RES-8017 Granting Conditional Use Permit No. 1949-92RESOLUTION NO. 8017 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE UPHOLDING THE RECOMMENDATION OF THE PLANNING COMMISSION OF THE CITY OF ORANGE AND GRANTING A CONDITIONAL USE PERMIT TO ALLOW CONSTRUCTION OF AN ACCESSORY SECOND DWELLING UNIT UPON PROPERTY SITUATED AT 1614 HUNTERS WAY. CONDITIONAL USE PERMIT 1949- 92 APPLICANTS: TOM , SHEILA HAMILTON RECITALS:After report thereon by the Planning Commission andafterduepublichearingsasrequiredbylaw, and after receivingarecommendationfromthePlanningCommission, recommending, by Resolution No. PC 8-92, that Conditional Use Permit 1949-92, be granted to allow construction of anaccessoryseconddwellingunituponpropertysituatedat1614HuntersWay, the City Council considered Conditional Use Permit 1949-92, and determined that the recommendation of the PlanningCommissionshouldbeupheldandConditionalUsePermit1949-92 be granted. Subject property is more particularly described inExhibit " A" which is attached herein.During the public hearing, the City Council found the facts as follows:1. That theapplicantsownasingle-family residence located in the OrangeParkAcresarea. The parcel measures slightly more than one acre, and is situated at the intersection of Santiago Canyon Road and Hunters Way, a private street.2. Thattheapplicantsproposeadetached "accessory second unit" through CUP1949. The dwelling unit is entirely self-sufficient, containing a living area, bedroom, kitchen and bathroom overatwo-car garage, which is provided supplementary to the 3-car garage that is attached to the existingresidence.The project is consistent with thedevelopmentstandardsestablishedforthesingle-family residential district in additiontoOrangeMunicipalCodeSection17.10.040(H), theprovisionsallowingsuchanadditionsubjectto the Council's review and approval by conditional use permit.3. That the Planning Commission reviewed the project atadUly-noticed public hearing on February 19, 1992. The commissionnotedthatthesecondunitisappropriatelylocatedatalowerelevationonthehillsideparcel, agooddistancefromadjacentresidentialproperties. Alternate designsandlocationswerebrieflydiscussed. The commission asked whethertheapplicantconsideredasingle-story project, situated withalittlemoredistancebetweenHuntersWayand thenewstructure. The applicant's representative replied that the project wasdesignedtotakeadvantageofthehillside, with the pedestrian entry hidden below grade, around the "back" of the building. NOW, THEREFORE, BB :IT RESOLVED by the City Council of the city of Orange that Conditional Use Permit 1949-92 be granted for the following reasons:1. The project is designed to integrate the accessory second dwelling unit in a manner that is appropriate to the neighboring residential development.2. The project is consistent with the city's Zoning Ordinance and General Plan, including the Orange Park Acres planning area.BE :IT FURTHER RESOLVED that Conditional Use Permit 1949-92 be granted subject to the following conditions:1. The existing block wall shall be relocated along santiago Canyon Road so as not to encroach upon public right of way, reconstructed wholly upon the applicant's property. The wall shall be relocated as a function of the building permit process, and construction complete before final inspection.2. A grading plan shall be submitted by the applicant,subject to review and approval by the Department of Public Works.3. The structure shall comply with the requirements of Municipal Code Chapter 15.52 (Building Security Standards, Ord.7-79), which relates to the use of specific hardware, drawings shall include sections of the ordinance that apply under Security Notes".4. Both residential units on the parcel shall be addressed per City standards of addressing, which pertain to location,color, height and illumination. A second address number shall be displayed where the driveway meets the private street.5. The site is located within a climatic and topographic high hazard and fire zone (Ordinance 5- 87), which requires all building construction to have class A fire retardant roofs with fire stopped and enclosed eaves. In addition, a spark arrestor with a maximum one-half inch screen is required on chimneys.6. Development fees will be tabulated and payment required upon the issuance of a building permit. Fees include, but are not limited to, the following: Sanitation District, Sewer Connection, Transportation System Improvement Program, Major Thoroughfare and Bridge, Park Acquisition, Police Facilities,Fire Facilities, Eastern Foothill Transportation Corridor, School Development, Building Division plan check, permit issuance and recordation fees.7. All plans shall conform substantially with plans and conditions approved by the Planning 8. Conditional Use Permit #1949-92 shall expire 24 months from the date of approval, should the proposal be abandoned.ADOPTED this 26th day of May 1992.
