A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE UPHOLDING THE RECOMMENDATION
OF THE PLANNING COMMISSION OF THE CITY OF
ORANGE AND GRANTING A CONDITIONAL USE
PERMIT AND ADMINISTRATIVE ADJUSTMENT TO
ALLOW A SENIOR CITIZEN HOUSING DEVELOPMENT
WITH A 4-POOT ENCROACHMENT INTO THE
FRONT SETBACK AREA STRUCTURE UPON PROPERTY
SITUATED AT THE NORTHEAST CORNER OF ALMOND
AVENUE AND PIXLEY

DEVELOPMENT CORPORATION RECITALS:After report thereon by City staff and
after due public hearings as required by law and after
receiving a recommendation from the Planning Commission, recommending, by
Resolution No. PC-31-92, that Conditional Use
Permit 1960-92 and Administrative Adjustment 92-9 be granted
to allow a senior citizen housing development with a
4-foot encroachment into the front setback area upon property
situated at the northeast corner of Almond Avenue
and Pixley street. The City Council considered Conditional
Use Permit 1960-92 and Administrative Adjustment 92-9
be granted. Subject property is more particularly
described in Resolution No. 8042 approving Zone Change 1150-92.
During the public hearing, the City Council found the facts
more particularly
set forth in Resolution No. 8042 approving Zone Change 1150-92.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Orange that Conditional Use
Permit
1960-92 and Administrative Adjustment 92-9 be granted for
the following reasons:1. The proposed project is consistent with the
goals and policies of the city's General Plan Housing
Element in providing the community with 15 units of
affordable senior citizen housing.2. The proposed medium density residential
use of the property is compatible with the uses in the
surrounding area because it provides a buffer between the industrial uses
to the north and east,
and the single family and duplex residential uses to the
south and west.3. Conditions have been imposed with
this project to assure the continued operation and maintenance of
the project as affordable senior citizen housing for the
life of the project.BE IT FURTHER
1. If not utilized, Conditional Use Permit 1960-92
and Administrative Adjustment Permit 92-9 shall expire two (
2) years from date
of approval.2. The project shall be in substantial
conformance with the plans as submitted to and approved by the
Planning commission and
City Council.3. Prior to issuance of building permits,
a deed restriction shall be recorded with the County
Recorders Office.Such document shall contain the terms as set forth
in Chapter 17.35 of the Orange Municipal Code, and as required by
the City Council. Prior to recordation, such document shall
be approved in form and content by the Department of
Community Development and the
city Attorney.4. Prior to issuance of building
occupancy permits,landscaping and irrigation plans shall be reviewed
and approved by the Design
Review Board.5. Prior to issuance of building permits,
grading plans shall be reviewed and approved by Department of
Public Works.6. Prior to issuance of building permits,
payment of development fees shall be required, including but not
limited to
the following:A. Transportation System Improvement
Program (
TSIP)Fees.B. Police
Facility Fees C. Fire
Facility Fees D. School
District Fees 7. Prior to start of construction, the existing
main water line on the site shall be relocated out to Pixley Street
to the satisfaction of the
Water Department.8. Street trees shall be provided as required
by Community
Services Department.Conditions #9 - #12 shall be complied with to
the satisfaction of the Fire
Department.9. An approved fire sprinkler system must be
installed throughout the building per O.M.C. 15.32.080 section 10.306(
a).The system shall be designed per N.F.P.A. 13R, U.B.C. Chapter
38 and U.B.C. Standard 38-1. The sprinkler system requires
24
hour supervision.10. The Fire Department connection shall not be
affixed to the building. The Fire Department connection must be
located at least 40 feet away from the building, within 40 feet of
a fire hydrant, and on the address side of the
building, unless otherwise determined by the
