALM AND ORANGE AVENUES.
PRE-ZONE CHANGE
1131-90 APPLICANT:

DAVIDSON RECITALS:After due public hearings as required by law,
the city Council of the City of Orange considered a recommendation
of the Planning commission of the City of Orange
recommending, by Resolution No. PC-80-90, that certain
property situated on the north side of Buena vista Street between
Palm and Orange Avenue be reclassified from the county R-4
District to the city R-2-6 District,
and approved said recommendation after finding and determining
the hereinafter described facts. The real property which is the
subject of the reclassification is more particularly described in Exhibit A attached
hereto and made a part hereof. A map of the subject
area is attached hereto as Exhibit "B".Upon the
public hearing before the
City Council, the following facts were established:1. The subject
property is rectangular shaped 6,483 square foot parcel of land with
an approximate 22% slope, located on the north side of Buena
vista Street between Palm Avenue and
Orange Avenue, addressed 16651 Buena vista Street 2. Existing
site development consists of one single family residence with two
small shed structures located on the front half of the lot. A low I' to 3'
high wall is located on the west property line and a l' to 5'
high wall is located on the east property line. The County
is in the process of constructing an approximate 4' to 5'
high river rock faced
retaining wall along the front property line.3. Buena' vista stre~t is
a local roadway with a 60 foot right-of-
way under Orange County jurisdiction. A 20' wide public alley under
county jurisdiction is located at the rear of
the site with access to Palm and Orange Avenues.4.
The
surrounding land use and zoning is as follows:
South:Two story
condominiums zoned R-=2-6 within the
City of Orange.Single
story, single family residence zoned county
R-4 (*suburban multiple family).
Single
story,
West:Single story, single family residence, zoned
County R-4 (suburban multiple
family).The city's Land Use Policy Map designates the
project site and surrounding area for low/medium density
residential development (6-15 units
per acre).5. North of the project site across the alley is a
7 unit two-story condominium development located within
the city. The 0.5 acre site was brought into the City by annexation
No. 367 on April 23, 1985. A zone change from County R-4
to City R-2-6 was approved by the City
Council on January 15, 1985. Conditional Use Permit 1494
and Tentative Tract Map 12645 authorizing construction of the
condominium development was approved by the City Council on March 18, 1986.
It appears from the map filed with Annexation No. 367 that the
City's boundary is currently the north right-of-
way line of the alley. The annexation proposed with Pre-
zone Change 1131-90 and Tentative Parcel Map 90-322, the
subject application, appears to extend only to the center line
of the alley leaving a 10' gap under County jurisdiction. The
city's annexation coordinator has indicated that this gap will be removed
during final
map review and that the City's boundary will be continuous.
NOW, THEREFORE, BE IT RESOLVED by the city Council of
the City of Orange that the recommendation of the
Planning Commission be upheld and that Pre-Zone Change 1131-
90
reclassifying
the
subject
property to R-2-6 District be approved for the
following reasons:1.General density The proposed project is
in conformance with the city'
s Plan Land Use Policy Map designation of
low/
medium residential (6-15 units per acre).
2.
The
proposed project complies with applicable zoning regulations.
