RES-ORA-0254 Adopting Replacement Housing PlanRESOLUTION NO. ORA- 254 A RESOLUTION OF THE ORANGE REDEVELOPMENT AGENCY ADOPTING A REPLACEMENT HOUSING PLAN IN CONNECTION WITH THE PROPOSED OWNER PARTICIPATION AGREEMENT BY AND BETWEEN THE ORANGE REDEVELOPMENT AGENCY AND CITRUS VILLAGE PARTNERSHIP, L.P. WHEREAS, Section 33413.5 the California Health and Safety Code requires that a redevelopment agency adopt by rE!solution a replacement housing plan not less than thirty (30) dclYS prior to the execution of an agreement for acquisi tion of real property, the execution of an agreement for the di.sposition and development of property, or the execution of an o~'ner participation agreement when such agreements will lead to the destruction or removal of dwelling units from the low and moderate income housing market; WHEREAS, the Orange Redevelopment Agency (the I~gency") is contemplating entering into the proposed Owner Pclrticipation Agreement by and between the Agency and Citrus Vi.llage Partnership, L.P, (the OPA"); and WHEREAS, the proposed OPA contemplates the e):penditure of moneys from the Agency's Low and Moderate Income Housing Fund established for the Tustin Street Redevelopment Project pursuant to Health and Safety Code Sections 33334,2 and 32~334. 3 to facilitate the rehabi Ii tation of a mul ti-fami ly rE!sidential rental development (the "Complex") and provide for the long-term availability of certain units in the Complex for affordable housing purposes, but which may result in the rE!moval of certain rental housing units in the Complex from the low and moderate income housing market; and WHEREAS, in addition to the proposed affordable housing provisions of the OPA, the Agency is continuing its efforts to increase, improve and preserve the community'S supply of low and moderate income housing; and WHEREAS, the Agency has prepared a replacement housing plan in connection with the OPA (the " Replacement Housing Plan") pursuant to the requirements of Section 33413. 5 of the California Health and Safety Code which Plan is attached hE!reto as Attachment No. 1 and incorporated by reference hE!rei n; and WHEREAS, the Replacement Housing Plan was available for public review for a reasonable period of time prior to a timely and properly noticed public meeting at which the Agency considered the Replacement Housing Plan; NOW, THEREFORE, THE ORANGE REDEVELOPMENT AGENCY DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1, The Orange Redevelopment Agency hereby appJ~oves and adopts the Replacement Housing Plan. SECTION 2, The Executive Director of the Agency is authorized to implement the Replacement Housing Plan and to execute any documents and take any other action necessary or convenient for the proper accomplishment of its purposes.
