A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE SETTING FORTH AN ADVISORY
PROPOSAL CONCERNING TERM LIMITS ON THE
MAXIMUM NUMBER OF CONSECUTIVE YEARS OF
SERVICE AS CITY COUNCIL MEMBER OR ELECTED
MAYOR TO BE VOTED UPON AT THE GENERAL MUNI-
CIPAL ELECTION TO BE HELD ON NOVEMBER 3, 1992.
WHEREAS, under the provisions of the laws relating to
general law cities in the state of California, a General
Municipal Election shall be held on November 3, 1992, for the
election of Municipal Officers; and
WHEREAS, pursuant to the authority of section 5353 of the
Elections Code of the state of California, the City Council of
the City of Orange desires to submit a certain measure to the
electors of the city of Orange for the purpose of allowing said
electors to voice their opinion of said issue; and
WHEREAS, the City Council desires that said ballot measure
be submitted to the electors of the city for an advisory vote
only, and, in the absence of state legislation being enacted to
allow general law cities to set term limits that the results of
said advisory vote cannot and will not be controlling or binding
on the City; and
NOW, THEREFORE, the city Council of the City of Orange,
California, does hereby resolve, declare, and determine and order
as follows:
SECTION I:
That, pursuant to section 5353 of the Elections Code of the
State of California, the hereinafter specified ballot proposal be
submitted for an advisory vote only, to the electors at the
General Municipal Election to be held in the City of Orange on
November 3, 1992.
SECTION II:
That the aforesaid ballot proposal hereby submitted to the
electors of the City of Orange shall appear upon the ballots for
said General Municipal Election in the following form:
ADVISORY VOTE ONLY
Should the City of orange Council YES
Members be limited to a maximum of
two consecutive four-year terms
in office and the elected Mayor
be limited to a maximum of three
NO consecutive two-year
terms
SECTION III:
That the City Clerk is authorized, instructed and directed
to procure and furnish any and all official ballots, notices,
printed matter and all supplies, equipment and paraphernalia that
may be necessary in order to properly and lawfully conduct the
election.
SECTION IV:
That the polls for the election shall be open at seven
o'clock a.m. on the day of the election and shall remain open
continuously from that time until eight o'clock p.m. of the same
day when the polls shall be closed except as provided in Section
14301 of the Elections Code of the State of California.
Section V:
That in all particulars not recited in this Resolution, the
election shall be held and conducted as provided by law for
holding municipal elections.
Section VI:
That notice of the time and place of holding the election is
given and the city Clerk is authorized, instructed and directed
to give further or additional notice of the election, in time,
form and manner as required by law.
Section VII:
That the City Clerk shall certify to the passage and
adoption of this Resolution and enter it into the book of
original Resolutions.
Section VIII:
That this Resolution shall take effect immediately.
